CONTRACT 6318B AmendmentAgreement No. 6318B SECOND AMENDMENT TO AGREEMENT NO. 6318 BETWEEN THE CITY OF EL SEGUNDO AND NINYO & MOORE GEOTECHNICAL & ENVIRONMENTAL SCIENCES CONSULTANTS THIS SECOND AMENDMENT ("Amendment") to Agreement No. 6318 ("Agreement") is made and entered into this 20th day of June 2024, by and between the CITY OF EL SEGUNDO, a general law city and municipal corporation existing under the laws of California ("CITY"), and NINYO & MOORE GEOTECHNICAL & ENVIRONMENTAL SCIENCES CONSULTANTS, a CALIFORNIA CORPORATION ("CONSULTANT"). The parties agree as follows: Pursuant to Section 34 of the Agreement, the Exhibit A Schedule of Fees is modified to in its entirety and replace with the updated Schedule of Fees set forth in Attachment 1 to this Amendment which is incorporated by reference. 2. Pursuant to Section 34 of the Agreement, the term in Section 8 is modified to extend through June 30, 2025. 3. This Amendment may be executed in any number or counterparts, each of which will be an original, but all of which together constitutes one instrument executed on the same date. In accordance with Government Code §16.5, the parties agree that this Amendment will be considered signed when the signature of a party is delivered by electronic transmission. Such electronic signature will be treated in all respects as having the same effect as an original signature. CONSULTANT warrants that its signatory (or signatories, as applicable) to this Amendment has the legal authority to enter this Amendment and bind CONSULTANT accordingly. 4. Except as modified by this Amendment, all other terms and conditions of the Agreement remain the same. Our field services, are charged at a 4-hour minimum, and 8-hour minimum for hours exceeding 4 hours. Overtime rates at 1.5 times the regular rates will be charged for work performed in excess of 8 hours in one day Monday through Friday and all day on Saturday. Rates at twice the regular rates will be charged for all work in excess of 12 hours in one day, all day Sunday and on holidays. Field services that may be subject to prevailing wage in accordance with AB 1768 and Prevailing Wage Determinations, will be subject to a prevailing wage surcharge as shown in our Schedule of Fees. Our rates will be adjusted in conjunction with the increase in the Prevailing Wage Determination during the life of the project, as applicable.
