A regular meeting of the City Council of the City of E1 Segundo, California, was called to orl.er at 7:00 o'clock P. M. on the above date, in the Council Chamber of the City Hall of said City, by Peter E. Binder, Mayor. ROLL CALL. Councilmen Present: Gerow, Hesser, Selby and Mayor Binder. Councilmen Absent: Love. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 4th day of December, 1935, were read. No errors or omissions appearing, it was moved by Councilman Selby, seconded by Councilman Gerow, that the minutes be approved'as read. Carried. WRITTEN COMMUNICATIONS. The following communications were read and disposed of as indicated: EL SEGUNDO KITANIS CLUB, dated December 11th, 1935, requesting the Council's support and favorable action upon a resolution adopted by said Club December 5th, 1935, petitioning this Council to erect or to cause to be erected boulevard stop signals on Sepulveda Boulevard at the Northerly and Southerly property lines of Imperial Highway. By general consent action in the matter was postponed until the next regular meeting of the.Council. STATE COMPENSATION INSURANCE FUND, dated December 4th, 1935, advising that the indemnity has been fixed in the matter of Case No. 824361 - Robert C. Grow, deceased, advising the amount thereof and expressing the hope that the adjustment meets with the Council's approval. Ordered filed.. SHELL OIL COMPANY, dated December 7th, 1935, requesting a permit to drill two 6" test holes in a portion of the East 1/2 of Section 1, Township 3 South, Range 15 West. Moved by Councilman Hesser, seconded by Councilman Selby, that the following resolution be adopted: RESOLVED, that the communication. of Shell Oil Company ". dated December 7th, 1935, requesting permission to drill two 6" test holes to a depth of 150 feet in the East 1/2 of Section _1, Township 3 South, Range 15 West, be and the same is hereby filed for identification and reference, and that permission to to drill test holes referred to in said communication is hereby granted, upon the conditions hereinafter set forth, as follows, to -wit: That by proceeding under the provisions of this permission, said Company shall automatically thereby agree and be bound- lst. - To make such tests at the points named in its said communication, to -wit: One on California Street, 600 feet South of Grand Avenue; one in the approximate center of Lot 16, C. C. Hunt Subdivision. 2nd. = To-indemnify the City of E1 Segundo; California, and each and all of its officers, agents, servants and employees from and against any and all damage or claims of damage of any kind, nature or description whatsoever, which may arise out of or be due indirectly or directly to the making of said survey yor any act in connection therewith; and 3rd. - That said Shell Oil Company shall immediately pay, upon proper demand therefor, any and all damages which may be occasioned to either persons or property or both, and which may be suffered by, through or on account of, or which may arise out of the making of said survey, or the doing or failure to do of any act in connection therewith. The foregoing resolution was adopted by the following vote: N46 Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. RAILROAD COMMISSION OF THE STATE OF CALIFORNIA, dated November 4th, 1935, a copy of its order initiating investigation in the matter of Case No. 4087 for the establishment of minimum rates, rules and regulations for highway carriers. Ordered filed. LEAGUE OF CALIFORNIA MUNICIPALITIES, dated December 6th, 1935, calling attention to hearings which will be had before the Railroad Commission of the State of California respecting the establishment of rates, rules and regulations for highway carriers. Ordered filed. ORAL COMP,.UNICATIONS. Colonel Barnitz, Manager, Los Angeles Municipal Airport, addressed the Council, urging its cooperation in the matter of the application of the Y,ater and Power Department of the City of Los Angeles for a permit to erect, maintain and operate a power line within the City of E1 Segundo. Colonel Barnitz was advised that the City Engineer of the City of E1 Segundo will make a survey of the situation, with an engineer from said Water and Power Department of the City of Los Angeles, thereafter reporting to this Council, following receipt of which report the matter will be given further consideration. REPORTS OF STANDING COMMITTEES. Councilman Selby advised that E1 Segundo Recreational Council hAd approached him with respect to obtaining the City's assistance in connection with Christmas Tree festivities this year and action in the matter was deferred pending more definite information as to what assistance is wanted. Councilman Gerow advised that Mr. K. E. Campbell had submitted to him a list of tools and equipment needed in connection with caring for trees throughout the City, whereupon it was moved by Councilman Hesser, seconded by Councilman Gerow, that the purchase of tools and supplies for.use in connection with planting and care of trees throughout the City be and the same is hereby authorized at a cost of not to exceed $18.00. Carried by the - following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor.Binder. Noes: Councilmen None. Absent: Councilman Love. REPORTS OF OFFICERS AND SPECIAL COMMITTEES. The City Attorney requested an additional week's time to report upon the matter of the amount of permissible expenditures for the fiscal year 1935 -1936, inasmuch as the State Board of Equalization has not as yet replied to his communication addressed to it respecting the matter. The City Clerk reported there had been filed with him the affidavit of Leona Ruth Grow respecting a certain sum which was due her husband as an employee of the City of El Segundo prior to his death. The affidavit appearing• to be in satisfactory form, it was moved by Councilman Gerow, seconded by-- Councilman Selby, that the following resolution be adopted: AREAS, on December 4th, 1935, Warrants Nos. 27345 and No. 27361 in amounts of $30.72 and 116.62 respectively were ordered drawn, payable to the order of Robert Grow, for services rendered the City of E1 Segundo for the month ended November 30th, 1935; and FIHER.EAS, Leona Ruth Grow, widow of the said Robert. Grow, has filed an affidavit with this Council,_setting forth the fact that the said Robert Grow left no estate or property which requires probate and that therefore no probate proceedings are contemplated; that she is the surviving widow of Robert Grow, deceased, and that all of the said earnings of the said balance of $147.34 so earned by said Robert Grow and consti- tuting community property be paid to herd NOW THEREFORE BE IT RESOLVED, that in view of the affidavit of Leona Ruth Grow respecting services rendered the City of El Segundo by her deceased husband, filed with this Council this date, City of E1 Segundo Warrants Nos. 27343 and 27361, ordered drawn and paid December 4, 1935, in payment of services rendered the'City of El Segundo by Robert Grow between the dates November 1st, 1935 to November 17th, 1935, be and the same are ordered cancelled, and the City Clerk of the City of E1 Segundo is hereby authorized to draw a new warrant in the sum of $147-.34, payable to Leona Ruth Grow, in payment of the services rendered the City of E1 Segundo by her deceased husband., iietneen the dates hereinbefore mentioned, and the Mayor of said City is hereby authorized to sign the same, and the City Treasurer is authorized to accept the same and pay said warrant upon presentation. The foregoing.resolution was adopted by the following vote: Ayes: Councilmen Gerow, Hesser, Selby and Mayor Binder. Noes: Councilmen None. Absent: Councilman Love. PAYING BILLS. Moved by Councilman Gerow, seconded by Councilman Selby, that the Street Superintendent be and he is hereby authorized and directed to cause the Christmas tree in Library Park be decorated and lighted over the Christmas holidays. Carried. ' The City Engineer submitted for the Council's consideration Project Statement No. 1. addressed to Director of Public Works, Sacramento, California, 'dated December 10th, 1935, setting forth the program of improvement to streets of major importance within the City of El Segundo during the current fiscal year. After examination of the same, it was moved by Councilman Hesser, '. seconded by Councilman Selby, that the following resolution be adopted: its RESOLVED, that Project Statement No. 12 dated December 10th, 19359 addressed to the Director of Public Works, Sacramento, California, to be transmitted through S. V. Cortelyou, District Engineer, Los Angeles, California, prepared pursuant to Sections 194 and 195 of the Streets and Highways Code, showing the program of improvement for streets of major importance within the City of E1 Segundo; showing 631octtions'of• funds for the maintenance of certain streets within said City as follows: Imperial, Highway - - Main Street - - - - Grand Avenue - - - E1 Segundo Boulevard Coast Boulevard - - Rosecrans Avenue - - $290.00 100.00 300.00 700.00 175.00 200.00 which said allocations are for the fiscal year ending June 30th, 1936, be and the same is hereby approved, and the Mayor of the City of E1 Segundo is hereby authorized and directed to sign said statement in duplicate on behalf of said City and the City Engineer is hereby authorized and directed to cause said statement in duplicate to be filed with said Director of Public Works. Carried. No further business appearing to be transacted at this session, it was moved by Councilman Gerow, seconded by Councilman Selby..-that the meeting adjourn until Thursday, the 12th day of December, 1935, at the hour of 4:15 o'clock P.
