CONTRACT 1276 OtherAGREEMENT THIS AGREEMENT, made and entered into this 13th day of January , 1969 , by and between the City of El Segundo, Cal if- ornia, a municipal corporation, hereinafter referred to as "City," and Standard Oil Company of California Western Operations, Inc., a corporation, hereinafter referred to as "Standard." RECITALS WHEREAS, City contemplates the extension of a main water line in Rosecrans Avenue from a point approximately 550 feet west of Sepulveda Boulevard to a point approximately 929 feet west of Sepulveda Boulevard, at a cost estimated to be $6,588.11, and a service pipe to Standard, at a cost estimated to be $1,085.00, for a total cost of $7,673.11; and WHEREAS, said line has a capacity of approximately 12,000 gallons per minute, of which 7,500 gallons per minute will provide additional capacity to Standard's new modernization program; and WHEREAS, City is under no legal obligation to construct this parti- cular line in the manner requested by Standard, but is willing to construct said line in such manner by reason of Standard's promise contained in this agreement; and WHEREAS, the extension and service pipe provided for Standard will cost the City an estimated $7,673.11. alignment: NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1 . City agrees to construct main water line along the following BEGINNING at the intersection of the centerline of Rosecrans Avenue and the centerline of Aviation Boulevard as shown on map of Record of Survey in Book 77 Pages 51 and 52 on file in the office of the -I- alignment: County Recorder, Los Angeles County, State of Calif- ornia; THENCE N 89' 57' 34" W 1, 334.37 feet along the centerline of said Rosecrans Avenue (40.00 feet wide) to a point; THENCE N 00 00' 04" W 36.00 feet along a line parallel to and 7.00 feet easterly of the centerline of Douglas Street (78.00 feet wide) to a point; THENCE N 890 57' 34" W 3,700.00 feet along a line parallel to and 36.00 feet northerly of the centerline of Rosecrans Avenue to a point; THENCE S 45' 02' 26" W 29.70 feet to a point in a line parallel to and 15.00 feet northerly of the centerline of Rosecrans Avenue; THENCE N 890 57' 34" W 476.37 feet along said parallel line to a point of tangency with a curve, concave to the north; THENCE northwesterly along said curve with cen- tral angle of 70 38' 55" and a radius of 1,485.00 feet, an arc length of 198.24 feet to a point; THENCE N 820 18' 39" W 100.00 feet to a point of tangency with a curve, concave to the south; THENCE westerly along said curve, with a central angle of 2° 05' 03" and radius of 1,515.00 feet, an arc length of 55.11 feet more or less to the TRUE POINT OF BEGINNING; said true point of beginning lying in the northerly prolongation of the centerline of Elm Avenue (40.00 feet wide, in the City of Manhattan Beach) as shown on map of Tract No. 1638, Map Book 21, Pages 46 and 47 on file in the office of the County Recorder, Los Angeles County, State of California, and 46.90 feet more or less northerly of the centerline of Rosecrans Avenue (40.00 feet wide); THENCE westerly along said last mentioned curve with an additional central angle of 50 33' 52" and radius of 1,515.00 feet, an arc length of 147.14 feet to a point in a line parallel to and 57.00 feet northerly of the center- line of Rosecrans Avenue (40.00 feet wide); THENCE westerly along said parallel I ine 176.35 feet to the ter- minating point, said point lying 50.39 feet westerly of the northerly prolongation of the centerline of Pine Avenue (40.00 feet wide, in the City of Manhattan Beach) as shown on Map of Tract No. 1638, Map Book 21 Pages 46 and 47 on file in the office of the said County Recorder, and 57.00 feet northerly of the centerline of said Rose- crans Avenue. Total length of said line: 378.60 feet. 2. City agrees to construct service water line along the following BEGINNING at a point in a line parallel to and 20.00 feet westerly of the northerly prolongation of the center- line of said Pine Avenue and also lying 57.00 feet nor- therly of the centerline of said Rosecrans Avenue (40.00 feet wide); THENCE northerly along said parallel line -2- 35.00 feet more or less to the terminating point; said terminating point lying 20.00 feet westerly of the northerly prolongation of the centerline of said Pine Avenue and 92.00 feet northerly of the centerline of said Rosecrans Avenue. 3. Standard agrees to pay the City the sum of $7,673:11, plus the costs of construction staking and inspection, prior to the completion of the con- struction contemplated by this agreement or by February 1, 1969, whichever occurs first. City will render invoices to Standard covering this contemplated extension and service pipe, detailing final actual costs incurred. 4. City agrees to purchase the excess capacity in the line of 4,500 gallons per minute for $2,475.00 whenever the City provides water service to a customer other than Standard from the said line, or extends the said line as a portion of a loop system along the perimeter of Standard's refinery. The purchase amount of $2,475.00 will be reduced for depreciation over a fifteen -year period as follows: First year $2,475.00 Second year $2,310.00 Third year $2,145.00 Fourth year $1, 980.00 Fifth year $1,815.00 Sixth year $1,650.00 Seventh year $1,485.00 Eighth year $1,320.00 Ninth year $1,155.00 Tenth year $ 990.00 Eleventh year $ 825.00 Twelfth year $ 660.00 Thirteenth year $ 495.00 -3- Fourteenth year $ 330.00 Fifteenth year $ 165.00 Sixteenth year $ 0.00 IN WITNESS WHEREOF, the parties hereto set their hand.
