Christibelle Villena, Scott Houston (with SB Community Coalition Against Hate), Emily Atmore and Shad McFarland accepted the proclamation on behalf of the DEI Committee. 2. Aly Mancini, Recreation, Parks, and Library Director recapped this summer's programs. 3. Council presented a Commendation to Allison Reaser-Halverson for Winning the Women's Decathlon World Championship. Mr. Reaser accepted the commendation on her behalf. Approve warrants demand register for August 19, 2024 through September 1, 2024 and approve warrant demand register numbers 4B and 5A: warrant numbers 3052040 through 3052219, and 9003216 through 9003219. Ratify Payroll and employee benefit Checks; Checks released early due to contracts or agreement; Emergency disbursements and/or adjustments; and, Wire transfers. (Fiscal Impact: $2,262,399.08 ($982,783.53 in check warrants and $1,279,615.55 in wire warrants)) 6. PULLED BY MAYOR PRO TEM PIMENTEL 7. Accept Center Street Storm Drain Improvements project by Palp, Inc. DBA Excel Paving Company as complete and authorize the City Clerk to file a Notice of Completion with the Los Angeles County Recorder's Office. (Prof. No. PW 24-04) (Fiscal Impact: $173,742.12 included in adopted FY 2024-25 budget) 8. Declare 26 self-contained breathing apparatus harnesses and 40 apparatus bottles past their service life and surplus property, authorize the donation of the self-contained breathing apparatus harnesses and apparatus bottles to El Camino College and authorize the City Manager, or designee, in a form approved by the City Attorney, to draft an agreement releasing title and all liability to accompany the El Camino College donation. (Fiscal Impact: None) 9. Authorize the City Manager to approve a third amendment to Agreement No. 6041C with Garon Wyatt Investigative Services for an additional $50,000 for confidential personnel investigative services, increasing the total payable compensation to $100,000 and authorize the City Manager to approve an amendment to Agreement No. 6860 with Nicole Miller & Associates for an additional $25,000 for confidential personnel investigative services, increasing the total payable compensation to $75,000. (Fiscal Impact: Included in adopted FY 2024-25 budget) 10. Authorize the City Manager to execute license Agreement No. 7106 with the El Segundo Unified School District to allow the use of the City Council Chamber and Executive Conference Room for School Board Meetings on the second and fourth Tuesday of each month, through August 2025. (Fiscal Impact: The City will be reimbursed the actual cost of hourly City staff time required to record and live broadcast the ESUSD School Board Meetings. The estimated cost is $484.85 per meeting, assuming a two-hour meeting. The actual cost will vary, depending on the length of each meeting. The City will invoice the El Segundo Unified School District monthly to recoup the actual production cost) 11. Approve request to waive El Segundo Municipal Code § 10-1-4(C) to allow alcohol in the City -owned parking lot at the north-east corner of Main Street and Grand Avenue for the El Segundo Kiwanis Main Street Fair on Saturday, September 28, 2024. (Fiscal Impact: City Council approved a 75% fee waiver to support this event) EL SEGUNDO CITY COUNCIL MEETING MINUTES SEPTEMBER 17, 2024 PAGE 2 12. Waive the second reading, including by title, and adopt Ordinance No. 1664 amending El Segundo Municipal Code Titles 7, 9, and 10 to establish camping and associated regulations on public property and rules of conduct for the El Segundo Public Library and find that such actions are exempt from the California Environmental Quality Act, pursuant to Guidelines §§ 15060(c)(3), 15061(b)(3), and 15378. (Fiscal Impact: While activities to ensure constitutional due process and carry out enforcement will require personnel and storage space; it is not currently anticipated that such requirements will cause a fiscal impact on the City's General Fund) 13. MOTION PASSED. 4/0 PULLED ITEMS: 6, Notice of Completion and Agreement Amendments for El Segundo Boulevard Improvement Project. (Fiscal Impact: $8,187,537 (including funds for construction administration, inspection, and testing) included in adopted FY 2023-24 budget) See staff report for complete breakdown of funds and accounts. Mayor Pro Tern Pimentel commented on the project. Council discussion MOTION by Mayor Pro Tern Pimentel, SECONDED by Council Member Giroux to accept El Segundo Boulevard Improvement Project by Sully -Miller Contracting Company as complete, authorize the City Clerk to file and record a Notice of Completion with the Los Angeles County Recorder's Office, authorize an increase in the construction contingencies by $150,000 from $700,000 to $850,000 for Sully -Miller Contracting Company from Proposition C funds, and authorize the City Manager to execute an amendment to Agreement No. 6574B with Sully -Miller Contracting Company to increase the agreement amount by $150,000 for a total not -to -exceed amount of $7,436,035.30 and authorize an increase in the construction management contingencies by $146,688.63 from $30,000 to $176,688.63, and authorize the City Manager to execute an amendment to Agreement No. 6600A with Z&K Consultants to increase the agreement amount by $146,688.63 for a total not -to -exceed amount of $436,248.63, payable from Proposition C funds. Subcontractor Substitution for the Construction of the Urho Saari Swim Stadium/Plunge Renovation Project (Fiscal Impact: None at this time) EL SEGUNDO CITY COUNCIL MEETING MINUTES SEPTEMBER 17, 2024 PAGE 3 Council Member Baldino asked Elias Sassoon, Public Works Director why the subcontractor was being replaced. Mr. Sassoon gave an explanation. Council discussion MOTION by Council Member Baldino, SECONDED by Council Member Giroux authorizing the City Manager to substitute a subcontractor other than that designated in the original bid on Agreement No. 6864 for the Urho Saari Swim Stadium/Plunge Renovation Project. MOTION PASSED. 4/0 C. PUBLIC HEARINGS: None D. STAFF PRESENTAIONS: 14. Continue Emergency Action for the Repair of the Storm Drain Pipe on Grand Avenue (Fiscal Impact: City Council appropriated $100,000 to #001-400-4302-6215 (General Fund - Repairs & Maintenance) on the September 3rd, 2024 City Council meeting. $130,000 additional appropriations are needed at this time for the unexpected repair of an existing 8" sanitary sewer main pipe discovered while working on the storm drain pipe) Elias Sassoon, Public Works Director, reported on an urgent matter with an 8" sanitary sewer main pipe discovered while working on the storm drain affected by the sinkhole emergency. This drain will need immediate repair. For this additional action not on the posted agenda, the Council voted by two-thirds majority to consider this additional action related to the existing emergency. Council determined that: (1) immediate action must be taken; and (2) staff became aware of the need after the agenda was posted. Council discussion O MOTION by Council Member Baldino, SECONDED by Mayor Boyles approving the additional item discovered after the posting of the September 17, 2024 agenda regarding the repair of the 8" sanitary sewer main pipe which requires immediate action, and a two-thirds vote of approval. MOTION PASSED. 4/0 Elias Sassoon, Public Works Director reported on the original item, Council Discussion Council consensus to receive and file the report. MOTION by Mayor Pro Tern Pimentel, SECONDED by Council Member Giroux approving a need continue the emergency action approved under Resolution No. 5503 and additional repair of an 8" sanitary sewer drain pipe. Recreation Park Renovation Project Phase One - Proposed Teen Plaza Renovation Options (Fiscal Impact: $8,704,848.97 estimated cost for renovation of the Teen Plaza was included in the adopted FY 2024-25 Budget as part of the overall Recreation Park Projects budget) Aly Mancini, Recreation, Parks, and Library Director and Jennifer Zell, MIG gave a presentation. Mayor Boyles — Attended a tour with the DOD (Department of Defense), gave kudos to Todd DeVoe for Ready Day on September 12, 2024, attended the 9/11 ceremony and pancake breakfast put on by the Fire Department, attended the Slam City Skatepark event, met with Tracey Park, LA Council Member and attended Deep Tech Week events.
