1925 SEP 04 CC MIN299 El Segundo, Cal. September 4th, 1925. A regular meeting of the Board of Trustees of the City of E1 Segundo, California, was called to order at 7:00 o'clock P. M. on the above date, in the Council Chamber of the City Hall of said City by Peter Be Binder, President of the Board. ROLL CALL. Trustees Presents Anderson, Gerow, Love and Binder. Trustees Absents Cannon. READING OF 1'.INUTES OF PREVIOUS 1M.71TINGS. The minutes of the special meeting held on the 27th day of August, 1925, were read. No errors or omissions appearing, it was moved by Trustee Gerow, seconded by Trustee Love, that the minutes be approved as read. Carried. The minutes of the regular meeting held on August 28th, 1925, were read without error or omission being noted and were approved as read upon motion of Trustee Love, seconded by Trustee Anderson, which carried. Trustee Cannon appeared at the meeting at this time, the hour being 7 :06 o'clock P. M. and immediately took his seat. The minutes of the adjourned regular meeting held on the 31st day of August, 1925, were read. No errors or omissions being noted, it was moved by Trustee Cannon, seconded by Trustee Anderson, and carried, that the minutes be approved as read. WRITTEN COMMUNICATIONS. The following communications were read and disposed of as indicated: PACIFIC- SOUTRW ST TRUST & SAVINGS BANK, advising that said bank finds of record a right-Of-way and perpetual easement fifteen feed wide over and through Lot 2, Block 13, Tract 1685, for the construction and maintenance of an outfall sewer as granted to the City of Los Angeles by deed recorded in Book 2383, page 215 of deeds, Records of Los Angeles County, which herein mentioned real property the City of El Segundo is purchasing from We Be Morgan and M. M. Kauffman, and asking if the City of El Segundo is willing to accept the said property subject to said easement and having the same appear in the Certificate of Title to be written, guaranteeing the title to said property to the City of E1 Segundo. The City Engineer reporting that in his opinion said easement would not be prejudicial to the best interests of the City of E1 Segundo and that it interferes in no way with contemplated plans for the usage of said property, it was moved by Trustee Gerow, seconded by Trustee Anderson, that the City of 1:1 Segundo accept the said property under the conditions above referred to and that the Pacific - Southwest Trust & Savings Bank be authorized to have Guarantee of Title issued showing the said easement. Carried by the following vote: Ayes: Trustees Anderson, Cannon, Gerow, Love and Binder. Noess None. Absents None. MRS. HELEN K. BROCK, being a report of her activities as Publicity Director from August 8th to August 30th, 1925, Inclusive. Ordered filed. LEAGUE OF CALIFORNIA MUNICIPALITIES, official announcement of the 27th annual Convention of said League to be held at Long Beach, California, September 28th to October 3rd, 19259 Inclusive. Ordered filed. CITY OF WATTS, copy of a resolution of its Board of Trustees passed August 3rd, 1925, relative to the contemplated demand to be made by the County of Los Angeles for the payment of certain money representing fines collected in the Recorder's Court for violations of the 18th Amendment to the Constitution of the 30OF United States, and requesting that the Board of Trustees of this City adopt a similar resolution. Following discussion, it was moved by Trustee Gerow, seconded by Trustee Anderson, that the following resolution be adopted: AREAS, the Supreme Court of the State of California has recently decided that fines and forfeitures collected by Sixth Class cities of the State of California for violations of the Prohibition Law should be paid over to the counties of which the respective municipalities of the State of California are a part; AND WH.ER.vAS, it appears that a number of the smaller municipalities of the State of California,have, through their own law enforcement agencies and at their own expense, pro- ceeded with the work of enforcing the said prohibition laws and have deposited to the credit of their respective treasuries the sums collected as fines and forfeitures and have in good faith expended the same in defraying the costs of their res- pective governments, AND VMZFEAS, prior to the decision of the Supreme Court of the State of California hereinabove.referred to, it was generally understood and agreed that it was lawful for municipalities of the Sixth Class to receive such fines and forfeitures and to disburse the same in the manner provided for the disbursement of other funds coming into the possession of said cities; AND WHMU?AS, a demand upon many of the Sixth Class cities of the County of Los Angeles by the Board of Supervisors of said County for the payment into the County Treasury of said County of moneys heretofore collected by the municipalities in the manner aforesaid would prove extremely embarrassing to said cities and unnecessarily burden the tax payers thereof with an exorbitant tax rate through which to make up the deficit; NOW THEREFORE, BE IT RESOLVED, that the Board of Trustees of the City of 3:1 Segundo hereby recommends and suggests that the facts herein stated be presented to the Board of Supervisors of said Los Angeles County, with the view of their giving the same earnest consideration to the end that, if consistent, they take such action as may be required by law to cancel all of the obligations due the said County of Los Angeles by reason of the collection of fines and forfeitures received from convictions for violations of the Prohibition Law within municipalities up to the close of the fiscal year ending June 30th, 1925. . Us CONVERSE and others, requesting the Board of Trustees to institute proceedings for the improvement of 'rand Avenue between the Easterly line of Concord Street and the Westerly line of Main Street in such manner as the Board of Trustees deems proper and to install ornamental street lights in said Street. Moved by Trustee Gerow, seconded by Trustee Love, that the City Engineer be and he is hereby authorized and instructed to prepare plans and specifications for the improvement of the roadway of Grand Avenue between the Easterly line of Doncord-Street and the Westerly line of Main Street, and for the installation of ornamental street lights in the said street between said points, and upon completion of the same to deliver them to the City Attorney of said pity and the City Attorney is hereby authorized and instructed, upon receipt of said plans and specifications, to prepare the legal proceedings necessary to acquire the improvements herein referred to. Carried by the following votes Ayes: Trustees Anderson, Cannon, Gerow, Love and binder. Noes: Bone. Absents None. PETITION OF JOSEPH E. BENDER and others, requesting the Board of Trustees to take such proceedings as may be necessary for the installation of ornamental street lights on Richmond Street between the Southerly line of Grand Avenue and the Northerly line of El Segundo Avenue. Moved by Trustee Cannon, seconded by Trustee Love, that the City Engineer be and he is hereby authorized and instructed to prepare plans and specifications for the installation of ornamental street lights in Richmond Street between the Southerly line of Grand Avenue and the Northerly line of El Segundo Avenue and to deliver same to the City Attorney of the City of E1 Segundo and the said City Attorney is hereby authorized and instructbd.upon receipt of said plans and specifications, to prepare the legal proceedings necessary to acquire the improvements herein referred to. Carried by the following vote: Ayes$ Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absent: None. PETITION OF E. R. ALDLMSON and others, requesting the Board of Trustees to form a lateral sewer district or districts, to include the real property lying South of Grand Avenue, north of the Center Line of El Segundo Avenue and Westerly of the Alley East of Standard Street, and including also Lot 43, Tract 2667, Lots 23 and 439 Tract 1826 and Lots 21 and 22 of Block 42. Moved by *ustee Gerow, seconded by Trustee Anderson, that the City Lngineer be and he is hereby authorized and instructed to prepare plans and specifications for the construction of lateral sewers within a district or districts comprising all of that portion of the City of El Segundo lying Southerly of Grand Avenue, Northerly of the center line of E'1 Segundo Avenue and Westerly of the alley East of Standard Street and including also Lot 43, Tract 2667, Lots 23 and 43, Tract 1826 and Lots 21 and 22 of Block 42 of the City of Rl Segundo, and upon completion of said plans and specifications to deliver the same to the City Attorney, who is hereby authorised and instructed to prepare the legal procedure necessary for the creation of the districts and the prosecution and completion of the work herein referred to. Carried by the following vote: Ayes= Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absent: None. SPECIAL ORDER OF BUSINESS. The hearing of protests against the laying out and opening of the certain new public street within the City of E1 Segundo between Arizona Drive and Inglewood and Redondo Road, to be designated and known as Mariposa Avenue, having heretofore been adjourned to the hour of 7 :30 o'clock P. M. at this meeting and said hour having arrived, the President arose, announced the same and asked if any person or persons present desired to file protests against the said work or improvement. The Qity Clerk then read a communication from Mr. E. 0. Leake, Attorney -at -Law, dated August 24th, 19259 which said communication is a formal withdrawal of protests against the said work or improvement previously filed with this Board of Trustees by A. Be Gough and Susan Gough. The City Attorney advised that air. Haas, representing certain property owners whose property is involved in the said proceeding and who he felt desired to withdraw protests formerly filed with this Board, still being away on vacation, had been unable to file notice of withdrawal of said protests. The City Clerk having advised that no additional protests had been filed with him, and that no other withdrawals of protests hAd been filed, it was moved by Trustee Cannon, seconded by Trustee Gerow, that the hearing of protests against the laying out and opening of the certain new public street within the City of E1 Segundo, to be known as Mariposa Avenue, as contemplated under Resolution of Intention No. 94 of the Board of Trustees QQ he said City, be and the same is hereby adjourned until the 11th day of September,l1tthe hour of 7 :30 o'clock P. M. Carried by the following vote: Ayes= Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absent: None. 'r r REPORTS OF STANDING COINITTEM. Trustee Gerow of the Public Works Committee, reported having given further consideration to the matter of abolishing the office of right -of -way agent and of having learned from Mr. Dale, the officer filling said office, that certain work now under way could be completed by the first of Octbber, 1925 and he thereupon moved that the action of this Board of Trustees, taken August 31st, 1925, abolishing the office of right -of -way agent and terminating the compensation of said officer, be reconsidered. The motion was see6nddd by Trustee Cannon and carried by the following votes Ayes: Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absents None. The matter was then reconsidered and discussed by the Board of Trustees, after which it was moved by Trustee Gerow, seconded by Trustee Cannon, that the following resolution be adopted: WH MEAS, on the 31st day of August, 1925, this Board of Trustees did take action abolishing the office of Right-of-Way Agent and terminating the salar;► paid to the incumbent thereof as of midnight the 4th day of September, 1925; AND WHEREAS, after giving the matter further consideration, this Board of Trustees feels that the best interests of the City of El Segundo will be conserved by maintaining the said office and the services of Harold D. Dale, who now fills the sane, for a longer period; NOW THZREFORR, BE IT RESOLVED, that the action heretofore taken as referred to in the first paragraph hereof, be and the same is hereby rescinded, AND BE IT FURTHER RESOLVED, that the office of_Right -of -Way agent of the City of El Segundo and the employment of Harold D. Dale,wwho now fills said office, be continued until midnight, the 30th day of September, 1925, and at said time and on said date, and until the further order of this Board, said office and the salary and/or other compensation heretofore allowed the said Harold D. Dale be terminated. Said resolution -was carried by the following votes Ayes: Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absent: Toone. None. None. Moved by Trustee Love, seconded by Trustee Gerow, that the City Marshal be and he to hereby authorized to purchase bedding for the jail, consisting of four bunk pads, four canvas covers for the same and six blankets, all at a cost not to exceed $50.00. Carried by the following votes Ayes: Trustees Anderson, Cannon, Gerow, Love and Binder. Noes: None. Absents None. Moved by Trustee Love, seconded by Trustee Anderson, that the City Marshal be and he is hereby authorized to purchase two cap badges for police officers of the City of -1 Segundo, at a cost not to exceed 412.00. Carried by the following votes Ayes: Trustees Anderson, Cannon, Gerow, Love and Binder. Noess None. Absent: None. At the request of Trustee Gerow and by general consent.of the Board of Trustees, the City Clerk was requested to write various municipal corporations of the State of California, for the purpose of ascertaining how they dispose of the matter of cleaning weeds from vacant lots throughout their respective municipalities. Moved by Trustee Cannon, seconded by Trustee Love, that the office of Traffic Officer held by M. Wo Stogdill be and the same is hereby declared vacant as of midnight, the 6th day of September, 19259 and that compensation of every kind and nature heretofore allowed said M. Wo Stogdill for services rendered the City of E1 Segundo in any capacity, be and the same is hereby terminated as of the same time and date. / Carried by the following vote: Ayers Trustees Anderson, Cannon, Gerow, Love and Binder. Moved by Trustee Cannon, seconded by Trustee Love, that the following resolution be adopted: WIMEAS, it appears that demands totaling $1130.23 have been presented to this Board of Trustees, allowed and ordered paid to various persons for the circulation of petitions with respect to the withdrawal of the E1 Segundo School District from the Ingliwood Union High School District; AND WHEREAS, it appears that on June 12th, 1925 as recorded at page F -232 of the minutes of the Board of Trustees and on July 17th, 1925, as recorded at page F -255, records of the Board of Trustees, the sums of 4250.00 and X400.00 respectively were authorized for this work; NOW THEREFORE, BE IT RESOLVED, that the payment of the difference between the sum allowed and the sum expended, to -wit: $580.23, be and the same is hereby ratified and approved.
