The City Council, with certain statutory exceptions, can only act upon properly posted
and listed agenda items. Any writings or documents given to a majority of City Council
regarding any matter on this agenda that the City received after issuing the agenda
packet are available for public inspection in the City Clerk's Office during normal

amount by $175,000 for a total not -to -exceed amount of $250,000 per
fiscal year for building plan check review and inspection services.

Camino College and authorize the City Manager, or designee, in a form
approved by the City Attorney, to draft an agreement releasing title and all liability
to accompany the El Camino College donation.

9. Authorize the City Manager to approve a third amendment to Agreement No.
6041C with Garon Wyatt Investigative Services for an additional $50,000 for
confidential personnel investigative services, increasing the total payable
compensation to $100,000 and authorize the City Manager to approve an
amendment to Agreement No. 6860 with Nicole Miller & Associates for an
additional $25,000 for confidential personnel investigative services, increasing
the total payable compensation to $75,000.
(Fiscal Impact: Included in adopted FY 2024-25 budget)
10. Authorize the City Manager to execute license Agreement No. 7106 with the El
Segundo Unified School District to allow the use of the City Council Chamber
and Executive Conference Room for School Board Meetings on the second and
fourth Tuesday of each month, through August 2025.
(Fiscal Impact: The City will be reimbursed the actual cost of hourly City staff
time required to record and live broadcast the ESUSD School Board Meetings.
The estimated cost is $484.85 per meeting, assuming a two-hour meeting. The
actual cost will vary, depending on the length of each meeting. The City will
invoice the El Segundo Unified School District monthly to recoup the actual
production cost)
11. Approve request to waive El Segundo Municipal Code § 10-1-4(C) to allow
alcohol in the City -owned parking lot at the north-east corner of Main Street and
Grand Avenue for the El Segundo Kiwanis Main Street Fair on Saturday,
September 28, 2024.
(Fiscal Impact: City Council approved a 75% fee waiver to support this event)

Environmental Quality Act, pursuant to Guidelines §§ 15060(c)(3), 15061(b)(3),
and 15378.
(Fiscal Impact: While activities to ensure constitutional due process and carry out
enforcement will require personnel and storage space; it is not currently
anticipated that such requirements will cause a fiscal impact on the City's
General Fund)

Completion with the Los Angeles County Recorder's Office, authorize an increase in the
construction contingencies by $150,000 from $700,000 to $850,000 for Sully -Miller
Contracting Company from Proposition C funds, and authorize the City Manager to
execute an amendment to Agreement No. 6574B with Sully -Miller Contracting Company
to increase the agreement amount by $150,000 for a total not -to -exceed amount of
$7,436,035.30 and authorize an increase in the construction management
contingencies by $146,688.63 from $30,000 to $176,688.63, and authorize the City
Manager to execute an amendment to Agreement No. 6600A with Z&K Consultants to
increase the agreement amount by $146,688.63 for a total not -to -exceed amount of

authorizing the City Manager to substitute a subcontractor other than that designated in
the original bid on Agreement No. 6864 for the Urho Saari Swim Stadium/Plunge
Renovation Project. MOTION PASSED. 4/0

14. Continue Emergency Action for the Repair of the Storm Drain Pipe on Grand
Avenue
(Fiscal Impact: City Council appropriated $100,000 to #001-400-4302-6215
(General Fund - Repairs & Maintenance) on the September 3rd, 2024 City
Council meeting. $130,000 additional appropriations are needed at this time for
the unexpected repair of an existing 8" sanitary sewer main pipe discovered
while working on the storm drain pipe)
Elias Sassoon, Public Works Director, reported on an urgent matter with an 8" sanitary
sewer main pipe discovered while working on the storm drain affected by the sinkhole
emergency. This drain will need immediate repair. For this additional action not on the
posted agenda, the Council voted by two-thirds majority to consider this additional
action related to the existing emergency. Council determined that: (1) immediate action
must be taken; and (2) staff became aware of the need after the agenda was posted.

kudos to Todd DeVoe for Ready Day on September 12, 2024, attended the 9/11

FISCAL IMPACT:
The warrants presented were drawn in payment of demands included within the FY
2024-2025 Adopted Budget. The total of $1,081,614.43 ($680,204.81 in check warrants
and $401,409.62 in wire warrants) are for demands drawn on the FY 2024-2025
Budget.

California Government Code Section 37208 provides General Law cities flexibility in
how budgeted warrants, demands, and payroll are audited and ratified by their
legislative body. Pursuant to Section 37208 of the California Government Code,
warrants drawn in payments of demands are certified by the City's Chief Financial
Officer and City Manager as conforming to the authorized expenditures set forth in the
City Council adopted budget need not be audited by the City Council prior to payment,
but may be presented to the City Council at the first meeting after delivery.
In government finance, a warrant is a written order to pay that instructs a federal, state,
county, or city government treasurer to pay the warrant holder on demand or after a
specific date. Such warrants look like checks and clear through the banking system like

checks. Warrants are issued for payroll to individual employees, accounts payable to
vendors, to local governments, and to companies or individual taxpayers receiving a
refund.
DISCUSSION:
The attached Warrants Listing delineates the warrants that have been paid for the
period identified above. The Chief Financial Officer certifies that the listed warrants
were drawn in payment of demands conforming to the adopted budget and that these
demands are being presented to the City Council at its first meeting after the delivery of
the warrants.

RECOMMENDATION:
1. Authorize the City Manager to execute an amendment to Agreement No. 6756
with Willdan Engineering to increase the annual not -to -exceed amount by
$175,000 for a total not -to -exceed amount of $250,000 per fiscal year for building
plan check review and inspection services.
2. Authorize the City Manager to execute an amendment to Agreement No. 6755
with True North Compliance, Inc. to increase the annual not -to -exceed amount
by $175,000 for a total not -to -exceed amount of $250,000 per fiscal year for
building plan check review and inspection services.
3. Appropriate $250,000 from the General Fund Reserves to FY 2024-25 budget
expenditure account 001-400-2403-6214.
4. Alternatively, discuss and take other action related to this item.
FISCAL IMPACT:
All fees related to this item are paid from fees collected by the City for either plan check
or inspection services. The consultant fee is 70% of the fee collected by the City, the
remaining 30% of the fee covers the administrative and overhead costs of the City.
Each agreement will be amended to a not -to -exceed compensation cap of $250,000
each fiscal year until the expiration of the three-year term on September 19, 2026. If
approved, the new combined contract amount for True North Compliance (True North)
and Willdan Engineering (Willdan) for the first year would be $500,000, and $1,500,000
for the full three-year term.
The FY 2024-25 adopted budget includes $250,000 for Professional and Technical
Services for True North ($125,000), Inc., and Willdan ($125,000). Salary Savings from

the Community Development Department would not cover the additional contract
amendment. Approval of the contract amendments will require an additional
appropriation of $250,000 for fiscal year 2024-25 from the General Fund Reserves. The
budget breakdown is as follows:

BACKGROUND:
On September 19, 2023, City Council approved two professional service agreements
with each True North and Willdan for building plan check review and inspection
services, for a total, fiscal year not -to -exceed compensation cap of $75,000 each.
Historically, the City has maintained on -call plan check and inspection services through
third party consulting firms in order to maintain a consistent level of service when
experiencing surges in permitting activity or staff turn over.

The Building and Safety Division continues to see a steady level of permitting activity,
processing an average of 800-1,000 building permits annually. Despite ongoing
recruitment efforts over the last 18 months, a shortage in the availability of qualified
candidates to fill two existing vacated Plan Check Engineer positions created a greater
reliance on True North and Willdan to keep up with plan review services.
Although recruitment efforts to fill the vacated Plan Check Engineer positions will
continue, in order to keep up and maintain the level of service expected in El Segundo,
staff may need to increase the volume of plan check reviews sent out to professional
services. Costs are only incurred when plan review or inspection services are
requested. As described above, all costs are paid from fees collected by the City for
applicable plan review or inspection services. Consequently, corresponding revenue is
offset by the increased expenditure, with 70% of the fee paying for professional services
and 30% supporting the City's administrative and overhead costs.

FISCAL IMPACT:
City Council appropriated $100,000 to account #001-400-4302-6215 (General Fund -
Repairs & Maintenance) at the September 3, 2024 City Council meeting. The additional
$130,000 needed to repair the sewer line is available in the Sewer Fund #502-400-
8204-8647 (Sewer Main Repair). No additional appropriations are needed at this time.

state law requires that the City Council review the emergency action at each regular
meeting thereafter. If the Council determines by four -fifths votes that there is a need to
continue the emergency action, then such work may continue.
DISCUSSION:
On September 3, 2024, the City Council adopted Resolution No. 5503 to declare an
emergency, under Public Contract Code §§ 20168 and 22050, due to a sinkhole caused
by a crack developed on a storm drain lateral pipe, and approved the award of a
contract to Williams Pipeline Contractors to effectuate the necessary repairs. State law

requires the City Council to review the emergency action at every regularly scheduled
meeting thereafter until the action is terminated, to determine, by a four -fifths vote, that
there is a need to continue the action." Staff provides this report and associated
presentation to facilitate the mandated emergency review.
The work began on repairing the storm drain lateral pipe, including excavating to a
depth of approximately 20 feet to uncover the damaged pipe. The repair of this pipe was
completed on September 6, 2024, and subsequently the back -filling of the excavated pit
work began. However, during the back -filling of the excavation pit, it was discovered
that the existing 8-inch sanitary sewer main was vertically displaced for a length of 140-
feet, and would need to be replaced with a budget of $130,000.
Staff explained the need for this additional work at the September 17, 2024 City Council
meeting, and the City Council unanimously determined that there was a need to include
this additional work as part of the continuation of the emergency action. At this time,
repair work is being done to replace approximately 140-feet of sewer pipe in Grand
Avenue. It is anticipated that the repair work will be completed by the end of next month.
Accordingly, staff believes it is appropriate for the City Council to continue the ongoing
local emergency.

A RESOLUTION ADOPTED PURSUANT TO PUBLIC
CONTRACTS CODE § 20168 FINDING THAT AN
EMERGENCY HAS EXISTED WITHIN THE CITY,
AUTHORIZING CONTRACTING WITHOUT THE NEED FOR
BIDDING PURSUANT TO PUBLIC CONTRACTS CODE §
22050
The City Council does resolve as follows:
SECTION 1: The City Council finds and declares as follows:
A. Pursuant to Public Contracts Code § 20168, the City Council may, upon a
four -fifths vote, declare that public interest and necessity demand the
immediate expenditure of public money to safeguard life, health, or
property because of an emergency.
& In accordance with Public Contracts Code §§ 20168 and 22050, the City
Council may repair or replace a public facility, take any directly related and
immediate action required by that emergency, and procure the necessary
equipment, services, and supplies for those purposes, without giving
notice for bids to let contracts.
C. On August 15, 2024, a sudden, unforeseen collapse occurred on a City
storm drain line located in Grand Avenue approximately 10-ft west of the
intersection of Grand Avenue and Indiana Street.
D. In compliance with applicable law, and to protect public, health, safety and
welfare, the City took immediate emergency action to cause the storm
drain to be repaired beginning on August 15, 2024.
E. The utility line collapse created a sudden, unexpected occurrence that
poses a clear and imminent danger to City property, its citizens, and
employees. This threat required immediate action to prevent or mitigate
the loss or impairment of essential public services.
F.. Under such emergency conditions, the City Council finds that the delay
resulting from public bidding would imperil essential public services.
SECTION 2: Approval; Delegation. The City Council approves the expense of $100,000
from the General Fund for the time and materials contracting cost required for the
repairs required to remediate the emergency described in Section 1, above. The City
Manager or designee is authorized to execute agreements or other associated
documents, in forms approved by the City Attorney, to effectuate the necessary repairs.

SECTION 3: In light of the emergency described above, the City Council directs the
City Manager, or designee, to take all steps necessary to protect public health, safety
and welfare including, without limitation, awarding and signing contracts in accordance
with Public Contracts Code § 22050.
SECTION 4: This Resolution will become retroactively effective immediately upon
adoption and remain effective unless superseded by a subsequent resolution.
SECTION 5: Pursuant to Public Contracts Code § 22050(c), the City Council will review
this emergency action at its next regularly scheduled meeting and at every regularly
scheduled meeting thereafter until the work described above is completed. The Council
must determine by a four -fifths vote that there is a need to continue the work at each
meeting or terminate the action at the earliest possible date that conditions warrant.

Resolution Establishing the Basic Hourly Salary Range for the License Permit Specialist
1-11 Part -Time Classification
RECOMMENDATION:
Adopt a resolution establishing the basic hourly salary range for the License
Permit Specialist 1-II Part -Time Classification.

FISCAL IMPACT:
Funding for the License Permit Specialist Part -Time 1/11 position assigned to the Fire
Department was approved as part of the FY 2024-25 budget. No additional
appropriation is needed at this time.
BACKGROUND:
The FY 2024- 2025 budget was adopted by City Council on June 4, 2024 and included
an appropriation to the Fire Department budget for part-time salaries in the amount of
$31,262 for a License Permit Specialist 1-II part-time position. Funding for this position is
offset by the fees collected by the City for inspection services, plan check, and building
and safety plan reviews. This unrepresented part-time position is anticipated to work up
to 19 hours per week. The attached resolution establishes the basic hourly salary range
at the same hourly rate as the represented full-time classification.
DISCUSSION:
The part-time License Permit Specialist 1-11 will provide the Fire Department with a
greater ability to enhance customer service for residents and businesses by
supplementing full-time staff to reduce the response time for scheduling inspections,
issuing permits and violation notices, and verifying online payment with the Finance
Department for these services.

The Fire Department conducts approximately 3,200 inspections annually which require
significant administrative staff assistance to provide customer service to the public for
these items in -person, over the phone, and via email. The Department is now compliant
with all State -mandated inspections and this position will ensure that compliance levels
are maintained.
A resolution is required to establish the basic hourly salary range for this part-time
position. Upon approval and adoption by the City Council, Human Resources will open
a competitive recruitment for the position.

The City Council of the City of El Segundo does resolve as follows:
SECTION 1: The City Council approves the following basic salary range, as further

RECOMMENDATION:
1. Adopt a resolution temporarily suspending collection and implementation of an
additional 0.75% sales tax, as authorized under El Segundo voter -approved
Measure C, and finding such action exempt from review under the California
Environmental Quality Act.
2. Alternatively, discuss and take other action related to this item.
FISCAL IMPACT:
Adoption of the resolution would suspend the City's collection of Measure C's 0.75%
sales tax, which city staff estimated could generate approximately $9 million in
additional City sales tax revenues annually. Approval of the suspension would obviate
the need for tax implementation costs, including California Department of Tax and Fee
Administration (CDTFA) implementation fees ($175,000) and associated audit
consultant fees (approximately $2,500 per year).
BACKGROUND:
On April 10, 2018, 83% of the voters of the City of El Segundo approved Measure C,
(Ordinance No. 1566; El Segundo Municipal Code (ESMC) Chapter 3-8) authorizing the
imposition of a three-quarter cent (0.75%) transaction and use tax (sales tax), to
become effective once another taxing entity places a new or increased retail
transactions and use tax on the ballot seeking voter approval.
On June 25, 2024 the Los Angeles County (County) Board of Supervisors submitted a
citizens' sales tax measure, entitled "Affordable Housing, Homelessness Solutions and
Prevention Now Measure" (the "County Tax Measure"), to voters for the November 5,
2024 election. The County Tax Measure would repeal and replace the County's

Measure H quarter -cent (0.25%) sales tax and replace it with a permanent half -cent
(0.50%) tax, thus increasing sales taxes in the County by 0.25%. Measure H otherwise
is set to sunset in 2027.
The submission of the County Tax Measure to voters triggered the City's ability to
collect additional Measure C three-quarter cent (0.75%) transaction and use tax (i.e.
sales tax). County voter approval of the County Tax Measure would allow for El
Segundo's ongoing collection of the additional 0.75% sales tax. The County Tax
Measure's failure would require the City Council's suspension of the additional 0.75%
sales tax collection. Notwithstanding the City's ability to collect the additional 0.75%
sales tax, Measure C, via ESMC § 3-8-15 (Suspension or Reduction), authorizes the
City Council to suspend or reduce the imposition of the additional 0.75% sales tax, after
a public hearing. For clarity, "reduction" of the tax means the imposition of only a portion
of the 0.75% collection otherwise allowable.
State law provides that the combined rate of all sales taxes imposed by local taxing
authorities in any county (including the county itself and cities within the county) may not
exceed 2 percent. (Rev. & Tax Code 7251.1.) That, together with other state laws,
effectively caps the total permissible sales tax rate within a county at 10.25 percent.
However, AB 1679 (2023) authorized the County of Los Angeles to impose a sales tax
of no more than 0.50 percent (to fund homeless prevention efforts) that, in combination
with other sales taxes, may exceed the 2 percent cap on locally imposed sales taxes.
The net effect of AB 1679 was to increase the cap on local sales taxes in Los Angeles
County from 2.00% to 2.25%. (Rev. & Tax Code 7286.01.) Accordingly, the maximum
permissible total sales tax in Los Angeles County is now 10.50%.
The table below illustrates the sales tax rate in El Segundo based upon the County Tax
Measure's success of failure (without inclusion of Measure C's additional 0.75% sales
tax).

Measure C allows the City to capture the 0.75% difference between the 10.50% sales
tax cap now allowable under AB 1679 and the 9.75% sales tax that would be effective if
the County Tax Measure is approved. If the County Tax Measure fails, the total tax rate
would remain at 9.50%.
DISCUSSION:
On August 20, 2024, following City staff's presentation regarding potential options
regarding Measure C tax collection, including implementation measures, the City
Council directed preparation of a resolution suspending the City's collection of the
additional 0.75% sales tax. As noted above, ESMC § 3-8-15 (Suspension or Reduction),
authorizes the suspension of the additional 0.75% sales tax.
In accordance with the City Council's August 20, 2024 direction, the proposed resolution
would suspend collection of the entire additional 0.75% sales tax under Measure C.
Section 2(C) of the proposed Resolution reserves the City Council's existing discretion
to, at a later time, partially or completely activate the additional 0.75% sales tax,
pursuant to the same authorizing triggers that the City's voters approved under Measure
C. For example, if the County Tax Measure fails in November, the sales tax in El
Segundo would remain at 9.50%, and the Measure C tax will remain suspended unless
and until it is again triggered by an applicable taxing district placing a sales tax on the
ballot. This would be in light of the 10.50% sales tax cap now allowable under AB 1679.
Alternatively, if the County Tax Measure prevails, the City could still reverse the
suspension and capture the additional 0.75% sales tax difference between the 10.50%
sales tax cap allowable under AB 1679 and the 9.75% sales tax based on its reserved
rights in Resolution Section 2(C) and ESMC § 3-8-15 (Suspension or Reduction).
Consistent with § 3-8-15, the public hearing to consider this Resolution was duly
published in a newspaper of general circulation. With regard to environmental review,
the proposed Resolution would find that the tax suspension is exempt from further
review under state law (California Public Resources Code §§ 21000, et seq., "CEQA"
and 14 California Code Regulations § 15000, et seq.) because it involves governmental
fiscal activities which do not involve any commitment to any specific project and will not
result in direct or indirect physical changes in the environment. Accordingly, this action
does not constitute a "project" that requires environmental review (14 CCR § 15378
(b)(4)).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL
SEGUNDO TEMPORARILY SUSPENDING COLLECTION OF
THE 0.75 PERCENT TRANSACTIONS AND USE TAX
AUTHORIZED BY THE VOTERS AT THE GENERAL
MUNICIPAL ELECTION HELD ON APRIL 10, 2018 (MEASURE
C), AND DETERMINING THIS RESOLUTION IS EXEMPT
FROM REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
The City Council of the City of El Segundo resolves as follows:
SECTION 1. The City Council finds as follows:
A. At the general municipal election held on April 10, 2018, the voters of the City of
El Segundo adopted Ordinance No. 1566 ("Measure C").
B. Measure C authorized a 0.75 percent transactions and use tax, the collection of
which was suspended for so long as any district having taxing powers within the
City's jurisdiction did not place a measure on the ballot seeking voter authorization
for a new or increased transactions and use tax. In the event a district with taxing
powers within the City's jurisdiction sought voter approval of a new or increased
transactions and use tax, the City would commence collection of the tax
authorized by Measure C.
C. On June 18, 2024, the County of Los Angeles announced that its "Affordable
Housing, Homelessness Solutions and Prevention Now" measure (hereinafter,
the "County Tax Measure") seeking voter approval of a new transactions and use
tax had qualified for the November 2024 ballot. Placement of the County Tax
Measure on the November 2024 ballot triggered commencement of collection of
the City's Measure C tax.
D. Measure C expressly authorizes the City Council to suspend or reduce the 0.75
percent transactions and use tax by resolution after a public hearing. (El Segundo
Municipal Code ("ESMC") § 3-8-15.)
E. The City Council desires to suspend, temporarily, collection of the 0.75 percent
transactions and use tax authorized by Measure C. By this action, the City
Council expressly reserves all power, authority, and discretion vested in it by the
voters through Measure C, and does not waive its power, authority, and discretion
to implement, at a future date, all or any portion of the Measure C tax in
accordance with the provisions of Measure C.

F. In accordance with ESMC § 3-8-15, the City Council held a duly noticed public
hearing on October 1, 2024, at which time it heard and considered all oral and
written testimony from the public prior to acting on this Resolution.
SECTION 2. Action.
A. Pursuant to ESMC § 3-8-15, the City Council hereby temporarily suspends
collection of the 0.75 percent transactions and use tax authorized by Measure C.
B. The City Council expressly reserves all power, authority, and discretion vested in
it by the voters through Measure C, and does not waive its power, authority, and
discretion to implement, at a future date, all or any portion of the Measure C tax
in accordance with the provisions of Measure C.
C. If the County Tax Measure fails to become effective, the tax authorized by
Measure C will remain suspended for so long as any district having taxing powers
within the City's jurisdiction does not place a measure on the ballot seeking voter
authorization for a new or increased transactions and use tax.
SECTION 3. The City Manager is hereby authorized to take any actions that are
necessary and appropriate to carry out the purpose and intent of this Resolution.
SECTION 4. Effective Date. This Resolution shall go into effect immediately upon
adoption.
SECTION 5. CEQA. This Resolution is exempt from review under the California
Environmental Quality Act (California Public Resources Code §§ 21000, et seq., "CEQA")
and CEQA regulations (14 California Code Regulations § 15000, et seq.) because it
involves governmental fiscal activities which do not involve any commitment to any
specific project and will not result in direct or indirect physical changes in the environment.
Accordingly, this action does not constitute a "project" that requires environmental review
(14 CCR § 15378 (b)(4)).
SECTION 6. The City Clerk will certify to the passage and adoption of this Resolution;
will enter the same in the book of original Resolutions of said City; and will make a minute

FISCAL IMPACT:
Funding for action related to the previously approved memoranda of understanding
(MOUs) is incorporated in the adopted FY 2024-25 operating budget. The fiscal impact
of the medical contribution for Unrepresented Hourly Employees considered full-time
under the Affordable Care Act (ACA) is dependent upon the number of employees who
accept the offer of coverage. The estimated maximum fiscal impact for calendar year
2025 is projected to be approximately $28,857. Sufficient funding is included in the
adopted FY 2024-25 operating budget.
BACKGROUND:
Staff and representatives of the employee labor groups met and conferred, and City
Council adopted and approved the MOUs listed above, which provide for a $50 increase

to the City's monthly medical contribution effective January 1, 2025, bringing the City's
total monthly contribution to $1,800 per month.
A Flexible Benefit Plan for unrepresented Management and Confidential employees is
outlined in Chapter 1A2 of the Administrative Code, Section 1A2.105. Management and
Confidential Series employees receive a $932 monthly contribution consisting of a
medical contribution under the Public Employees Medical and Hospital Care Act
(PEMHCA) plus a $818 Flexible Dollars Benefit. Effective January 1, 2025, the monthly
City contribution to the Flexible Dollars Benefit will increase by $50. The PEMCHA
contribution will remain at $932, and the new Flexible Dollar contribution will be $868,
totaling $1,800 per month.
On October 3, 2023, the City Council adopted a monthly minimal essential health
contribution for unrepresented hourly employees as required by the ACA. Each year, an
affordability analysis must be conducted to determine if an adjustment to the
contribution is necessary to maintain affordability.
All represented employee groups are now aligned so that every employee receives the
same $1,800 monthly contribution effective January 1, 2025. As required by CalPERS,
separate resolutions for each group are attached to this report to effectuate the changes
to City contributions. Information regarding the Resolutions previously approved by City
Council providing for the increases to City contributions is detailed below:
El Segundo City Employees' Association (CEA): City Council adopted the successor
CEA MOU on September 3, 2024 by Resolution 5504.
El Segundo Firefighters' Association (ESFA): City Council adopted the successor ESFA
MOU on May 21, 2024 by Resolution 5488.
El Segundo Police Managers' Association (PMA): City Council adopted the successor
PMA MOU on November 7, 2023 by Resolution 5447.
El Segundo Police Support Services Employees' Association (PSSEA): City Council
adopted the successor PSSEA MOU on June 20, 2023 by Resolution 5426.
El Segundo Police Officers' Association (POA): City Council adopted the successor
POA MOU on May 2, 2023 by Resolution 5411.
El Segundo Supervisory and Professional Employees' Association (SPEA): City Council
adopted the successor SPEA MOU on April 18, 2023 by Resolution 5408.
El Segundo Administrative Code Chapter 1A2 Management & Confidential Series: City
Council adopted Resolution 5433 (Mid -Management and Confidential) on August 15,
2023 and 5307 (Executive Management) on February 1, 2022 to increase the City
medical contributions under PEMHCA. Resolution 5496 was adopted on August 15,

2023 and adjusted the Flexible Benefit contribution for both Executive and Mid -
Management Confidential employees.
Unrepresented Hourly Employees considered full-time under the ACA: The ACA
requires employers to offer affordable, minimum essential health insurance coverage to
employees that work "full-time." Under the ACA, an employee that works an average of
30 hours per week during the City's designated measurement period of November 1
through October 31 is considered full-time. Employee work hours are tracked
throughout the year and an annual eligibility analysis is conducted in October. The
minimum essential coverage (MEC) for each calendar year is calculated using the ACA
affordability threshold, federal poverty level for Los Angeles, and CalPERS lowest
medical premium rate.
Effective January 1, 2025, the affordability threshold is 9.02% and the cost of the lowest
CalPERS medical premium is $714.40 per month. The maximum employee monthly
contribution will be $113.28, and the minimum employer contribution will be $601.20 per
month. After conducting an early analysis of the employee hours worked thus far during
the November 1, 2023 through October 31, 2024 measurement period, we anticipate
that there will be four employees eligible for an offer of coverage. The fiscal impact is
dependent upon the number of employees who accept the medical coverage through
the City's CalPERS plan (currently no employees have accepted the City's ACA offer of
coverage). Based on the limited number of qualifying employees, the estimated
maximum fiscal impact for calendar year 2025 is projected to be approximately $28,857.
City Council adopted a minimum essential coverage contribution on October 3, 2023 for
the calendar year beginning January 1, 2024. The attached resolution updates the
MEC and establishes a new MEC allowance of $601.20 per month effective January 1,
2025.
DISCUSSION:
CalPERS requires contracting agencies participating in the Health Plan under PEMHCA
to submit a change resolution approved by the City Council to amend the employer
contribution for medical premiums. This item outlines the previously adopted City
medical contributions in MOUs and the Administrative Code and fulfills the City's
obligation to adjust the MEC allowance as appropriate for unrepresented hourly
employees considered full-time under the ACA. Human Resources will ensure that the
approved resolutions are recorded with CalPERS and work with Finance to implement
the increases to the City's contribution for medical premiums.

Segundo shall be subject to determination of its status as an "agency or
instrumentality of the state or political subdivision of a State" that is
eligible to participate in a governmental plan within the meaning of

Regulations pursuant to such Section. If it is determined that City of El
Segundo would not qualify as an agency or instrumentality of the state or
political subdivision of a State under such final Regulations, CalPERS

RECOMMENDATION:
Adopt a resolution providing for revised salary and benefits for the unrepresented
Police Officer Trainee classification.

FISCAL IMPACT:
The fiscal impact of the updated salary and various benefits for the unrepresented,
"Police Officer Trainee" classification for the remainder of FY 2024-25 is approximately
$129,692. This total fiscal impact includes six El Segundo Police Department trainee
incumbents and two additional new hires that are expected to begin employment in
early October. Additional appropriation from the General Fund reserves is needed in the
following amounts to these accounts:
001-400-3102-4101 Salaries Full-time - $99,694.18
001-400-3102-4201 Retirement CalPERS - $10,158.84
001-400-3102-4202 FICA/Medicare - $7,626.60
001-400-3102-4203 Workers' Compensation - $12,212.54
BACKGROUND:
The El Segundo Police Department (ESPD) officer trainees must serve a limited -term
appointment typically lasting six months, and, upon successful completion of the ESPD
Academy, may be appointed to a probationary sworn (safety) ESPD Officer
classification which is represented by the El Segundo Police Officers' Association

(POA). The City has established the Police Officer Trainee employment classification for
these ESPD trainees under a probationary, non -sworn (miscellaneous) classification
that is not represented by any bargaining unit.
The City Council adopted Resolution No. 5025 on February 21, 2017 to establish salary
and benefits for the Police Officer Trainee classification. For base salary, Resolution No.
5025 established a Police Officer Trainee classification hourly rate of eighty percent
(80%) of the ESPD sworn officer salary. Non -salary benefits (health, dental, vision and
life insurance) and sick and vacation leave accruals for the Police Officer Trainee
classification mirror those for sworn ESPD officers covered under the POA
Memorandum of Understanding (MOU). The Police Officer Trainee does not receive
any other benefits (i.e. special pays) provided under the POA MOU unless and until
they are appointed to a sworn ESPD officer position.
DISCUSSION:
To assist ESPD and the Human Resources Department with filling projected ESPD
officer vacancies due to expected retirements, the City Council adopted Resolution No.
5415 authorizing an expansion of the Lateral Police Officer Incentive Program on May
16, 2023. This program provides a total of $40,000 to successful candidates that pass
probation and remain employed as an ESPD Police Officer for five years.
Under the Lateral Police Officer Incentive Program, the bonus is paid as follows:
$10,000 upon hire, $10,000 upon completion of probation, $8,000 upon completion of
second year of employment, $6,000 after completion of third year, and $6,000 after
completion of fourth year. Additionally, any current City employee is provided with a
$10,000 bonus paid in two $5,000 increments for referring a lateral ESPD officer: when
the officer is hired and again when they successfully complete probation. The expansion
of the Lateral Police Officer Incentive Program has assisted recruitment efforts in this
very competitive labor market.
ESPD is currently budgeted and staffed with 62 sworn personnel (i.e.- Police Officers,
Sergeants, Lieutenants, Captains, and the Chief of Police). On June 20, 2023, City
Council authorized an additional 10 sworn personnel to attain a total of 72 sworn
personnel. The Police and Human Resources Departments have been diligently
working together to fill the additional 10 positions to achieve the goal of 72 sworn
personnel.
Currently, six ESPD officer trainees attend the Police Academy with two additional
ESPD officer trainees starting in early October 2024. Upon graduation from the Police
Academy, the trainees may be appointed to a sworn ESPD officer position. If all eight
trainees are successful, that would place the Department at 70 sworn personnel, just
two under the staffing goal of 72 sworn officers. Recruitment and selection for the Police
Officer Trainee and Police Officer are ongoing to maintain staffing and to account for
regular attrition due to retirements or other separations.

The unrepresented Police Officer Trainee classification does not participate in a meet
and confer labor negotiations process as is customary with the represented employees
in bargaining units (i.e. POA). While Resolution No. 5025 established a link between the
Police Officer Trainee and ESPD Officer salaries and some of their benefits, it is only
updated via a successor resolution; there is no automatic increase. The last adjustment
was made in February 2017, more than seven and a half years ago. Updating the salary
to reflect the previously approved range set at eighty percent (80%) of ESPD officer
salary will recognize the position's responsibilities and provide the City with a more
competitive edge in recruitment efforts.
The City Council adopted Resolution No. 5411 approving the successor POA MOU on
May 2, 2023 which includes a three percent (3%) salary increase effective the pay
period that includes January 1, 2025. The resolution attached to this report includes a
salary range adjustment for the Police Officer Trainee effective October 5, 2024 along
with a second salary range adjustment to align with the POA increase effective
December 28, 2024. The basic salary would maintain the trainees' eighty percent (80%)
of the ESPD officer salary.
Upon City Council approval, Human Resources will process salary increases for the
current ESPD officer trainees and post the updated salary on the publicly available
schedule on the City's website as required by CalPERS.

A RESOLUTION ESTABLISHING UPDATED SALARY AND
VARIOUS BENEFITS FOR POLICE OFFICER TRAINEES
The City Council of the City of El Segundo does hereby resolve as follows:
SECTION 1: Classification. The Police Officer Trainee classification is a probationary
non -sworn classification that is not represented by any bargaining unit. Police Officer
Trainees must serve a limited -term appointment, and, upon successful completion of the
Police Academy, may be appointed to a probationary sworn Police Officer classification
which is represented by the Police Officers' Association ("PDX).
SECTION 2: Base Salary.
A. The City of El Segundo ("City") previously approved and adopted Resolution No.
5025 on February 21, 2017 providing for salary and benefits for the Police Officer
Trainee classification. The base salary was established at an hourly rate of eighty
percent (80%) of the Police Officer salary range. Benefits provided to this position
for retirement, health, dental, vision along with sick and vacation leaves were
provided at the same level as the Police Officer classification.
B. The City seeks to update the Police Officer Trainee classification base salary
hourly rate of eighty percent (80%) of the Police Officer salary range to align with
recent updates to the Police Officer salary range.
C. Accordingly, the Police Officer salary range is updated and will take effect as
follows:
1. Effective October 5, 2024, the Police Officer Trainee classification base salary
shall be as set forth in Exhibit "A" to this Resolution, which is attached hereto
and incorporated by this reference. Such base salary will be equal to eighty
percent (80%) of the Police Officer salary range effective as of October 5, 2024.
2. Effective December 28, 2024, the Police Officer Trainee classification base
salary shall be as set forth in Exhibit "B" to this Resolution, which is attached
hereto and incorporated by this reference. Such base salary will be equal to
eighty percent (80%) of the Police Officer salary range effective as of
December 28, 2024.
SECTION 3: Retirement Plan. The classification of Police Officer Trainee shall participate
in the California Public Employees' Retirement System ("CaIPERS") Miscellaneous
coverage group as follows:
A. Classic Members- 2%@60. This formula shall apply to Police Officer Trainees
hired on or after December 30, 20212 who are otherwise not a "new employee"
and/or "new member" of CaIPERS under Government Code section 7522.04 also

known as the California Public Employees' Pension Reform Act of 2013
("PEPRA"). Employees shall be responsible for paying the statutorily mandated
employee CalPERS contribution.
B. New Members- 2%@62. This formula shall apply to "new employees" and/or "new
members" as defined by PEPRA. Employees shall be responsible for paying the
statutorily mandated employee CalPERS contribution.
C. Attainment of Sworn Status- Upon successful completion of the Police Academy,
the Police Officer Trainee may be appointed to a sworn Police Officer classification
and participate in the CalPERS Safety coverage group with applicable retirement
formula.
SECTION 4: Benefits. Police Officer Trainees shall be offered the following benefits:
A. Health Insurance- Employees shall receive the same monthly medical contribution
offered to members of the POA and shall be eligible to enroll in the same medical
plans offered to POA. For 2024, the City monthly medical contribution is $1,750.
Effective January 1, 2025, the City monthly medical contribution increases to
$1,800.
B. Optical, Dental and Life Insurance- Employees shall receive the same monthly
medical contribution offered to members of the POA. The City's monthly
contribution shall not exceed $184.25. Premiums shall be paid in the following
order of precedence: Optical, Life, and Dental insurance.
C. Other Benefits- Employees are eligible to enroll in the City's Flexible Spending
Account, Dependent Care Account, Deferred Compensation, and Long -Term Care
programs. All associated costs or contributions shall be borne by the employee.
SECTION 5: Leave. Police Officer Trainees shall accrue Sick and Vacation Leave as
follows:
A. Sick Leave- Employees shall accrue Sick Leave at the rate of eight (8) hours per
month.
B. Vacation Leave- Employees shall accrue vacation hours per pay period according
to the schedule below based on length of City service. Vacation Leave may only
be taken after successful completion of the Police Academy.

SECTION 6: Repeal. All resolutions and other actions of the City Council in conflict with
the contents of this Resolution are hereby repealed.
SECTION 7: Signature Authority. The Mayor, or presiding officer, is hereby authorized to
affix his signature to this Resolution signifying its adoption by the City Council of the City
of El Segundo, and the City Clerk, or her duly appointed deputy, is directed to attest
thereto.
SECTION 8: City Clerk Direction. The City Clerk is directed to certify the adoption of this
Resolution; record this Resolution in the book of the City's original resolutions and make
a minute of this adoption of the Resolution in the City Council's records and the minutes
of this meeting.
SECTION 9: Effective Date. This Resolution will become effective immediately and will
remain effective unless repealed or superseded.
