1929 MAY 10 CC MINJ 147 El Segundo, California. May 10th, 1929. A regular meeting of the City Council of the City of El Segundo, Califomia, was called to order at 7x00 o'clock P. M. on the above date, in the Council Chamber of the City Hall of said City, by Peter E, Binder, Mayors ROLL CALL. Councilmen Present: Gerow, Krimmel, Love, Selby and Binder. Councilmen Absent: None. READING OF MINUTES OF PREVIOUS MEETING. The minutes of the regular meeting held on the 3rd day of May, 1929, were read. No errors or omissions appearing, it was moved by Councilman Love, seconded by Councilman Krimmel, that the minutes be approved as read. Carried. WRITTEN COtIId mCATIONS. The following communications were read and disposed of as indicated: MRS. C. T. AINSWORTH and Family, acknowledging with thanks the expression of sympathy of the Municipal ]nployees in Heir recent bereavement. Ordered filed. WK* J. LOCKS, Executive Secretary, League of California *=icipalities, dated May 3rd, 19299 advising that all difficulties existing in respect to the terms for use of "Uniform Building Code" have been settled, that all cities may adopt the same by reference, and that copies thereof may be had at the price of $1.00 each. Ordered filed. CARL K. CHAPIN, Chairman, Water Supply Committee, of the School of Citizenship and Public Administration Short Course to be held at the University of Southern California, June 17th - 219t, 1929, dated April 27th, 1929, calling attention to and directing the interest of the Council in .the said Course. Ordered filed. A. M. RAWN, Chairman, Sanitary Engineering Committee, of the School of Citizenship and Public Administration Short Course, to be held at the University of Southern California, June 17th - 21st, 1929, dated April 27th, 1929, calling attention to and directing the interest of the Council in the said Course. Ordered filed. ORAL COMUNICATIONS. Mr. C. J. Rambo, of the firm of C. J. Rambo & Co., Public Accountants, addressed the Council relative to the next annual audit of the books and records of the City of E1 Segundo, and stated that he would file a written bid therefor. REPORTS OF STANDING COMMITTEES. Councilman Gerow advised that the dwelling house occupied by the Water Superintendent needs certain renovation and remodeling, which he detailed at some length. Thereafter, it was moved by Councilman Love, seconded by Councilman Krimmel, that alterations to the back porch and kitchen of the dwelling house owned by the City of E1 Segundo and occupied by the Superin- tendent of the Water Department be and the same are hereby authorised, at a cost not to exceed $50900. Carried by the following votes Ayes Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absents bone. REPORTS OF OFFICERS & SPECIAL COIWTTEES. The Chief of Police announced the appointment of W. A. LaMar and W. R. Ellis as Special Police Officers and requested the approval of said appoint- ments, whereupon it was moved by Councilman Gerow, seconded by Councilman Krimmel, that the said appointments be approved. Carried. J The City Clerk reported that El Segundo State Bank had filed its "Consent to Enter Upon Property and Apply Waterproofing ", which will now enable the City to waterproof portions of the South wall of that building commonly referred to as the "Brady Building ", and concerning which the Council has previously taken action. The Council requested the City Engineer to take notice of the filing of such consent and of its authorisation to waterproof the south wall of the building referred to in said doctmment, and to accomplish the Council's instruction at his convenience, giving due notice to the said Bank, so that it may apply such additional treatment as it sees fit. SPECIAL ORDER OF BUSINESS. The hour of 7:30 o'clock P. M. at this meeting having heretofore been fixed as the time for the receiving of bids for the sale of certain municipal property heretofore declared unfit and unnecessary for the use of the City of E1 Segundo, 611 as advertised for sale in the manner provided by law, the Mayor announced the hour of 7 :29 o'clock P. M. and asked if there were any person or persons present who desired to file bids pursuant to the provisions of said advertised notice. The hour of 7x30 o'clock P. N. having arrived and all bids being in, the Mayor declared that the time for receiving bids for the sale of certain municipal property as advertised for, was closed. The Clerk thereupon announced that five bids had been received.. It was then moved by Councilman Love, seconded by Councilman Gerow, that. the said bids received for the sale of certain municipal property, as advertised for, be opened, examined and publicly declared before this Council at this time. Carried. Each and all of the said bids were thereupon opened, examined and publicly declared before said Council, at said meeting, which said bids were found by said Council, to be as follows, to pit: "May 6 - 1929. Russell Haynes bids $26.00 on Tractor. $3.00 enclosed as down payment. Russell Haynes, 219 West Maple Avenue, El Segundo." Said bid was accompanied by currency in the sum of $3900. "El Segundo, Cal. May 7, 1929. To the 1'oard: Dear Sirs - I will pay $25.00 for hand tractor and cultivator. Yours truly, C. F. Turner ". Said bid was accompanied by check in the sum of $5.00, drawn on The First National Bank of El Segundo, payable to the City of El Segundo. "Los Angeles, Calif. May 10th, 19299 City of E1 Segundo, E1 Segundo, Calif. Gentlemen: I wish to file the following bid. Enclosed please find Cashier's Check for $10.00. Item 1. Austin Horse -Drawn 600 Gal. Said bid was accompanied by Cashier's Check No. 147826, in the sum of $10000 drawn on Wilshire & LaBrea Branch, Security -First National Bank of Los Angeles, payable to Victor D. Verlon Boyer ". Said bid was accompanied by silver in the sum of 50¢. "Los Angeles, Cal. 5- 10 -29. Said bid was accompanied by Cashier's Check No. 6685, in the sum of $10.00, drawn on The First National Bank of El Segundo, payable to City of El Segundo. After consideration of the foregoing bids, it waS moved by Councilman Gerow, seconded by Councilman Selby, that the following resolution be adopted: RESOLVED, that pursuant to the determination of this Council with respect to the bids received for the various items of municipal property advertised for sale, as being no longer necessary for municipal use, said respective items of property be and the same are hereby awarded to and ordered sold to the persons hereinafter set forth, for the considerations hereinafter respectively indicated, to -wits Item No. 1 for 1 Austin horse -drawn 600 gallon, wood - stave, sprinkler wagon, shall be and the was is hereby sold to George W. French for the sum of - - - $75.00. Item Not 2 for 1 Austin -horse drawn, 2 yard dump wagon, shall be and the same is hereby sold to J. W. Sinek, for the sum of - - - - - - - - - - - - 45.00. Item No. 3 for 1 Federal gasoline hand tractor with 4 shovel cultivator and lawn mower attachment, shall be and the same is hereby sold to Russell Haynes for the sum of - - - - - - - - - - - 26.00. The persons to whom said respective items are awarded shall make payment within 10 days from date hereof; AND BE IT FURTHER RESOLVED, that the municipal officer having charge of the particular items above referred to is hereby authorized and instructed to make immediate delivery thereof to such respective purchasers upon notification from the City Clerk of said City to the effect that the purchase price thereof as hereinabove indicated has been paid; AND BE IT FURTHER RESOLVED that the City Clerk of said City be and he is hereby authorized and instructed to Peturn forthwith all good faith deposits of unsuccessful bidders on the above items. Absents None, The City Clerk reported that there had been filed with him on the 7th day of May, 1929, at the hour of 4s20 o'clock P. M., petition in re Initial Land Registration LR 698, Marquette, Jr. vs. Mollandan, et a1. The City Engineer thereupon reported that he had examined the said petition and th*t the City of E1 Segundo has no interest in any of the property described in said petition, whereupon, by general consent, the said petition was referred to the City Attorney for farther #nspection, and if to him it appears the City of El Segundo has a01W intereorf-In or,'Woining so" lauds, said City Attorney is authorised to take such steps as he deems proper to protect the City's interest. The City Clerk reported that at the date of the death of C. T. Ainsworth, a former employee of the City of E1 Segundo, to —wits May let, 1929s there was due the deceased for services rendered the City of El Segundo during the month of April, 1929, the sum of $85.00, as evidenced by Warrant No. 14422, ordered drawn and paid by the City Council at its regular meeting held Mal let, 1929, as well as $6.54 for services rendered by the said deceased on the lot daffy of May, 1929, for which no warrant has been ordered drawn, and that Ethel V, Ainsworth, widow of the said Co T. Ainsworth, had filed an affidavit setting forth the fact that she is unable to cash the said warrant, or to collect the said $6.54, for which warrant has not been drawn; that all claims and documents against her deceased husband and all of his debts have been fully paid and discharged; that there will be no estate of said deceased to probate; and that the amount of the claim against the City of El Segundo is so small that it :quid not justify her in instituting probate proceedings to obtain the same; that she is the only person lawfully entitled to the said money and praying that the City Council order said Warrant No. 14422 cancelled and a new warrant in the sum of $91.54 drawn and made payable to her. The Council then discussed the matter at length, whereupon it was moved by Councilman Love, seconded by Councilman Selby, that the following resolution be adopted: RESOLVED, that the prayer of Ethel Y. Ainsworth, set forth in her affidavit of May 10th, 19299 filed with this Council this date, be and the same is hereby granted, and that the Mayor, City Clerk and City Treasurer of the City of El Segando be and they are hereby authorised and instructed to make, execute and deliver municipal warrant, drawn on the General P=d of the said City for the sum of $91.54, payable to the order of said Ethel V. Ainsworth, in full and couplets satisfaction of the claim of Claude T. Ainsworth against the said City, for all services rendered; reserving unto this Council the right to determine whether or not any additional sums may be due said Claude T. Ainsworth by reason of accrued vacation time or otherwise. Said resolution was adopted by the following votes Ayes: Councilmen Gerow, Krrimmnel, Love, Selby and Binder. Noels None. Absent: None. The City Engineer filed with the City Clerk his estimate of the cost of improving the alleys in Block 82 of the City of El Segundo, PAYING BILLS. The City Engineer reported that Title Insurance and Trust Company had called his attention to a form of municipal policy of title insurance issued by said Company►, and which is shed by municipalities covering oassuents, Idghts —of —way and other properties acquired by municipalities for public purposes. By general consent the form of title insurance policy was referred to the City Attorney for his inspection and report to this Council. Councilman Gerow introduced Ordinance No. 159, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE N0. 90 OF SAID CITY, ENTITLED: "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING THE COLLECTION AND DISPOSAL OF GARBAGE AND RUBBISH AND THE ACCUMULATION OF MANURE WITHIN SAID CITY; PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH", ADOPTED ON THE 2ND DAY OF JANUARY, 1923, BY AMENDING SECTIONS 1 AND 4 THEREOF, which was read. Moved by Councilman Gerow, seconded by Councilman Krimmel, that the expenditure of $21.66 for repair parts for the Chevrolet Track of the Street Department heretofore authorized by the City Engineer, be and the same is hereby ratified and approved* Carried by the following votes Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Moved by Councilman Krimmel, seconded by Councilman Love, that the Water Department of the City of E1 Segundo be and the 'same is hereby authorized to lacy a 41! cast iron water line in a portion of Eucalyptus Drive adjacent to 0 Avenue, and a 2" standard screw pipe water line in Oak Avenue East of 1��Drive, at a cost not to exceed $225.00. Carried by the following votes Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absent: None. Moved by Councilmen Gerow, seconded by Councilman Selby, that the purchase of certain pipe and fittings for use of the Municipal Water Department, be and the same is hereby authorized, at a cost not to exceed $210.00. Carried by the following vote: Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Miller, in the Street Department of the City of El Segundo be and the same is hereby ratified and approved, the compensation of said employees to be at the rate of 64 per hour for such time as said persons are actually engaged in the performance of services for the City of El Segundo. Carried by the following votes Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absents None. ffioved by Councilman Love, seconded by Councilman Krimmel, that the following resolution be adapted: WHEREAS, on the 12th day of April, 1929, a vaction schedule affecting certain of the municipal employees of the City of El Segundo was adopted by this Council; and WHEREAS, in said schedule the vacation period of A. R. Gunn was fixed between the dates July 22nd,.1929 and August 5th, 1929; and WHEREAS, this Council has informally seen fit to amend said previously adopted schedule and has authorised the said A. R. Bunn to begin his customary annual two weeks vacation beginning May 6th, 1929 and ending May 20th, 1929; NOW THEREFORE, BE IT RESOLVED, that said informal action of the said Council hereinbefore mentioned be and the same is hereby ratified and approved; and BE IT FURTHER RESOLVED, that in future the head of any municipal department may change the date of the annual vacation of a municipal employee under his supervision to a date differing from the one fixed in the schedule heretofore adopted by this Council whenever it appears that the interests of said employee or the City of E1 Segaido or of the department of the said City affected thereby would be best served by making such change.
