1931 FEB 11 CC MIN42 1C, E1 Segundo, California. February 11th, 1931. A regular meeting of the City Council of the City of El Segundo, California, was called to order at 7 :00 o'clock P. M. on the above date, in the Council Chamber , of -the City Hall of said City, by George Love, Mayor. ROLL CALL. Councilmen Present! "Binder, Gerow, Krimmel and Love. Councilmen Absent: Selby. READING OF YUNUM.S OF PREVIOUS LZETING. The minutes"of the regular meeting held on the 4th day of February, 1931', were read. "No errors or omissions appearing, it was moved by Councilman Binder, seconded by Councilman Gerow, that the minutes be a: proved as read. Carried. WRITTEEN COI NICATIONS. The following communications were read and disposed of as indicated: BOARD OF REGISTRATION FOR CIVIL FINGINHYMS, dated February 10th, 1931, calling attention to the fact that the Map Act, Chapter 837, Statutes of 1929, requires that all maps submitted for recordation shall have affixed thereto the seal of a Licensed Surveyor or a Civil Engineer, and that in accordance with the Civil Engineer's Act, Chapter 801, Statutes of 1929, any Civil Engineer filing such a map, must be registered. Ordered filed. CALIFORNIA STATE C'RA =, R OF OD L ,ERCE, dated February 2nd, 1931, calling attention to an article in the January edition of the California Tournal of Development, respecting the necessity of public street and road construction for the relief of unemployment, and advising further that separate copies of said Journal were being forwarded for the respective officers of the City. Ordered filed. LEAGUE OF CALIFORNIA LM. IC IPALITIES, dated February 2nd, 1931, being its Legislative Bulletin No. 2, respecting Senate Bill No. 386, which provides that such portions of city streets as happen to form the continuation of a state highwa7, shall be deemed a part of the State Highway System, which the State will have to build and maintain but of the Gasoline Tax Fund, and requesting the Council to write to the Senator and Assemblyman from this District, urging their'support of such bill, if this Council approves the same. The Bill was thereupon referred to the City Attorney for examination and co=ent, and following his explanation of the same and approval thereof, it was moved by Councilman Binder, seconded by Councilmen Krimmel, that the City Clerk of the City, of El Sezuado, on behalf of the City Council of said City, urge the Senator And Assemblyman representing. this District in the Legislature of the State of California, to lend their support and aid to the adoption of Senate Bill Ito. 386, provided the same is adopted in substantially the same form as introduced by Senator Crittenden, January 21st, 1931, Carried by the following vote: Ayes: Councilmen Binder, Gerow, Krimel and Love. Councilman Krimmel of the Public Works Committee, reported that a recent inspection of the City Hall indicated certain repairs were needed in the basement thereof, and he thereupon moved that additional electric wiring conduit be installed, that the valves on certain oil lines be changed, that portions of the ceiling and walls of the City Hall basement be fireproofed, at a total cost of not to exceed 025.00, ani that �ucl_ work, so far as possible, be done by mun_cipal emrloyees. The motion was seconded by Councilman Geroc., and carried by the folloc:inr vote: Ayes: Councilmen Binder, Gerow, Fsimmel and Love. Noes: None. Absent: Councilman Selby. REPORTS OF OFFICERS ARID SPECIAL COI.I, =TZES. The City Clerk reported that since the gong attached to the Fire Department telephone has been removed from the outside of the Westerly wall of the City Hall -wilding to the interior of the Fire apparatus Room, the Fire En ^ine Drivers do not hear the said gong ring while they are performing janitor service in the City hall -!nex, and that the gong should arrain be placed on the outside of the building, to avoid the probability of failure to receive an alarm of fire. "ollor,ino discussion, it was moved by Councilman Binder, seconded by Councilman Krimmel, that the City Clerk be and he is hereby authorized aad directed to cause the gong attached to the Fire Department telephone, to be affixed to the exterior of one of the walls of. the City Hall or the City ::all Annex, at a location which will make it audible to the Fire Engine strivers while they may be workine in the City 11all Annex or around the grounds adjacent to the City Hall, the total cost of this work not to exceed 45.00. The City Clerk reported that the Altar Society of St. Antheny's Church had requested permission to use the City Hall Auditorium on a certain date, whereupon, following consideration, it was moved by Councilman Gerow, seconded by Councilman Binder, that the Altar Society of St. Anthony's Catholic church be and it is hereby granted permission to use the City Hall Auditorium on the evening of February 17th, 1531, for the purpose of giving a benefit card party, no charge to be made for such use. Carried by the following vote: Ayes: Councilmen Binder, Gerow, Krimmel and Love. IJoes: None. Absent: Councilman Selby. The City Clerk reported that the question of' whether or not the City or the firemen personally mould be responsible for personal injuries or property damage caused by an individual fireman driving his own automobile in response to a fire alarm, had been raised by one of 'the' -fire en -of the City of tEl•Seguz:-oi' and followinG an e;cplanation b:; the -.Oily '.ttgrneTr of the *legal_ aspects of the case; th6 City Clerk was directed to ascertain if the Cit;Is insurance carrier would endorse its existing contract v'ith the City, so as to include the operation of the personal automobiles of members of the Fire Department of the City of El Segundo, while such firemen are responding to alarms of fire within the City of E1 Segundo. The City Clerk reported that Hadden Automatic Sprinkler Comnenv had made request for the payment to it of the balance due on its contract with the City of E1 Segundo for furnishing certain pipe and fittings in connection with the sprinkler system at the Library Park, which said payment has been withheld by reason of the fact that there 44 X, c� A y has been unforseen delay on the part of the City in assembling the materials to determine whether or not they conform in all respects to the plans and specifications upon which they were furnished. The City Attorney thereupon examined the contract entered into between the City of E1 SeE-undo and said Hadden Automatic Sprinkler Company for the furnishing of said material, and the Faithful Performance Bond accompanying said contract, and advised that it is likely that the said bond is ample for the protection of the City should it pay the said Hadden Automatic Sprinkler company the balance due it and later ascertain that the materials furnished do not comply with the requirements. Thereupon, it was moved by Councilman Binder, seconded by Councilman Gerow, that the following resolution be adopted: Wry :RAS, on the 29th day of November, 1930, Hadden Automatic Sprinkler Company, a Corporation, entered into an agreement with the City of E1 Segundo to furnish sprinkler system materials to said City at a total contract price of ,5180.00; and WHEREAS, there remains unpaid to said Hadden Automatic Sprinkler Company at this date the sum of $1295.00; and 'AMREAS, the said Hadden Automatic Sprinkler Company has filed its demand for the payment to it of said sum; ;d0`�i"FOR✓, IT RESOLVED, that, conditioned upon the filing with the City Clerk of a letter from the united States Fidelity and Guaranty Company, a Corporation, signed by its Attorney -in -Fact, stating that the coverage of the bond given in connection with that certain agreement to furnish sprinkler system materials, dated the 29th day of November, 1930, by and between the City of E1 Segundo, a Municipal Corporation of Los Angeles County, California, and Hadden Automatic Sprinkler Company, a corporation of Los Angeles County, California, will be extended to cover supervision of the installation of said sprinkler system, as contemplated in the said contract and the plans and specifications therein referred to, notwithstanding the payment of the full contract price, prior to such installation and official acceptance of said material; and HE IT FURVRER RESOLVED, that the demand of said Hadden Automatic Sprinkler Company in the sum of $1295.00, being the balance due said Company on account of the contract hereinbefore referred to, is hereby allowed and warrant therefor ordered drawn upon the General Fund of the Treasury of the City of E1 Segundo, and the City Clerk is authorized to deliver said warrant to said Hadden Automatic Sprinkler Company only upon with said City Clerk o£ the letter hereinbefore referred to from the United States Fidelity and Guaranty Company. Said resolution was carried by the following vote: Ayes: Councilslien. Binder, Gerow, Iirimmel and Love. Noes: None.- Absent: Counc ilman 'Selby. The City Clerk informed the Council that in view of the dis- continuance of the use of the personal automobile of Police Officer T. B. DeBerry by the Police Department of said pity, action should be taken by the Council to terminate the existing contract between the City of E1 Segundo and the said T. B. DeBerry for the use of said automobile. Thereupon it was moved by Councilman Kimmel, seconded by Councilman Binder, that the following resolution be adopted: ff, 44 WHER. -EAS, the City of El Segundo, California, has heretofore under lease dated the 21st day of March, 1930, leased from T. B. DeBerry a certain automobile; AIM WEER AS in said lease provision is made that same may be cancelled upon twenty -four hour's notice of either party to the other; AidD jYn'�'RF.IAS, this Council finds that said automobile is no longer needed for municipal use or purposes; NOW T11EREFORE, IE IT RESOLVED, that said lease be terminated as of the expiration of the period of- twenty four hours' notice as provided in said lease; AND a IT FU3`I'FisR RESOLVED, that the City Clerk is hereby authorized and instructed to cause written notice of such cancellation to be served forthwith upon said T. 3. DeBerry, and that upon the expiration of twenty four hours notice, said lease shall be and remain cancelled and said automobile shall thereupon be restored to said Lessor.
