A regular meetinE of the City Council of the City of E1 Se €undo, California,
was called to order at 7:00 o'clock P. Y. on the above date, in the Council
Chamber of the City Hall of said City by Peter E. Binder, 1:ayor.
ROLL CALL.
Councilmen Present: Krinnel, Love, Selby and Binder.
Councilmen Absent: Gerow.
READING OF T::INUTES OT PRE7IOUS 'y TITTG.
The minutes of the regular meetin held on the 19th day of October, 1928,
were read. No errors or omissions appearing, it was moved by Councilman
Love, seconded by Councilman Krimmel, that the minutes be approved as read.

SPECIAL ORDER OF BUSII,7ESS.
The receiving of bids for furnishing the City of E1 Segundo with one small
roadster, equipped with pick -up body, electric starter, speedometer, spare rim
and spare tire, having heretofore been set for the hour of 7:30 o'clock P. Y.
at this meeting, the 1ayor arose and announced the hour of 7:29 o'clock P. 74.
and asked if there were any person or persons present who desired to file bids
for said equipment. The house of 7:30 o'clock P. Y. having arrived and all
bids being in, the Yzyor declared the time for the receiving of bids for
furnishing the City of E1 Segundo with one small roadster, equipped with
pick -up body, electric starter, speedometer, spare rim and spare tire, as
advertised for, closed.
The Clerk announced receipt of one bid; whereupon it was moved by
Councilman Love, seconded by Councilman Krimmel, that the Council proceed to
open, examine and publicly declare the bid received for furnishing the City
of E1 Segundo with one small roadster, equipped with pick -up body, electric
starter, speedometer, spare rim and spare tire, as advertised for. Carried.
The Council thereupon proceeded to open, examine and publicly declare
said bid, which said bid was found b;• said Council to be as follows, to -wit:

Said Bid was accompanied by Cashier's Check No. 5958, drawn on the First
National Bank of E1 Segundo, payable to City of E1 Segundo, in the sum of
X30.00.
After consideration of said bid, it was moved by Councilman Love,
seconded by Councilman Selby, that Resolution No. 205, entitled:

The City Clerk announced receipt of three deeds affecting property
required by the City of E1 Segundo for public street purposes in connection
with the street opening proceedings instituted under the provisions of
Resolution of Intention No. 154 and Ordinance No. 135 of the City of E1
Segundo. Vzved by Councilman Love, seconded by Councilman Krimmel, that
the following resolution be adopted:
RESOLVED, that that certain street deed, dated the 25th
day of October, 1928, executed by J. K. Speck and Reta J.'
Speck, his wife, conveying to the City of E1 Segundo for
public street purposes the Northerly 40 feet of Lot 13, Block
8, Tract 1685, as recorded in Beok 21, Page 98 of Naps,
Records of Los Angeles County, alifornia, on file in the office
of the County Recorder of said County;
Also that certain street deed, dated the 20th day of
October, 1928, executed by 71illiam R. Harriman and Elinor
Harriman, husband and wife, conveying to the City of El Segundo
for public street purposes the Northerly 40 feet of Lot 7,
Block 92, El Segundo Sheet No. 4, as recorded in Book 20,
?age 24 of Maps, Records of Los Angeles County, California,
on file in the office of the County Recorder of said County,
and the property conveyed thereby, be and the same are hereby
accepted on behalf of the City of E1 Segundo; and
BE IT FURTHER RESOLVED, that the City Clerk of the City
of E1 Segundo be and he is hereby authorized upon receipt of
advice from the Southwest Title Company, that through such
instruments the City of E1 Segundo will acquire title to said
property, free and clear of encumbrance, to cause the said
instruments to be filed for record, and to cause to be delivered
to the grantors the amounts awarded them in the Report of
Commissioners appointed for such purpose, under the provisions
of Resolution of Intention No. 154 and Ordinance No. 135 of said
City; .and
BE IT FURTHER RESOLVED, that that certain deed of Southern
California Gas Company, dated October 6th, 1928, quitclaiming to
the City of E1 Segundo an easement for public road and highway
purposes, in Lot 9, Block 103, E1 Segundo Sheet No.,, and reserving
unto the said Company, its successors and assigns, rights and
privileges in the land crossed by the roadway therein described,
be and the same is hereby accepted on behalf of the City of E1
Segundo, and the City Clerk is hereby directed to affix his
certificate.thereto, showing the acceptance of the same, and to
cause the said instrument to be filed for record in the office
of the County Recorder of Los Angeles County:

REPORTS OF OFFICERS AND SPECIAL CO XITTEES.
The Clerk announced that 1:r. Partlow, residing at i:o. 405 Valley Street, is
desirous of constructing a retaining wall in front of his premises and of having
the EnE;ineerinE_ Department of the City of E1 Segundo set line stakes for the same.
;roved by Councilman Krimmel, seconded by Councilman Love, that the City Engineer
be and he is hereby authorized and directed to set line stakes for the construction
of a retaining wall in front of the premises situated Iq'o. 405 Valley Street.
Carried by the following vote:

Absent: Councilman 6erow.
The Clerk informed the Council that the thirty gallon galvanized iron water tank,
which was removed frow: the hot water system of the City ?fall and junked when the
automatic hot water heater was installed, has remained in the basement of the City
Hall for a number of years, and is of no value to the City and one of the local
plumbers had inquired whether or not the Council would sell the same and the price
thereof. Thereupon, it was moved by Councilman Love, seconded by Councilman
Krimmel, that the City Clerk be and he is hereby authorized to obtain bids for the
sale of that certaiirty gallon galvanized water tank of the City of
E1 Segundo and to dispose of the same to the highest bidder. Carried.

Yoved by Councilman Love, Seconded by Councilman Selby, that the following
resolution be adopted: _
1�M'�EAS, on the 19th day of October, 1928, as recorded at Page
I -273 of the minutes of the proceedings of this Council, a Partial
Release of 11ortgage affecting the Northerly 40 feet of Lot 11, Block
10, Tract 1685, in the City of E1 Segundo, executed by S. S. Carter
and Lillie E. Carter, his wife, was accepted on behalf of the City
of E1 Segundo and the City Clerk of said City directed to cause the
same to be filed for record; and
ti`5=AS, subsequent to the said date, said instrument was returned
to the City Clerk for the reason that there was an insufficiency in
the notarial acknowledgment annexted to said instrument, and that there-
fore the acceptance of the said instrument and the instruction to the
City Clerk to record the same, as hereinbefore referred to, were void
and of no effect; and
71HEREAS, there has since been annexed to the s�_id instrument proper
notarial certificate and that it now appears said instrument is in
proper form for recordation;
NOW THEREFORE, BE IT RESOLVED, that that certain Partial Release
of Mortgage, dated October 18th, 1928, executed by S. S. Carter and
Lillie E. Carter, his wife, respecting the Northerly 40 feet of Lot 11,
Block 13, Tract 1685, r.s per map recorded in Book 21, Page 98 of Maps,
Records of Los Angeles County, California, which said real property is
required by the City of E1 Segundo pursuant to the provisions of
Resolution of Intention No. 154 and Ordinance No. 135 of said City, be
and the same is hereby accepted on behalf of the City of E1 Segundo,
and the City Clerk of said City is hereby directed to cause the said
instrument to be filed for record.

The City Clerk reported that, at the date of the death of P. D. Gardner, a
former employee of the City of El Segundo, to -wit: June 4th, 1928, there was
due the deceased for services rendered the City of E1 Segundo during the month
of I:ay, 1928, the sum of •100.00, as evidenced by Warrant No. 13185, ordered
drawn and paid by the City Council at its regular meeting held June 1st, 1928,
and that his widow, Isabella Gardner, had filed an affidavit, setting forth the
fact that she is unable to cash the said warrant as it is made payable to her
deceased husband; that all claims and demands against her deceased husband and
all of his debts have been fully paid and discharged; that there will be no estate
of said deceased to probate; that the amount of the claim against_ the City of E1
Segundo is so small that it would not justify her in instituting probate
proceedings to obtain the same; that she and Evelyn Tuck, her daughter, wife
and daughter respectively of said deceased are the only heirs at law of said
deceased, ''µ#that the amount represented by said warrant was the community
property of the said deceased and of said Isabella Gardner, having been
earned by the deceased durint his life time and while domiciled within this
state with said Isabella Gardner, his widow; that the said deceased left no
will disposing of any part of said community property but died intestate;
and that therefore under the law in such case made and provided, the whole of
said amount in truth and in fact belongs to said Isabella Gardner, widow, all
debts of the deceased having been paid as aforesaid and praying that the
existing warrant be cancelled and under the circumstances, a new warrant be
made payable to her in satisfaction of said debt; which said affidavit is
accompanied by a bond in the penal sum of $100.00, with Isabella Gardner as
Principal and R. T. Hutchins and J. W. Gilbert, as Sureties,
to indemnify the City of E1 Segundo and each and all of the respective officers
of said City against loss, by reason of the cancellation of said warrant No.
13185 and the issuance to Isabella Gardner of a new warrant in the sum of
$100.00, in payment of the services of her deceased husband rendered the-City
of E1 Segundo prior to his death.
It was thereupon moved by Councilman Love, seconded by Councilman
Krimmel, that in view of the affidavit of Isabella Gardner respecting payment
for services rendered the City of E1 Segundo by her deceased husband,filed
with this Council this date, and of the bond accompagving said affidavit,
that City of E1 Segundo General Goverrunent Warrant No. 13185, ordered drawn
and paid June 1st, 1928, in payment of services rendered the City of E1 Segundo
by P. D. Gardner for the month of bray, 1928, be and the same is hereby ordered
cancelled, and the City Clerk of the City of E1 Segundo is hereby authorized to
draw a new warrant in the said stun of $100.00, payable to the order of Isabella
Gardner, in payment of the services rendered the City of E1 Segundo by her
deceased husband for the month of bray, 1928, and the Mayor of the City of El
Segundo is hereby authorized to sign the same and the City Treasurer is further
authorized to accept the same and pay the same upon presentation. Carried by
the following vote:
Ayes: Councilmen Krimmel, Love, Selby and Binder.
Does: None.
Absent: Councilman Gerow.
NETS' BUSINESS.
Moved by Councilman Love, seconded by Councilman Krimmel, that the purchase
of one ton of emulsified road oil at a cost not to exceed $12.50 be and the same
is hereby authorized. Carried by the following vote:
Ayes: Councilman Krimmel, Love, Selby and Binder.
Noes: None.
Absent: Councilman Gerow.
Moved by Councilman Krimmel, seconded by Councilman Selby, that the Superin-
tendent of the rater Department be and he is hereby authorized to purchase for
use in his Department 500 feet of 2" galvanized pipe, 500 feet of 3/4" galvanized
pipe and six 2" valves, all at a cost not to exceed 0175.00. Carried by the
following vote:
Ayes: Councilmen Krimmel, Love, Selby and Binder.
Noes: None.
Absent: Councilman Gerow.
No further business appearing to be transacted at this meetin&, it was
moved by Councilman Selby, seconded by Councilman Love, that the meeting adjourn.
Carried.
