A regular meeting of the City Council of he ty of El Segundo, California, was called to order at 7:00 o'clock P. :u;:.in he Co tuncil Chamber of the City Hall of said City by the -Oeputy City Clerk, the City Clerk and Y.ayor being absent. Councilman Gerow was unanimously chosen 1ayor pro -tem and he immediately assumed the duties of the Yayor. Councilman Love was appointed Clerk pro -tem. ROLL CfZL. The minutes of the regulE.r meetinE held on the 1st day of Di_arch, 1929, were read. No errors or omissions appearing:, it was moved by Councilman Love, seconded by Councilman Krimmel, that the minutes be approved as read. Carried. 7RIT 70 CO!2qJNICATIONS. The following communications were read and disposed of as indicated: ','L1 LTER J. LITTLE, Assemblyman, dated February 28th, 1929, advising that he will be glad to keep in mind the recommendations of this Council when the County Unit Bill comes up for passage. Ordered filed. ?WALTER J. LITTLE, Assemblyman, dated Yarch 6th, 1929, advising that he will lend his support to the passage of the bill re appropriation for the disposition of sewage and industrial wastes. Ordered filed. PACIFIC TELEPHONE & TELEGRAPH CO., dated March 5th, 1929, advising that poles have been removed end wires rerouted adjacent to Block 85, within tbe/City of El Segundo, as requested in letter of the City Clerk of said City dated August 1st, 1928. Ordered filed. PACIFIC TELEPHONE & TELEGRAPH CO., dated March 5th, 1929, requesting permission to place two anchors on the South side of Franklin Avenue and 1 anchor on the East side of alley West of Richmond Street, within the City of E1 Segundo, as per sketch accompanying said letter. The location of the anchors to be set having; been investigated by the City Engineer and approved by him, it was moved by Councilman Love, seconded by Councilman Selby, that the permit requested by granted, provided all of said work is prosecuted and completed to the satisfaction of the Street Superintendent of the C ty of El Segundo. Carried. Mayor Binder appeared at the meeting at this t ime, the hour being 7220 o'clock P. M. and he immediately assumed the duties of the Mayor, Councilman Berow thereupon ceasing to act as Mayor pro -tem. S. V. CORTELYOU, District Engineer, Division of Highways, dated March 2nd, 1929, relative to request of this City Council for State aid in the improvement of Sepulveda Boulevard within the City of El Segundo. Said letter was ordered filed for future reference and consideration. BURDETT MOODY, Bureau of Power and Light of the City of Los Angeles, dated March 2nd, 1929, re Assembly Constitutional Amendment No. 2 -A, being a proposal to tax publicly owned utilities engaged in supplying the public with light, heat, power, transportation, telegraph or telephone service. Ordered filed. VETERANS' WELFARE BOARD OF THE STS -ATE OF C.LIFORNIA, requesting the cancellation of certain municipal taxes against Lot 1, Block 47, Lot 4, Tract 3690, Lot 4, Tract 2667, Lot 17, Tract 2667 and North 5 ft. of Lot 27, Block 49, also Lot 4, Block 54, all in the City of El Segundo, which properties are now owned by the Veterans' Welfare Board. J 79' at a cost not to exceed $21.00, be and the same are hereby authorized. Carried by the following vote: Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absent-* None. Respectfully submitted, J gi FollowiW discussion, in which the opinion of the City Attorney was rendered, to the effect that he could not place upon the Act referred to in the petition, the legal construction which apparently the officials of the Veterans' Welfare Board had placed thereon, and that there was considerable question as to whether or not the Council had the authority under the law to make the cancellation requested, it was moved by Councilman Krimmel, seconded by Councilman Love, that the following resolution be adopted: WHEREAS, this Council has received from the Veterans' Welfare Board of the State of California, a certain petition requesting that all municipal taxes against Lot 1, Block 47; Lot 4, Tract No. 3690; Lot 4, Tract No, 2667; Lot 17, Tract No. 2667; No. 5 ft. of Lot 27, Block 49 and Lot 4, Block 54, E1 Segundo Sheet No. 2, all in the City of El Segundo, County of Los Angeles, State of California, excepting special assessments be cancelled; AND WHEREAS, this Council has carefully considered the said matter and has received legal advice with reference to the same; AND 1,MREAS, a doubt exists in the mind of this Council at this time that it has the authority to grant the petition as prayed for; NOW THEREFORE, BE IT RESOLVED, that said petition be and the same is hereby denied without prejudeand that said Veterans' Welfare Board be advised of this decision and invited to submit any data or authorities which said Board may have, bearing upon the legality of the proposed cancellation and more definitely indicating the authority of the Council of this City to make such cancellations. None. REPORTS OF OFFICERS & SPECIAL CMUTTEES. In connection with the famishing of the materials for and the erection of an ornamental woven wire fence around -the municipal reservoir located at Lomita Street and Grand Avenue, the contract for which was awarded Anderson Fence Company and which said work was completed and accepted by the Superintendent of the Water Department, February 20th, 1929, the said Superintendent of the Water Department advised the Council that he had checked over labor and material bills which had been referred to him for checking at the previous meeting of the Council and that these bills appeared to have been paid, and that in his judgment the said bills constituted all of the bills for labor and materials furnished in connection with the construction of said fence. It was moved by Councilman Krimmel, seconded by Councilman Love, that the demand of Anderson Fence Company in amount of $553.15, be paid in accordance with the terms of that certain agreement dated February 8th, 1929, between the City of El Segundo and Anderson Fence Company, for the construction of a certain woven wire fence around the reservoir located at Lomita Street and Grand Avenue, in the City of El Segundo. Carried by the following vote: Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absent: None. The City Engineer reported that R. P. Radich & Company had completed, in a satisfactory manner and in accordance with puns and specifications approved by the Council, the construction of a lateral sewer in Oak Avenue between Main Street and Virginia Street. In view of the fact that said work was done under private contract and that the City as such, had no interest therein, the Council, by general consent, authorized the City Engineer to prepare a statement, indicating the fact of the completion of the said sewers in a satisfactory manner, for the use of the contractor in making his collections for the work. W i � a ., UNFINISHED BUSI ESE'S. The City Engineer presented plan and profile for the improvement of a portion of Oak Avenue, in the City of " -1 Segundo, by the construction of sidewalk and curb therein. After examination of said plan and profile, it was moved by Counc$ man Love, seconded by Councilman Gerow, tiat the said plan and profile be and the same are hereby approved and adopted for the work or improvement of a:Poxtion of Oak Avenue, within the said City, and the City Engineer of the City of El Segundo is hereby directed to place it on file in his office and designate it as Plan and Profile No. P- 290110. Carried. The City Ln -ineer then presented a certain map prepared by him, desi €-hated as Map No. Y- 290123 and entitled: 111ap of District to be assessed for the improvement of a portion of Oak Avenue ", which said map delinaates the property to be benefited by and to be assessed for the costs and expenses of the work or improvement of a portion of Oak Avenue, within the 'Uity of E1 Segundo, California. After examination of same, it was moved by Councilman Yrimmel, seconded by Councilman Selby, that the said map be approved, and that the same is hereby approved and adopted for the work or improvement of a portion of Oak Avenue within the City of El Segundo, and the City Engineer of the City of El Segundo, California, is hereby directed to place the same on file in his office and designate it as lap No. 1- 290123, ITap of District to be Assessed for the Improvement of a Portion of Oak Avenue ". Carried. The City Engineer then submitted and filed his written estimate for the work or improvement of a portion of Oak t.venue, said estimate being 82555.00 It was then moved by Councilman Krimmel, seconded by Councilman Love, that Resolution of Intention No. 210, entitled: A RESOLUTIOT: OF TIIF CITY COUITCIL OF 1I.E. I -'oved by Councilman Love, seconded by Councilman Gerow, that Ordinance No. 157, entitled: AN ORDINANCE OF TIE CITY OF EL SEGUNDO, CALIFORNIA, P2TI DING ORDINANCE N0. 29 OF SAID CITY, ENTITLED, "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING THE 1+.R.AKING, CARRYING, KEEPING, POSSESSING, SELLING AND DISCHARGING OF CERT«IN ,!WEAPONS AND DEVICES ", PASSED AND ADOPTED ON THE 26TH DL.Y OF DECEMBER, 19Y7, which was introduced and read at a regular meeting of the City Council held on the 1st day of March, 1929, and reread at this meeting, be adopted. Carried by the following vote: Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absent: None. NEW BUSINESS. Councilman Love introduced Ordinance No. 158, entitled: AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROVIDING CERTAIN FIRE PREVENTION ME iSUR.ES AND RE- GULATIONS IN THE OIL FIELDS OF SAID CITY, :-REPEALING ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT TIEREWITH AND P-MVIDING PENALTIES FOR TT VIOLATION THEREOF, T which was read. Moved by Councilman Love, seconded by Councilman Krimmel, that the purchase of three 60 foot lengths of garden hose for use of the Park, Sewer and Street Department "q W spray nozzle for use of the Park Department, at a total cost of Carried by the following vote: �p�30.00, be and the same is hereby authorized. Ayes: Councilmen Gerow, Krimmel, Love, Selby and Binder. Noes: None. Absent: None. The Water Superintendent advised that Rev. L. 0. Bostwick of the El Segui-:do Community Church had requested use of the Grand Avenue Park at the Municipal Water Works Site for the purpose of holding Sunrise Easter Services. By general consent this pennission was granted. Moved by Councilman Krimmel, seconded by Councilman Love, that until the further order of this Council, the employment of a repair man at the Municipal Warehouse be and the same is hereby authorized, such employment to begin as of March 16th, 1929. Said employee shall receive as compensation in full for all services rendered as such repair man the sum of 75¢ per hour, which compensation shall be paid in such manner as other employees of the Street Department are compensated. Moved by Councilman Love, seconded by Councilman Selby, that this Council hereby goes on record as favoring the proposed Daylight Saving Law and that the action heretofore taken by the City Clerk in writing to the legislators representing this district endorsing said law on behalf of this Council, be and the same is hereby ratified and approved.
