M. on the above date, in the Council Chamber of the City Hall of said City, by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Hesser; Love and Mayor Binder. Councilmen Absent: Gerow and Selby. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 21st day of April, 1937, were read. No errors or omissions appearing, it was moved by Councilman Hesser, seconded by Councilman Love, the minutes be approved as read. Carried. WRI IT'! EN COrIYUNI CATIONS. The following communications were read and disposed of in the manner indicated following the reference to each hereinafter: VAR DEPART,°TIT, UNITED STATES ENGINEER OFFICE, Los Angeles, California, dated April 21st, 1937, being notification that D. H. Monstad, Redondo Beach, has made application for War Department permit to construct an extension to an existing wooden pier in Santa Monica Bay at Redondo Beach and advising that interested persons, who have objection to the issuance of the permit applied for, must submit such objections in r,Titing on or before 11 :00 A. M., May lst, 1937. Ordered filed. CITY CLERK, CITY OF ?AVHATTAN BEACH, dated April 21st, 1937, submitting a certified copy of a certain resolution adopted by the City Council of said ") City _prior to April 21st, respecting the matter of grade separation at Rosecrans Avenue and Wiseburn Avenue, in the City of Manhattan Beach. Ordered filed. CITY CLERK, CITY OF :'!ANHATTAN BEACH, dated April 26th, 1937, advising that he had been directed by the City Council of the City of Manhattan Beach to notify the City Council of the City of El Segundo of the adoption April 15th, 1937, by the City Council of the former City, of a certain resolution respecting the matter of grade separation of the crossing of the A. T. & S. F. Railway at Rosecrans Avenue and Wiseburn Avenue in the City of Manhattan Beach, and to request the City Council of the City of El Segundo to take similar action. By general consent the City Engineer of the City of E1 Segundo was instructed to confer with the City Engineer of the City of Manhattan Beach, for the purpose of obtaining more information respecting the subject matter of the Manhattan Beach resolution hereinbefore referred to, and to report his findings to this Council at its next regular meeting. Councilman Gerow appeared at the meeting at this point, the hour being 7:18 o'clock P. M., and he immediately took his seat at the Council Table. UNION OIL COIIDANY OF CALIFORNIA, dated April 22nd, 1937, being an application for a permit to drill a well to be known as "E1 Segundo No. 3n, for the purpose of producing oil, gas or other petroleum products. Aloved by Councilman Hesser, seconded by Councilman Love, that Resolution No. 372, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, GRANTING TO UNION OIL COMPANY OF CALIFORNIA A PERMIT FOR THAT CERTAIN OIL WELL IN SAID CITY DESIGNATED AND KNOWN AS "EL SEGU,TDO NO. 3 ", which was read, be adopted. LEVITT, dated April 28th, 1937, an application for employment by the City of E1 Segundo. Ordered filed. LEON ADA14S, dated April 27th, 1937, an.application for employment by the City of E1 Segundo. Ordered filed. For cutting weeds on vacant lots in the City of El Segundo, bids were received as follows: H. BARBETTINI, dated April 28th, 1937, quoting $2.75 per acre. W. D. SICYJ ER, dated April 27th, 1937, quoting $2.50 per acre. Following consideration, it was moved by Councilman Love, seconded by Councilman Gerow, that the viork of cutting weeds and grass on vacant lots through- out the City of El Segundo be awarded W. D. Sickler at the price named in his bid filed with this Council this date, to -wit: $2.50 per acre; it being provided that the work shall begin and be prosecuted and completed at the discretion and under the supervision of the Street Superintendent of the City of E1 Segundo. LEAGUE OF CALIFORNIA T- JUNICIPALITIES, its Report No. 1, dated April, 1937, respecting swimming pools, their cost, operation and maintenance. Ordered filed. CIVIC U14ION OF PLAYA DEL REY, being copy of a letter addressed to the' Board of Health of Los Angeles City by said Union, April 23rd, 1937, to which was attached copy of a resolution adopted by said Body at its special meeting held April 21st, 1937, respecting the dumping of sewage screenings on the surface of the ground on land lying between the City of E1 Segundo and Playa Del Rey. It appearing that the practice referred to in the before mentioned resolution is one which heretofore has been called to the attention of this Council and which if permitted to continue will become a menace to the health of all persons within a radius of many miles thereof, and that the nuisance should be abated at the earliest possible time, it was moved by Councilman Hesser, seconded by Councilman Gerow, that the following resolution be adopted: VMEREAS, from time to time during several weeks past, this Council has-been the recipient of complaints from numbers of its townspeople concerning foul odors and an infestation of flies and mosquitoes emanating from a source unknovm; and WHEREAS, investigation discloses that the origin of these nauseous odors and winged pests is a mass of sewage screenings, which has been transported from the sewage screening plant of the City of Los Angeles located at Hyperion, and dumped upon the surface of the ground at a point northerly of the northerly city limits.of the City.of El Segundo, lying between Pershing Drive and the 'sand dunes easterly of the Pacific Ocean, for the apparent purpose of drying such screenings; and TIHEP.EAS, the dumping of this excrement in such manner, with seeming disregard for the rights of citizens residing in the vicinity of such dump, is revolting to the senses and wholly inconsistent with vaunted modern methods of sanitation and health control; creates a breeding place for rodents and vermin; presents possibilities of contamination of domestic water sources and is in every aspect wholly intolerable in or near any municipality worthy of the name and should not be countenanced by any governmental agency charged with the responsibility of preserving the public health and safety; 0 -5 1 � NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of E1 Segundo does hereby go on record as expressing its displeasure with the existence of the fetid nuisance hereinbefore referred to and hereby directs the City Clerk of the City of El Segundo to forward to the City Council of the City of Los Angeles, the Board of Public Works of the City of Los Angeles, the Health Officer of the City of Los Angeles, the Health Officer of the County of Los Angeles, and the Association of City Planners of Los Angeles County, each a certified copy of this resolution, which it is hoped will be accepted by the one or more of such Bodies as have jurisdiction thereover, as a respectful but urgent request that it or they take such immediate action as is necessary to cause an abatement of this menace to health and to prevent a recurrence thereof. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Love and Mayor Binder. Noes: Councilmen None. Absent: Councilman Selby. At this point, the City Engineer submitted data which had been handed him by representative of the office of the City Engineer of the City of Los Angeles, respecting A. B. 728, now under consideration by the State Legis- lature, which if enacted into law, would allocate to the County of Los Angeles and to the incorporated cities thereof, based upon the population of the respective political subdivisions, that portion of gasoline taxes and motor vehicle taxes which heretofore has been paid by the State directly to the Board of Supervisors of Los Angeles County. The question being moot, no action thereon was taken by this Council. .None. REPORTS OF STANDING C0181ITTEES. REPORTS OF OFFICERS AND SPECIAL COP.!MITTEES. Kenneth E. Campbell, City Forester, reported having unsuccessfuly attempted to locate stocks of trees suitable for purchase by the City to replace dwindling stock, expressing the belief, however, that he will be able to obtain some quotations on suitable trees in the very near future; also that during the prior week he had planted fifty trees, thirty being replacements and twenty in new locations. He explained, too, about the other activities of his department and of the spraying of trees during the prior week. The City Engineer reported having, as directed, checked the wiring at El Segundo High School for the purpose of determining whether or not it would carry the load represented by the installation of four 1500 -watt lamp units for flood lighting the public street in front of the High School on such times as public events are taking place in the High School; that he had an electrician accompany him but as yet they have not arrived at any satisfactory conclusion, the plans are being studied and doubtless a definite answer will be forthcoming at the next regular meeting of the Council. The City Attorney reported that the matter of the suit of the City of Los Angeles Department of Water and Power against the City of El Segundo for permission to construct, maintain and operate a 332000 volt power line in, through and over certain of the public-streets of the City of El-Segundo" came on for hearing in Department 9 of the Superior Court of Los Angeles County on the -27th-day of April, 1937; that approximately 1 hour and 45 minutes was used in the presentation of arguments respecting the matter and that the Court granted the City of Los Angeles permission to construct, maintain and operate its line through the City of El Segundo, but ruled in favor of said City of E1 Segundo on five of the six terms or conditions which the City of E1 Segundo contended should be incorporated in the Court order granting the permit. The point lost by the City of El Segundo was the term or condition reauiring the Bureau of eater and Power of the City of Los Angeles to provide service to any consumer in the City of El Segundo who might demand service from C 0 -7: said Bureau. The City Attorney stated further that a copy of the Court order would be filed with the Council at a future date. The City Attorney reported having examined the form of Notice to Bidders and the specifications for the installation of an aeration system and chlorina- tion plant for the Pater Department of the City of E1 Segundo, as heretofore submitted by Taylor and Taylor, Consulting Engineers, which, he stated, was satisfactory to him as to legal form. It was thereupon moved by Councilman Hesser, seconded by Countilman Love, that the specifications (and plan) for furnishing one chlorinator, its installa- tion and all necessary appurtenances, dated April, 1937, and submitted to this Council April 21, 1937, by Taylor and Taylor, Consulting Engineers, be and the same are hereby apnrovided by this Council and the original thereof ordered placed on file in the office of the City Clerk and one copy thereof filed in the office of the City Engineer of the City of E1 Segundo. Carried by the following vote: Ayes: Councilmen Gerow, Hesser, Love and Mayor Binder. Noes: Councilmen None. Absent: Councilman Selby. The Superintendent of the Water Department reported that in the prosecu- tion of the alterations required to the Water Department reservoir, he had employed certain persons and requested that his 'action be ratified and approved. Moved by Councilman Love, seconded by Councilman Gerow, that the action of the Superintendent of the Water Department of the City of El Segundo in employing E. R. McCartney, J. J. Lind, Fred Kenney, F. McGra.nahan and D. S. Phillips -as r°echanics Second Class, and Lloyd Wilson and Clifford Smith as Laborers, said Mechanics of the Second Class to be compensated at the rate of 75, per hour and said laborers at the rate of 70¢. per hour for such time as each shall Ectually perform or render service to the City of E1 Segundo, be and the same is hereby ratified and approved. The City Clerk reported that the sponsors of the Bible Study Group, vrhich has been using the City Hall Auditorium on each Tuesday night, for several creeks for the holding of religious service under the name of Bible Fellowship Hour, have advised him of their inability to procure other quarters for the holding of their meetings and requested that they be granted permission to use the City Hall Auditorium for the said purpose for a term beyond that originally granted. It was thereupon moved by Councilman Love, seconded by Councilman Gerow, that the group of citizens comprising the Bible Study Hour be and they are hereby granted permission to use the City Hall Auditorium each Tuesday night during the month of P :ay, at a nightly rental charge of $1.25, provided this permit and the use of said Auditorium is subject to the prior right of the public to use said auditorium on any of said nights for a meeting of general public interest; provided further that the perm±ttee be requested to seek other quarters prior to the termination of this permit. Moved by Councilman Gerow, seconded by Councilman Love, that the Junior t'oman's Club be and it is hereby granted permission to use the City Hall Auditorium on the evening of May 3rd, for the purpose of conducting a fashion show, no charge to be made for such use. Carried. Moved Ity Councilman Gerow, seconded by Councilman Love, that E1 Segundo Recreational Council be and it is hereby granted permission to use the City Hall Auditorium on the evening of May 21st, for the purpose of holding a public dance, no charge to be made for such use. Carried. Hioved by Councilman Hesser, seconded by Councilman Gerow, that the purchase of 200 feet of "Theft Proof" hose for the Park Department be and the same is hereby authorized, the total cost thereof not to exceed $40.00, plus California. State Sales Tax. Carried by the following vote: Ayes: Councilmen Gerow, Noes: Councilmen None. Absent: Councilman Selby. Hesser, Love and Mayor Binder. Moved by Councilman Love, seconded by Councilman Gerow, that the purchase of tnro tires and two tubes for the motorcycles of the.City of E1 Segundo be and the same is hereby authorized, the total cost thereof not to exceed $19.00, plus California State Sales Tax.
