2010-12-09 PC MinutesMINUTES OF THE MEETING OF THE PLANNING COMMISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA December 9, 2010 Chair Wagner called the El Segundo Planning Commission meeting to order at CALL TO ORDER 7:00 p.m. in the El Segundo City Hall's Council Chambers, 350 Main Street, El Segundo, California. Chair Wagner led the Pledge of Allegiance to the Flag. PRESENT: WAGNER, FELLHAUER, BALDINO and NEWMAN ABSENT: BARBEE None. Chairman Wagner presented the Consent Calendar. None. PLEDGE TO FLAG ROLL CALL PUBLIC COMMUNICATIONS CONSENT CALENDAR CALL ITEMS FROM CONSENT Vice Chair Fellhauer moved, seconded by Commissioner Baldino, to approve of MOTION the November 18, 2010 Minutes. Approved (3-0) Chair Wagner abstained. Vice Chair Fellhauer moved, seconded by Commissioner Baldino to approve MOTION Environmental Assessment No. 896 and Administrative Use Permit No. 10-10. Motion carried (4-0). Planning Manager Kimberly Christensen read into the record the revised Staff WRITTEN Report and Administrative Use Permit approval letter dated December 2, 2010 COMMUNICATIONS for Agenda Item H-4. Chairman Wagner presented Agenda Item H-3 Environmental Assessment No. NEW BUSINESS — EA-864 and Administrative Use Permit No. 10-01. Applicant: Sammy's Wood EA-864 and AUP 10-01 Fired Pizza — Anthony Kulick. Property Owner: PES Partners, LLC. Address: 780 South Sepulveda Boulevard, Suite B. Principal Planner Paul Samaras presented the staff report (of record.) Commissioner Newman asked whether or not Sammy's has any other location outside El Segundo. Commissioner Baldino stated that there is one in Torrance. Vice Chair Fellhauer moved, seconded by Commissioner Newman to Receive MOTION and File, the approval of Environmental Assessment No. EA-864 and Administrative Use Permit No. 10-01. Approved (4-0). El Segundo Special Planning Commission Meeting Minutes December 9, 2010 Page 1 Chairman Wagner presented Agenda Item H-4 Environmental Assessment No. NEW BUSINESS — EA-894 and Administrative Use Permit No. 10-09. Applicant: Robert M. EA-894 and AUP 10-09 Silverman of Walgreens Co. Property Owner: Force El Segundo, LLC. Address: 330 N. Sepulveda Blvd. Assistant Planner Bryan Fernandez presented the staff report (of record.) Commissioner Fellhauer asked whether conditions addressed the sale of single cans. Assistant City Karl Berger stated that the ABC regulations are very extensive and that the City will not be able to regulate the sale of single can alcohol. He stated that the Commission can request that the applicant agree to the condition voluntarily. Planning Manager Kimberly Christensen stated that in the analysis section of the staff report on Stamped Page 93 states that "the applicant will not sell distilled spirits, malt liquor, single servings or any other variation." Ms. Fellhauer stated that she would like the applicant to agree to a condition stating that the sale of single cans of alcohol will not be allowed. Mr. Berger stated that for the record that the applicant would need to agree for the conditions to be added. Matt Dzurec. representative for Walqreens Mr. Dzurec stated that Walgreens agreed to the conditions as stated in the application and staff report had no problem abiding by a condition to prohibit the sale of single servings. Commissioner Newman asked whether if all the Walgreens stores sell alcohol. Mr. Dzurec stated that not all stores do. He added that Walgreens decided to sell beer and wine for the first time this year. Ms. Fellhauer inquired why the sale of alcohol is only until 2:00 a.m. If the store is open 24 hours. Mr. Dzurec replied that although the store is open 24 hours a day, state law prohibits the hours of beer and wine sales from 6:00 am until 2:00 a.m. Ms. Newman inquired how the alcohol sale hours are enforced at the store. Mr. Dzurec stated that there is a register prompt that does not allow the sale after 2:00 a.m. and that there are security cameras as well. Mr. Berger stated the recommended language for a new Condition No. 16 that would read as follows: "that the applicant cannot sell distilled spirits, malt liquor, single servings of alcoholic beverages," if the applicant is in agreement. Mr. Dzurec stated that he is in agreement with the new condition. El Segundo Special Planning Commission Meeting Minutes December 9, 2010 Page 2 Commissioner Newman moved, seconded by Commissioner Fellhauer, to MOTION approve Environmental Assessment No. EA-894 and to Receive and File Administrative Use Permit No. 10-09 as amended adding Condition No. 16 "that the applicant cannot sell distilled spirits, malt liquor, single servings of alcoholic beverages." Approved (4-0). Chairman Wagner presented Agenda Item H-5 Environmental Assessment No. NEW BUSINESS — EA-881, Specific Plan Amendment No. 10-04, and Zone Text Amendment No. 10- EA-881, SPA 10-01 and 04. Applicant: Matt Crabbs. Property Owner: Various Owners. Address: Smoky ZTA 10-04 Hollow Specific Plan. Principal Planner Paul Samaras presented the staff report (of record.) Chair Wagner inquired about the point of sale allowed in art studios production space and art gallery. Mr. Samaras replied that an art gallery would only be allowed as an accessory use and that the production space for art studios functions more like an light industrial use were a product is produced. Commissioner Newman inquired whether retail sales would be allowed by this use. Mr. Samaras stated that art galleries are not a permitted primary use, but that accessory sales are permitted in that zone currently. Matt Crabbs, applicant Mr. Crabbs gave a brief statement in support of the project and stated that he was available to answer questions. Andy Sheng. Bill Messori, Mar Ventures. property owners of 126-138 Lomita Street Mr. Messori gave a brief statement in support of the project and stated that he was available to answer questions. Cavlan Mvronowicz Mr. Myronowicz stated that he is looking forward to purchasing one of the units and having the opportunity to do business here. Chair Wagner inquired about the number of vacancies that exist in the area. Planning and Building Safety Director Greg Carpenter stated that the vacancies rate for industrial space citywide was about 10 percent, and that in Smoky Hollow it is sometimes more difficult to find mainly due to zoning restrictions, age of the building, and parking. Commissioner Newman moved, seconded by Vice Chair Fellhauer to adopt MOTION Resolution No. 2684 recommending that the City Council approve Environmental El Segundo Special Planning Commission Meeting Minutes December 9, 2010 Page 3 Assessment No. EA-881, Specific Plan Amendment No. 10-01, and Zone Text Amendment 10-04. Approved (4-0). None. PUBLIC HEARING CONTINUED BUSINESS Planning and Building Safety Director Greg Carpenter thanked the Commission REPORT FROM and wished everyone a Merry Christmas. PLANNING AND BUILDING SAFETY DIRECTOR Commissioner Newman wished everyone a Merry Christmas and stated that the PLANNING El Segundo Christmas parade is on December 12, 2010. COMMISSIONERS COMMENTS Commissioner Fellhauer thanked staff for all their hard work. Chair Wagner stated that beginning December 131h the El Segundo Kiwanis Club and the El Segundo POA will be hosting Santa's Sleigh. None. OTHER BUSINESS Chair Wagner adjourned the meeting.
