CC RESOLUTION 5587RESOLUTION NO. 5587 A RESOLUTION ESTABLISHING A NEW, OPTIONAL MEMBER GROUP FOR CURRENT AND RETIRED COUNCIL MEMBERS, WITH SUCH GROUP SEPARATE FROM THE POLICE SUPPORT SERVICES EMPLOYEE ASSOCIATION (PSSEA), AND DECLARING THAT THE NEW MEMBER GROUP SHALL RECEIVE THE SAME BENEFITS AS A NON -SAFETY GROUP (POLICE SUPPORT SERVICESS EMPLOYEES' ASSOCIATION) AS REQUIRED BY STATE LAW SECTION 1: Recitals: (1) The City of El Segundo has an existing agreement with the California Public Employees' Retirement System (CalPERS) to provide its health program to active City employees and officials and retired annuitants; (2) The CalPERS health program is governed by the Public Employees' Medical and Hospital Care Act (the "Act"); and (3) Concurrent with the adoption of this resolution, the City Council adopted a resolution electing to be subject to the Act and fixing the amount of the employer contribution by resolution; and (4) State law requires the benefits for the City's elected officials to receive the same benefits as a non -safety group and to not receive higher benefits than that group; (5) On March 15, 2016, City Council approved combining members of the current and retired City Council to the Police Support Services Employee Association (PSSEA) member group; and (6) The City Council desires to form a separate group for CalPERS medical coverage for current and retired City Council members. SECTION 2: The City Council of the City of El Segundo does resolve as follows: A. That, as of June 1, 2026, a separate, optional medical group for current and retired City Council members is hereby established. The current and retired City Council members will no longer be part of the Police Support Services Employee Association (PSSEA) medical group but instead will be in a new, and separate optional member medical group. B. That, to the extent permitted by law, the current and retired City Council optional members medical group shall receive the same benefits as the RESOLUTION NO. 5587 PAGE 1 of 3 Police Support Services Employees' Association (PSSEA), a non -safety group. SECTION 3: Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution. It is the City Council's intent that the provisions of this Ordinance be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution. SECTION 4: Severability. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable. SECTION 5: The City Clerk is directed to certify the adoption of this Resolution; record this Resolution in the book of the City"s original resolutions and make a minute of this adoption of the Resolution in the City Council's records and the minutes of this meeting. SECTION 6: This Resolution will become effective upon adoption and will remain effective unless repealed or superseded.
