The Board of Trustees of the City of El Segundo, 'California, met in adjourned regular session on Monday, the 4th day of May, A. D., 1925, beginning at the hour of seven oblock P. The minutes of the adjourned regular meeting of April 30, 1925 were read and on motion of Trustee Anderson, seconded ti by Trustee Gerow and unanimously carried, the same were approved as read. The minutes of the regular meeting of May lot, 1925 were read and on motion of Trustee inderson, seconded by True- tee Gerow and unanimously carried, the same were approved as read. RETURNS OF SPECIAL CONSOLIDATED MUNICIPAL ELECTION PRESENTED The City Clerk reported that the returns of the special consolidated municipal election held in the City of El Segundo, California, on Friday, the first day of May, 1925 were now in his possession in the same condition as when received from the respective boards of election conducting said election, and said Clerk presented said returns' to the Board of Trustees at this time. REGULAR ORDER OF BUSINESS DISPENSED WITH It was thereupon regularly moved by Trustee Gerow, seconded by Trustee Anderson and unanimously carried, that the regular order of business be dispensed with for this meeting, and that this Board proceed immediately to the canvass of the returns of the special consolidated municipal election held in the City of El Segundo, California, on the first day of May, 1925. CANVASS OF ELECTION RETURNS 'The Board thereupon proceeded t o open and examine the returns of said special consolidated municipal election so pre- sented and after thoroughly canvassing and examining the same, the Board being tally advised in the matter took the following action, to -wit: It was moved by Trustee Gerow seconded by Trustee Anderson and carried by the followAng vote, to-wit: Ayes: Trustees, Gerow, Anderson and Binder; Noes: Trustees, none; Absent: Trustees, Love and Cannon, that the following resolution be adopted: o s ss ".AREAS, the Board of Trustees of the City of El Segundo, California, did, by Ordinance No. 114 of said City, entitled,- 'An Ordinance of the City of El Segundo, California, calling, providing for and giving notice of a special election to be held in said City on Friday, the first day of May, A. D., 1925, for the purpose of submitting to the qualified electors of said manioipality the question whether or not certain new unimb i4ed territory herein described shall be Annexed to, Incorporated in and made a part of said munioipal corporation', adopted on the 3d day of April, 19259 duly provide for the holding in said City of a special municipal election on the first day of May, 1925; AND, WHEREAS, said Board did, by Ordiname No. 115 of the said City, entitled,- 'An Ordinance of the City of El Segundo, California, calling and providing for the holding of a special election t o ,be held in the City of El Segundo on Friday, the first day of May, 1925, and submitting to the qualified voters of said City certain proposi- tions for the incurring of bonded indebtedness for the acquisition, construction and completion of certain municipal improvements, to -wit: a municipal sewer system as in this ordiname more folly stated and a public park or system of parks as in this ordinance more fully stated aid consolidating said special election with a special election heretofore called to be held in said City of El Segundo on said first day of May, 1925, by Ordinance No. 114 of the City of Sl Segundo', adopted on the 10th day of April, 1925, oall_ and .order to be held in said City a special municipal bond election on the same day, to-wit, on said first day of May, 19259 for the purpose of submitting to the qualified voters of said City, two certain propositions to incur bonded debts by the satd City of El Segundo, as follows, to -wit: 11) A certain proposition to incur a bonded debt by said City of E1 Segundo, California, to the amount of $375,000.00 gold coin of the United States of America, for, the purpose, of the so- quisition, construction and completion by said City of a certain municipal improvement to -wit, a municipal sewer system for the oollection, carrying off and disposal of sewage in and =my from said City of El Segundo, consisting of the acquisition, construction and completion by said City of main trunk line sewers and main inter - oepting sewers and consisting of the soquisition, construction or completion of an outfall sewer line or lines; and disposal plant or plants, or the right to use such outfall sewer lines and disposal plants, an:d including the aoquisition, construction and completion of all necessary leads, rights of way, easements, pipe, machinery, apparatus aid equipment necessary for the com- pletion of such municipal sewer system; and (2) A certain proposition to incur a bonded debt by said City of El Segundo to the amount of $50,000.00 gold coin of the United States of America; for l ' �- U., w_r+ the purpose of the acquisition, construction ani completion by said City of a certain muni- oipal improvement, to wit, a public park or system of parks including the acquisition of lands and the improvement of the same for park purposes by the acquisition, construction or completion thereon of lawn, trees, shrubbery, flowers, walks, sidewalks, drives and other structures, buildings or works necessary for the o omple t ion of such municipal improvement; AND, WHEREAS, under the provisions of said Ordi- nance No. 115 said special municipal bond election was consolidated with said special municipal election called under the provisions of said Ordinance No. 114 for said first day of May, A. D., 1925; AND, WEREAS; said Ordinances Nos. 114 and 115 were duly published in form, time a2d manner as required by law, as appears from affidavits on file in the office of the City Clerk of said City; AND, WHEREAS, it appears that said special con- solidated election use duly held in a000rdmoe with law and the `provisions of said Ordinances Nos. 114 and 115; and that the polls for said election were kept open during the time required by law, to -wit, from six o'clock A. M. to seven o'clock P. M. on said first day of May, 1925, except as pro- vided in Section 3.164 of the Political Code of the State of California; and that said speoisl oonsolidated election was held, 'and the votes thereat reoeived, oanva.ssed, and the returns thereof ascertained, determined, declared and re- turned in time, form and manner as required by the laws of the State of California and the ordInaa.oss of said City; AND, WHEREAS, on Monday, the 4th day of May, 1926, the Board of Trustees of said City met in adjourned regular session at their usual place of meeting and proceeded to, and did, canvass the returns of said special consolidated election as required by law; AND, WHEREAS, the results of said election have been found by said Board to be as hereinafter stated, - NOW, TEEREFORE, the Board of Trustees of the City of El Segundo, California, do resolve, declare and determine as follows: SECTION 1. That the proposition referred to in said ordinance No. 114 and voted i}pon at said special election was the proposition hereinafter in this section set forth, and the same was stated upon the oallots used at said election as follows: 'Shall Second Annexation Territory, being that certain territory situated in the County of Los Angeles, State of California, described as follows, to-wit: All of Lot Two (2) of Tract No. 3303, as per map re- corded in Map Book 36, Page 14; also all of Lots 33, 34, 35 and 36 and part of Lots 22, 249 269 28, 30, 31 and 32 of Tract No. 2356 as per map recorded in Map Book 28, Page 42, and part of Block 18 of the El Porto Tract as per map recorded in Map Book 18, Pages 142 and 143, all of Los Angeles County Records; also part of the Pacific Electric Railroad Right of Way, 45 also known as Lot M of Tract No. 2356, Highland Ave- nue and Port Avenue, all lying within the following described marvel of land: Beginning at the southwesterly corner of Lot 1, Tract No. 3303, as per map records of Book 36, Page 14 of Maps, records of Los Angeles County, and on file in the office of the County Recorder of said Oounty; saL d point being also the-southwesterly corner of the City of El Segundo, County of Los Angeles, Califomia, as the same now exists; thence westerly along the northerly boundary line of the City of Manhattan Beach, as the same now exists, to the point of Intersection of said northerly -boundary line of the City of Manhattan Beach, with a line lying 20.00 feet easterly of measured at right angles, and parallel to the easterly line of Tract No. 4108, as per map records of Book 46, Page 8 of Maps, re- corded and on file as aforesaid; thence northwest- erly along the aforesaid line lying 20.00 feet easterly of, measured at right angles, and parallel to ,the easterly line of Tract No. 4103, as per said map last he re inabo ve referred. to, to a point where said line intersects the easterly prolongation of the center line of that certain street known as 45th Street, Tract No. 4103; as per said map last here3nabove re- ferred to; thence westerly along the said easterly prolongation of said center -line of said 45th Streqt, Tract No. 4103, as per said map last hereinabove re- ferred to, to a point where said easterly prolongation intersects the easterly line of Tract No. 4103, as per said map last hereinabove referred to; thence northerly along the said easterly line of said Tract No. 4103 to the northeasterly corner of said Tract No. 4103, as per said map last hereinabove referred to; thence westerly along the northerly line of said Tract No. 4103, its projection across Highland Avenue, as shown upon the last above - mentioned map, and Its westerly prolongation thereof, to a point where said westerly prolongation of said northerly line of &aid Tract No. 4103 interseots the westerly line of the Pacific Electric Railway Bight of flay; also know a& Lot X.- Treat No. 8356, Sheet ao. 2, " per map raaords of Book 88, Page 42 of Maps, records of Los Angeles County, on file as aforesaid; thence south- erly along the westerly line of We said Paoifio Electric Railway Right of Way,. a distance -of 20.00 feet to a point; thence south 670 48* 00 "west to the point of Intersection,, in the Pacific Ocean, with the northerly boundary line of the City of Manhattan Beach, County of Los Angeles, Califtmis as the same now exists; thence westerly along the said northerly boundary of the said City of Manhattan Beach, County of Los Angeles, California, to the northwesterly cor- ner of said City of Manhattan Beach; thence north- westerly parallel to the high tide line to the southwesterly corner of the City of El Segundo, as the same now exists; thence easterly and northeast- erly- along the southerly boundary line of said City of El Segundo, to the northwesterly corner of Lot 22, Tract No. 2356, Sheet No. 2, as per map records of Book 28, Page 42 of Maps, recorded and on file as aforesaid; said point being also on the southerly boundary line of the said City of El Segundo as the same now exists; thence easterly along the said southerly boundary line of said City of El Segundo to the northwesterly corner of Lot 1, Tract No.3303, v� r/v L e s .f i l �QQ �7 as per map records of Book 36, Page 14 of baps, records of Los Angeles ; County, and on file as aforesaid, said point being also on the southerly boundary line of the said City of El Segundo as the same now exists; thence southeasterly along the westerly line of Lot 1, Tract 33039 as per map last hereinabove referred to, said line being also the westerly line of the said City . of El Segundo, as the same now exists' to the point of beginning, be amaexed to and incorporated in and made a part of the City of E1 Segundo, Cali 1b rnia ?' SECTION 2. That the first proposition referred to in said Ordinance No. 115 voted upon at said special election, was the proposition hereinafter in this section set forth, and the same was stated upon the ballots used at said election as follow: 'PROPOSITION I: Shall the City of El Segundo inour a bonded debt of Three hundred seventy -five thousand dollars ($375,000) for the purpose of the acquisition, construction and completion by said City of a certain manic ipal improvement, t o-wit : a Municipal newer system for the colleoti_on, carrying off and disposal of sewage in and away from said City of E1 Segundo, consisting of the acquisition construction sad com- pletion by said City of main gunk line severe and main intercepting sewers and consisting of the aoqui- sition, construction or completion of an outfall sewer line or lines and disposal plant or plants, or the right to use such outfall sewer lines and disposal plants and including the acquisition, construction and completion of all necessary lands, rights of way, easements, pipe, machinery, apparatus and equipment necessary for the completion of such municipal sewer system ?' - SECTION 3. That the second proposition referred to in said Ordinance No. 115, voted upon at said special election, was the proposition hereinafter in this section set forth, and was stated as follows: 'PROPOSITION II: Shall the City of El Ss ndo incur a bonded debt of Fifty thousand dollars (W,000) for the purpose of the acquisition, construction and com- pletion by said City of a certain municipal improve - 3nent, to -wit: A public park or system of parks, including the acquisition of lands and the improvement of the same for park purposes by the acquisition, con- struction or completion thereon of lawns, trees, shrabbery, flowers, walks,, side - walks, drives and other structures, buildings or works necessary for the completion of such municipal improvement ?' ` SECTION 4. That there were three election precincts within said City for the purpose of holding said special election, to-wit: Voting Precinct A, which was named and knounas such and which consisted of all of the territory in the City of El Segundo, California, within the exterior boundaries of El Segundo City Precinct No. 1, as last established by the Board of Supervisors of Los Angeles County, California for state ea d county elections; Voting Precinct B, which was named and knoaen as such, and which consisted of all of the territory in the City of El Segundo, California, within the exterior boundaries of El Segundo City Precinct No. 2, as last established by the Board of Supervisors of Los Angeles County, !California for state and county elections; Voting Precinct C. which was named and know as each, and which oonsiated of all of the territory in the city. of El Segundo, California, within the exterior boun. daries of El Segundo City Precinct No. 3, as last estab- lished by the Board of Supervisors of Los Angeles County, California, foi state and oonnty elections. SECTION 5. That the total number of votes cast at said special consolidated municipal election was 524 votes. SECTION 6. That the total- number of votes cast thereat in favor of the proposition hereinbefore stated, in Section 1 of this Resolution was 364 votes; and that the number of votes cast thereat against said proposition .was 88 votes. SECTION 7. That the total number of votes east thereat in favor of the proposition hereinbefore stated, in Section 2 of this Resolution was 414 votes; and that the number of votes cast thereat against said proposition was 99 votes. SECTION 8. That the total number of votes cast thereat in-favor of the proposition hereinbefore stated, in Section 3 of this Resolution was 222 votes; and that the number of votes cast thereat against said proposition was 274 votes. . SECTION 9. (a) That more than a majority of the Y&ole number of votes cast at said special consolidated municipal election on the proposition hereinabove set forth in Section 1 of this Resolution, to -wit, the proposition for the annexation of the territory in -said proposition describ- ed, to said City of 21 Segundo, were cast in favor of said annexation, and the said proposition for the annexation to said City of El Segundo, California, of said territory ]mown, described and referred to as 'Second Annexation Territory', is hereby declared to have been carried, and the City Clerk shall therefore enter this resolution containing the omvass, statement and report of said election, by this Board, in fall in the minutes of the meeting at which the same is passed and adopted, and shall make and oertify under the -seal of said City, a fall, true and correct copy of this resolution, statement and report, canvassing said returns so entered upon said minutes, and forthwith transmit the same to the Secretary of State of the State of California, and he shall also transmit a similar copy so certified to the Board of Supervisors of the County of Los Angeles, State of California, all in the manner provided by low; that from and after the date of the filing of said certified copy of this resolution, statement, oaavass and report of said eleo- tion in the office of the said Secretary of State of the State of California, the annexation of the said territory so proposed to be annexed, shall be deemed to be, and shall be complete; that thenceforth such annexed territory shall be a part of said municipal corporation for all intents and purposes, except only that no part of such annexed territory shall ever be taxed to pay any portion of any indebtedness or liability of said City of El Segundo contracted prior to or existing at the time of such annexation; and that said i property so annexed and hereinabove referred to is situated in the County of Los Angeles, State of Cali lb rnia, is un- inhabited, is adjacent to the said City of El Segundo, is designated, named, described, referred to and known as 'Second Annexati on , Te rritory' , ,and is folly and completely described as follows: All of Lot Two (2) of Tract No. 3303, as per map recorded in Map Book 36, Page 14; also all of Lots 33, 34, 35 and 36 and part of Lots 229 249 26, 28 , 30, 31 and 32 of Tract No. 2356 as per map - recorded in Map Book 28, Page 42, and part of Block 18 of the El Porto Tract as per map recorded in Map Book 18, Pages 142 and 1439 all of Los Angeles County Records; also part of the Pacific Electric Railroad Right of way, also known as Lot M of Tract No. 2356, Highland Avenue and Port Avenue, all lying within the following described parcel of land: Beginning at the southwesterly corner of Lot 1, Tract No. 3303, as per map records of Book 36, Page 14 of Maps, records of Los Angeles County, and on file in the office of the County Recorder of said County; said point being also the southwesterly corner of the Oity of El Segundo, County of Los Ange- les, California, as the same now exists; tbenoe westerly along the northerly boundary line of the City of Manhattan Beach, as the same now exists, to the point of intersection of said northerly boundary line of the City of Manhattan Beach, with a line ly- ing 20.00 feet easterly of, measured at right angles, and parallel to th-e easterly line of Tract No. 4103, as per map records of Book 46, Page 8 of Maps,- re- corded and on file as aforesaid; thence northwesterly along the aforesaid line lying 20.00 feet easterly of, ,measured at right angles, and parallel to the easterly line of Tract No. 4103, as per said map last herein- - above referred to, to a point vhere said line inter- sects the easterly prolongation of the center line of that certain street known as 45th Street, Tract No. 4103, as per said map last hereinabove referred to; - thence westerly along the said easterly prolonga- tion of said center line of said 45th Street, Tract No. 4103, as per said map last hereinabove referred to, to a point where said easterly prolongation intersects the easterly line of Tract No. 4103, as per said map last hereinabove referred to; thence northerly along the said easterly line of said Tract No. 4103 to the northeasterly corner of said Tract No. 4103, as per said map last hereinabove referred to; thence west- erly along the nortberly line of said Tract No. 4103, its projection across Highland Avenue, as shovel upon the last above mentioned map, and its westerly pro- longation thereof, to a point where said westerly _ prolongation of said northerly line of said Tract No. 41-03 intersects the westerly line of tke Pacific Electric Railway Right, of Way; also known as Lot M. Segundo to the northwest- erly corner of Lot 1, Tract No. 33039 as per map records of Book 36, Page 14 of Maps, Records of Los Angeles County, and on file as aforesaid, said point being also on the southerly boundary line of the said City of El Segundo as the same now exists; thence southeasterly along the westerly line of Lot 1, Tract 3305p as per map last hereinabove referred to, said line being also the westerly line of-the said City of El Segundo, as the same now exists, to the point, of beginning. (b) That more than two - thirds of all of the voters voting at said special consolidated election, voted in favor of said proposition, second hereinbefore stated to -wit, the proposition of incurring a bonded debt of $37',000 for the purpose of acquiring, constructing and completing by said City a certain municipal improvement, to-wit:. a Municipal sewer system for the collection, arrying off and disposal of sewage ;.n and away from said City of El Segundo, consisting of the acquisition, con - struation and completion by said City of main trank line sewers and main intercepting sewers and consisting of the acquisition, construction and completion of an outfall sewer line or lines and disposal plant or plants, or the right to use such outfall sewer lines as_d disposal plants and including the acquisition, construction and completion of all necessary lands, rights ofrray, easements, pipe, machinery, apparatus and equipment necessary for the oomple- tion of such municipal sewer system,- and did thereby authorize the incurring of a bonded debt by said City of E1 Segundo in the sum of $375,000.00 for the purpose stated in said proposition. (c) That less than two - thirds of the voters voting at said special consolidated election voted in favor of said proposition third hereinbefore stated, to -wit, the proposition of acquiring, constructing and completing by said City, a certain municipal improvement, to -wit: A public park or system of parks, including the acquisition of lands and the improvement, of the same for, park purposes by the acquisition, oonstrnetion or completion thereon of lawns, trees, shrubbery, flowiers, vaal.ks, side - walks, drives and other structures, buildings or works necessary for the completion o f such municipal improvement , - and did thereby refuse to authorize the, incurring of a bonded indebtedness by said City of E1 Segundo in the sum of $50,000.00, or in any other sum, for the purpose stated in said proposition. AL SECTION 10. That therefore bonds of said City Will be issued to defray the cost of the acquisition, con- struction and completion of the improvement hereinabove referred to in the proposition set forth in Section 2 of this Resolution, to -wit, the proposition of acquiring, construct- ing and completing by said City a certain municipal im- provement, to -wit: a Municipal sewer system for the eolleo- tion, carrying off and disposal of sewage in and away from said City of El Segundo, consisting of the acquisition, construction and completion by said City of main trunk line sewers and main intercepting sewers and consisting of the acquisition, construction or completion of an outfall sewer line or lines mad disposal plant or plants, or the right to use such outfall sewer lines and disposal plants and including the acquisition, construction and completion of all necessary lands, rights of way, easements, pipe, maohi- nery, apparatus aad equipment neoessary for the completion of such municipal sewer system,- in the amount stated, to- wit, $375,000. SECTION 11. That t] Section 3 of this Resolution, the sum of 050,000 for public found to have failed to carry votes as required by law, and, the said proposition is lost. e proposition set forth in relating to a bonded debt in park purposes, is hereby by the, requisite number of it is therefore declared that SECTION 12.
