Subject: City Council Meeting 1/21
Dear Mr. Hensley:
I am writing to inquire whether any City Councilmembers will be required or asked to recuse
themselves from tonight's discussion of Item 18 on the agenda: "Cultural Development
Program Review."
Since the potential elimination or modification of the CDP directly impacts fees levied on
commercial developments, it seems appropriate for the City Attorney to clarify the standard
for recusal and determine whether any Councilmembers with potential conflicts should
abstain from these discussions or votes (as seen when Councilmembers recused themselves
from matters related to the Downtown Specific Plan on past agendas).
Allowing Councilmembers with conflicts of interest to participate could raise ethical
concerns and undermine public trust. For this reason, I respectfully request that your office
provide the requested clarification before the start of tonight's City Council meeting.
