1933 JAN 04 CC MIN1001; El Segundo, California. January 4th, 1933. A regular meeting of'the City Council of the City of E1 Segundo, California, was called to order at 7:00 o'clock P. M. on the above date, in the "Council Chamber of the City Hall of said City, by Peter E. Binder, Mayor. ROLL CALL, Councilmen Present: Gerow, Krim e1, Love, Selby and Mayor Binder. Councilmen Absent: None. Kt -ADING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 28th day of December, 1932, were read. No errors or omissions appearing, it was moved by Councilman Srimmel, seconded by Councilman Gerow, that the minutes be approved as read. Carried. WRITTEN COUMUNICATIONS. The following communications were read and disposed of as indicated: DOROTHY GRACE MORTON, dated January 4th, 1933, being an application for appointment to the position of stenographer in the office of the Water Department of the City of E1 Segundo. Ordered filed. EVELYN EATON, dated January 4th, 1933, requesting consideration in the matter of the selection of a secretary in the office of the Water Department of the City of E1 Segundo. Ordered filed. MISS CLARA EATON, dated January 3rd, 1933, being an application for position as secretary- bookkeeper in the office of the Water Department of the City of E1 Segundo. Ordered filed. LOS ANGELES COUN'T'Y LEAGUE OF MUNICIPALITIES, dated December 30th, 1932, advising that the January meeting of said League will be held in Pasadena, January 12th, at 6:30 o'clock P. M. Ordered filed. LOS ANGELES COUNTY LEAGUE OF MUNICIPALITIES, dated December 30th, 1932, advising of the adoption of a resolution by said League at its meeting held December 21st, 1932, requesting the various cities within the County of Los Angeles to cooperate with Lang & Miller to the extent of furnishing from the records of the various cities such information as said engineers may request to enable them to prepare a comprehensive report of all special assessment districts in the County of Los Angeles to the end that applications may be made for an equitable distribution of any funds which may be appropriated by the County of Los Angeles or the State of California for the relief of any such districts which may be in distress. Ordered filed. C. R. REED, Committee Secretary, California Utilities Association, dated December 30th, 1932, advising of a meeting hel$•in San Francisco, December 28th, 1932, of-representatives from the City of LosAngeles, the City of San Francisco and the East Bay Municipal Utility District, for the purpose of discussing Federal taxation of cities and state agencies, as contemplated by the Treasury Department of the United States. The letter set forth also a number of recommendations approved by the representatives present at said meeting, and requested the adoption of a resolution recommending certain amendments to the Revenue Act of 1932. After consideration of the proposed resolution, it was moved by Councilman grimmel, seconded by Councilman Gerow, that the following resolution be addpted: 4,101 WHEREAS, it has come to our attention that certain Federal Agencies contemplate submitting to Congress certain amendments to the Revenue Act of 1932, which amendments will in our opinion, result in a tax burden Upon States, State Agencies and /or publicly owned utilities, and S , AS, we are of the opinion that any tax created by Congress which results in the imposition of any burden upon States, State Agencies and /or publicly owned utilities is contrary to public policy, NOW, 7HEREFbRE, BE IT RESOLVED, that we, the City Council of the City of E1 Segundo, State of California, protest any Federal taxation which imposes, or may be interpreted to impose, a burden upon States, State Agencies and /or publicly owned utilities. HE IT FURRTEER RESOLVED that we recommend the adoption of the following amendments to the Revenue Act of 1932: 1. In the enforcement of the Revenue Act of 1932 the Federal Government shall not impose an obligation upon any State or territory or Political subdivision thereof, or the District Of Columbia, or on the officers or employees of the aforesaid. 2• The term "Political subdivision" includes any district created under the laws of a State or territory for the purpose of constructing or operating any public utility. BE IT FURTHER RESOLVED that Senators Tohnson and Shortridge and Representatives Swing and Crail of the 11th and 10th Congressional Districts of California, be and they are hereby urged to assist in protesting any such tax and to submit the above amendments to their respective bodies for immediate passage. BE IT FURTHER RESOLVED that accredited representatives from the cities of San Francisco, Los Angeles and the East Bay Municipal Utility District be and they are hereby authorized and requested, in the name of the City of E1 Segundo to protest any such tax. The foregoing resolution was adopted by the following vote: Ayes: Councilmen Gerow, Kimmel Noes: Councilmen None. ' Love, Selby and Mayor Binder. Absent: Councilmen None. ORAL COM=ICATIONS. At this point the Mayor addressed a group of part time municipal employees, who were present in the Council Chamber, explaining that In order to keep within the limit of taxes levied for the conduct of the business of the City of E1 Segundo for the fiscal year 1932 -1933, it would be necessary to dispense with their services. It appearing from brief discussion which followed, that these gentlemen would like to assemble at some future time to discuss the situation among themselves, they were offered the use of the Council Chamber, Tuesday evening, January 10th, 1933. REPORTS OF STANDING CONISIT TES. REPORTS OF OFFICERS AND SPECIAL C018dITTEES. The City Clerk reported that the permit heretofore granted Foster & Kleiser t�o maintain a billboard at the Northwest corner of E1 Segtuido Boulevard and Main Street within the City of E1 Segundo had expired and that said Company had made application for renewal of same by tendering a check in payment of the annual license fee required for the maintenance of billboards within the City of E1 Segundo. It was thereupon moved by Councilman Love, seconded by Councilman Gerow, that the following resolution be adopted: RESOLVED, that Foster & Kleiser Company be and it is hereby granted permission to maintain and operate a billboard or signboard at the Northwest corner of E1 Segundo Boulevard and Main Street within the City of E1 Segundo, said billboard being the same, and in the same location as that heretofore maintained and operated by said Foster & Kleiser Company-under previous permits granted by this Council; provided, however, that this Council reserves the right-to revoke the within permit at any time upon refunding to the holder thereof a pro rata portion of the fee paid therefor, whenever, in the discretion of said Council, the public interests, necessity or safety of said City demands that the said permit be revoked, and the said billboard be removed; and provided further, that said billboard be main- tained in accordance with all of the provisions of Ordinance No, 45 of the City of E1 Segundo, and all other existing ordinances or ordinances which may hereafter be adopted apperhaining thereto; and BE IT FUR RESOLVED, that the draft of Foster and Kleiser Company, in the sum of $10.00, tendered by said Company in payment of the license fee for the year January let, 1933 to December 31st, 1933, be accepted by the City Clerk as payment of the fee for the license herein granted. Said resolution was adopted by the following vote: Ayes: Councilmen Gerow, grimmel, Love, Selby and Mayor Binder, Noes: Councilmen None. Absent: Councilmen None. The City Engineer reported having received from A. T. & S. F. ttailway Company a form of easement for street and /or road purposes over said Company's right of way at imperial riighway and Redondo Boulevard, in favor of the City of E1 Segundo, with the request that the same be presented to the pity Council for its approval and acceptance. tie stated, however, that he does not approve from an engineering standpoint the description of the crossing as set forth in said form of easement and that, therefore, he was referring the matter to the City Attorney for an opinion. The City Clerk reported having had a telephone conversation with !4r. Summerfield of the American Bitumuls Company relative to a license mixture agreement covering the products of said Company, which may be used in the improvement of Arizona Drive within the City of E1 Segundo and that Mr. Sun= rfield had informed him that the form of license mixture agreement heretofore filed with the City of hl Segundo prior to the improvement of Imperial highway is and will remain a good and valid agreement until cancelled by said i;ompany and that therefore the same will suffice for use,in connection with the-proposed Arizona Drive ,.improvement. fhe City Attorney reported also that he had had a'telephone conversation with liar. Guy Smith of the same Company, who likewise advised that the license mixture agreement at present on file with the City of ll Segundo may be used in connection with the proposed &rizona Drive improvement.
