Downtown Outdoor Dining
Study Session
Eligibility
• Restaurants and retailers with property owner approval
• On streets with speed limits of 25 mph or lower, which include a dedicated on -
street parking lane
• Sidewalk Dining is permitted where through access and path of travel may be
maintained along the right-of-way
• Signed petition by 100% of adjacent property owners/business owners located
within 100' on the same side of the street

Process
1. Applicant review guidelines and permit process — set up meeting with staff
2. Applicant submit the completed application form and necessary exhibits &
pay application fee
3. Staff from various departments review the application: 2-4 weeks
4. If approved, submit additional information: insurance, active business
license, annual license fee, license agreement, etc.
5. Pay any remaining fees
6. Permit approved and issued, with annual renewal

Design
• Aesthetics: Compliance with Downtown Specific Plan Building Development
Standards
• Main St. District, Richmond Street District, Grand Avenue District, and Civic Center District. All outdoor dining enhancements,
materials, and design must be consistent with the applicable Building Development Standards and Supplemental Area -Wide Standards
and Guideline.
• Parklet Size: Maximum of three adjacent parking spaces or up to the length of a
business frontage (whichever is less)
• Sidewalk Dining Size: Maximum of the length of a business frontage.
• May not interfere with utilities, preservation of historic buildings, landmarks, public art, etc. or be located within blue,green, red, yellow, or white -painted
curbs
• Parking: Allowance

Legal
• City does not own the ROW in fee and so it cannot grant
outdoor dining applicants exclusive use of the area - it will have
to be shared with patrons and non -patrons. This may also
affect applicant's ability to get ABC alcohol permits.
• ABC relaxation of outdoor dining alcohol permits expires
7/1 /26; This may reduce number of applicants for outdoor
dining if permanent provisions are not adopted.
