AGREEMENT FOR AN IN-SERVICE FIREFIGHTER TRAINING PROGRAM WITH THE CITY OF
EL SEGUNDO FIRE DEPARTMENT
THIS AGREEMENT is made and entered into this 3rd day of January, 2023;
by and between CITY OF EL SEGUNDO (hereafter "Department")
and EL CAMINO COMMUNITY COLLEGE DISTRICT
(hereafter "District")
RECITALS:
WHEREAS, the Department desires to provide in-service firefighter training to
firefighters through the District's Fire and Emergency Technology Division; and
WHEREAS, the Department's training program meets all requirements of the law of
the State of California, California Education Code (CEC), Title 5 Code of California
Regulations (CCR T5), and other applicable requirements, regulations, and statutes; and
WHEREAS, the District intends to claim full-time equivalent students (FTES) and
receive State apportionment for the courses provided through this agreement, the
Department's activities under this agreement are subject to these requirements and
monitoring as may be directed; and
WHEREAS, on January 4, 2016, the California Community Colleges Chancellor's
Office (CCCCO) provided revised Instructional Services Agreement Guidelines for
Community College Districts and Public Agencies (Exhibit A), these "ISA Guidelines" are
herein adopted, applied, and noted with reference to the applicable ISA Guideline; and
WHEREAS, the District desires to furnish unit credits to any person who has been
admitted to the college, has met applicable prerequisites, and has completed the in-service
fire training courses to the satisfaction of instructors [ISA Guideline 5.a.]; and

WHEREAS, the Department will be providing much of the training and coordination
in the program, the Department may be entitled to a portion of State funding received by
the District for students enrolled in the District courses of instruction, provided and
contingent upon both the District and the Department meeting all regulations and
requirements pertaining to, and maintaining eligibility for, and the District having received,
State funding for such courses as provided in accordance with this agreement.
NOW, THEREFORE the parties hereto agree as follows:
1. TERM: The term of this Agreement shall commence on ianuary 3. 2023
and continue until December 31, 2023, with four (4) optional one-year renewal
periods [ISA Guideline 2.c.]. Optional one-year renewals will be considered
automatic unless alteration or termination is requested by either party.
2. DESCRIPTION OF SERVICES AND RESPONSIBILITIES: District and Department
agree to provide services as described herein below. The responsibilities of the
parties follow [ISA Guidelines 2.a.]:
A. Responsibilities of District:
(1) The District shall determine whether or not the herein proposed
vocational training program is justified [ISA Guidelines 1.] [CEC
§78015].
(2) Secure and maintain a written agreement/contract with the
Department which stipulates the responsibilities of each party [ISA
Guideline 2].
(3) Conduct, through the Department's approved in-service firefighter
training, courses under its Fire and Emergency Technology program.
a. Although these programs may be operated on -site by the
Department, the District is responsible for the educational
program and/or content of the courses [ISA Guidelines 2.a.].

agreement/contract is under the immediate supervision
and control of an employee of the District (T5, § 58058)
who has met the minimum qualifications for instruction
in Fire Technology in a California community college
(Exhibit B).
ii. District shall provide that minimum qualifications for
instructors providing instruction under this agreement
are consistent with requirements for other District
instructors similarly situated/assigned. [ISA Guideline
4.]
iii. Where the instructor is not a paid employee of the
District, the District shall maintain an additional
agreement/contract with each instructor requiring
FTES to be reported by the instructor and state that the
District has the primary right to control and direct the
instructional activities of the instructor. [ISA Guidelines
3.a.]
b. Direct, provide procedures, terms and conditions, and make
determinations relating to: [ISA Guidelines 2.b.]
i. Enrollment periods;
ii. Student enrollment fees;
iii. Number of class hours sufficient to meet stated
performance objectives;
iv. Supervision and evaluation of students; and
V. Withdrawal of students prior to completion of a course
or program.
C. Ensure compliance with all appropriate Title V and Education
Code requirements to ensure these courses are completely

eligible for State apportionment.
i. The District shall certify that it does not receive full
compensation for the direct education costs of the
course(s) from any public or private agency, individual
or group. [ISA Guideline 11.]
ii. Obtain certification from the Department verifying that
the instructional activity to be conducted will not be
funded by other sources. [ISA Guideline 12.]
iii. If courses will be located outside the boundaries of the
District, the District comply with T5 (§55300 et seq.)
concerning approval by adjoining high school or
community college districts and use of non -district
facilities. [ISA Guideline 13.]
d. Provide a coordinator and/or appoint designated Department
staff as District instructors [ISA Guidelines 3.], who:
i. Are under the immediate supervision and control of an
employee of the District.
ii. Have met the minimum qualifications for instruction in
the discipline of the course in a California community
college.
iii. Provide supervision and control necessary for the
protection of the health and safety of students.
iv. May not have any other assigned duty during the
instructional activity. As a general rule, faculty must be
physically present in the classroom or lab or within
line -of -sight of the students.
V. Will complete and provide daily attendance rosters
(primary attendance accounting documents) which are

properly signed and dated attesting to the truth and
accuracy of the students in attendance at each course
meeting.
(4) Demonstrate direction and control through such actions as providing
instructors with: orientations, manuals, course outlines, curriculum
materials, testing and grading procedures, and any other materials
and services it would provide to its hourly on -campus instructors.

(5) Give appropriate units of credit for successful completion of each
course of instruction.
(6) Perform other support services as required or appropriate to
adequately manage and control its course offerings.
a. In accordance with open enrollment policies (T5, §51006,
§55005), The District shall publish in the college catalog,
schedule of classes, and any addenda to the schedule of classes:
open enrollment policy, grade or credit options, transferability,
and course description within the time frames provided. [ISA
Guideline 5.b.]
b. Course outlines of record for these courses of instruction will
not list as a prerequisite public safety employment or
possession of a basic course diploma. Appropriate health and
safety prerequisites and/or enrollment limitations can include
the requirement to pass a California Department of Justice Live
Scan, as well as additional requirements established at the
local level, so long as they do not violate the law, T5, or this
directive (Cal. Code Regs., T5 §§55003, 58051(c)-(g) and
58106; Pen. Code §832.3(c)). [ISA Guideline 5.c]

C. Course outlines of record for these courses of instruction will
include a sufficiently detailed list of prerequisites that are
directly related to content of the advanced course, so that all
prospective students can be assessed for enrollment eligibility,
and shall only be put in place as provided by T5, §55003.
Prerequisites shall not be established or construed so as to
prevent academically qualified persons who are not employed
by public safety agencies from enrolling in and attending
courses (Cal. Code Regs., T5 §§55003, 58051(c)-(g) and
58106; Pen. Code §832.3(c)). [ISA Guideline 5.d]
d. A student may request an evaluation of his/her previous
experience and coursework to determine if it is equivalent to
the listed requirements. If it is determined that a student does
not meet the prerequisite requirements pursuant to T5
§55003(o), the student may challenge the prerequisites
through the college's prerequisite challenge process pursuant
to T5 §55003(p). The college shall maintain documentation
that demonstrates that its processes for assessing student
eligibility for enrollment were followed. [ISA Guideline 5.e]
College publications, including course outline of record and
syllabi, shall inform students regarding the method by which
they can seek an evaluation for equivalent enrollment
eligibility for advanced public safety courses, and shall include
a notification advising advanced public safety course students
that approval of equivalent enrollment eligibility is not a
guarantee that state regulatory and licensing authorities will
also grant equivalency for licensure or employment purposes.

Degree and certificate programs must have been approved by

the State Chancellor's Office and courses that make up the
programs must be part of the approved programs, or the
District must have received delegated authority to separately
approve those courses locally. [ISA Guideline 6.]
g. The District shall specify through attachment or addendum to
this agreement all courses conducted under this agreement
(cooperative arrangement), and provide corresponding
outlines of record with documentation that each has been
approved by the District's Curriculum Committee, is consistent
with T5 course standards, and has been approved by the
District's Board of Trustees. [ISA Guidelines 7.]
B. Responsibilities of Department:
(1) Furnish facilities and instructional services at the Department for the
conduct of in-service firefighter training courses in accordance with
District, CCR T5, CEC, and applicable rules and regulations.
a. Instructional activities must be conducted at facilities, which
are clearly identified as being open to the general public.
Notwithstanding that students may be required to meet course
or program prerequisites, enrollment in the course(s) under
this agreement must be open to any person who has been
admitted to the college and has met any applicable
prerequisites. [ISA Guidelines 5.a.]
(2) Provide qualified instructors, each who:
a. Have provided documents to the District certifying that they
meet minimum qualifications as previously defined.
b. Where the instructor is not a paid employee of the District, the
instructor has received, signed, and submitted to the District, a
written agreement with the District attesting to their

understanding that the District has primary right to control
and direct instructional activities of the instructor, that they
have attended a District sponsored instructor orientation,
received a training manual, and agree to District time tables
and reporting requirements. [ISA Guidelines 3.a.]
C. Attend District sponsored instructor orientations as required
to remain knowledgeable and current on instructor's
requirements, manuals, course outlines, curriculum materials,
testing and grading procedures, reporting timetables, and
other policies, materials, and services similar to those provided
to other District hourly on -campus instructors. [ISA Guidelines
3.b.]
(3) Supervise and evaluate students, lecturers, equipment, materials,
day-to-day management support, and all related overhead necessary
to conduct the program consistent with District. [ISA Guidelines
2.b.1-5.]
(4) Department shall be responsible for grading students and for taking
appropriate action regarding academic performance, in accordance
with both District and Department policies. [ISA Guidelines 2.b.5.].
a. Department shall maintain daily attendance records which
include daily student contact hours qualified under this
Agreement, and student performance records in accordance
with District requirements and will submit such records with
regard to form and applicable time -schedules as required by
the District.
1. Each primary attendance accounting document shall be
properly signed and dated by the instructor attesting to
the truth and accuracy of the students in attendance at
each course meeting.

b. Department shall submit records both physically and/or
electronically to the District in accordance with District
time -schedules and requirements.
2. The Department shall provide written notice within
three (3) days regarding any student who withdrawals,
drops from, or ceases to attend any course prior to the
course completion date. [ISA Guideline 2.b.5.]
3. As audits significantly impact State apportionment, the
Department shall provide unfettered access to
attendance, grade, and student records as required for
audit and accreditation purposes. [ISA Guideline 9.]
4. Department will observe District open enrollment
policies, lead times, and time -schedules as specified by
District. [ISA Guideline 5.b.]
C. Automation efforts are underway, Department will cooperate
with these efforts and provide and enter data electronically as
technology becomes available.
(5) Cooperate with District to ensure that all instructional personnel,
equipment, and materials used in this program conform to all
requirements governing instructional programs for firefighters.
(6) Provide certification to the District that the educational activity
covered under agreement will not be fully funded by other sources.

C. Responsibilities of both District and Department:
(1) Permanent records of student attendance, grades, and achievement
will be maintained by the Department and the District. Records
maintained by the Department will be open for review at all times by
District and community college officials and auditors. Copies of

permanent records shall be submitted to the District, on a schedule
developed by the District. [ISA Guidelines 9.]
(2) Instruction provided under this agreement shall be provided in such a
manner that courses delivered remain consistent with the
District -approved outline of record for that course.
Faculty/instructors covered under this agreement and students are
held to a comparable level of rigor to all courses offered at the District.
[ISA Guideline 8.]
(3) It is agreed that both the District and the City will ensure that
ancillary and support services are provided for students (e.g.,
counseling, guidance, placement assistance, assessment tutoring, etc.).

3. ADMINISTRATION: The Chief Deena Lee, or authorized designee (hereafter jointly
referred to as "Chief'), shall have the authority to administer this Agreement on
behalf of the Department. The District shall designate, in writing, a person who shall
have the authority to administer this Agreement on behalf of District.
4. PAYMENT FOR SERVICES: District shall reimburse the Department for services and
materials to be supplied hereunder at a rate of two dollars and fifty cents per
student contact hour provided and contingent upon both the District and the
Department meeting all regulations and requirements pertaining to, and
maintaining eligibility for, and the District having received, State funding for such
courses as provided in accordance with this agreement.
A. Department will supply appropriate invoices at the end of each semester for
all student contact hours qualified under this Agreement.
(1) Each invoice will include the Chiefs signature and date attesting to
the truth and accuracy of both the invoice and the supporting primary
attendance accounting documents upon which the invoice is based.

(2) Invoices shall be mailed to District address contained in Section 15
herein.
(3) The maximum amount of contract hours which may be invoiced is
ninety (90) hours.
B. Payments made under this agreement are based upon an assumption that
State funding (apportionment) will be received. These payments are subject
to reversal and collection pending subsequent verification and determination
made by the California Community Colleges and other appropriate state
agencies.
(1) District shall make (advance) payment within (30) days following
timely submission of grades, attendance records for registered
students, and delivery of invoices from Department. These payments
are contingent upon the District having received State allocation funds
for the services rendered under this agreement.
C. Students may be charged by the Department directly for the cost of textbooks
and materials which students retain in their possession.
5. RECORDS AND AUDITS:
A. Educational Records: The Department and District shall maintain accurate
and complete records which shall include a record of educational services
provided in sufficient detail to permit an evaluation of services in accordance
with Education Code provisions. Such records shall be open to the respective
inspection and audit by authorized professional staff of the District,
Department, and other State Agencies where such inspection and audit does
not conflict with the Pupil Record Act of the Education Code.
B. Financial Records: District and Department shall maintain accurate and
complete financial records of its activities and operations as they relate to
services provided under this Agreement. All such records shall include

supporting documentation and other information sufficient to fully and
accurately reflect District's and City's provision of services hereunder. All
such records shall be retained by District and the Department for a minimum
period of five (5) years following the expiration or termination of this
Agreement. All such records shall be open to inspection and audit at
reasonable times by an authorized representative of District. Any audit of
District records conducted by Department staff shall include an exit
conference with District, if requested by District.
6. REPORTS: The District shall make written reports as required by the Coordinator,
concerning the Department's activities as they affect the contract duties and
purposes contained herein. In no event, however, may Coordinator require such
reports unless it has provided District with at least thirty (30) days prior written
notification thereof. The Department shall provide District with a written
explanation of the procedures for reporting the required information.
7. INDEMNIFICATION: The District agrees to indemnify, defend, and hold harmless
the Department, elected officials, appointed officers, employees, and agents of the
Department from and against any and all liability, expense, including without
limitation, defense costs and legal fees, arising from or connected with any claims
for damages or workers' compensation benefits resulting from the District's
operations or its services provided under this Agreement, including without
limitation, bodily injury, death, personal injury, or property damage to any property,
including physical damage to or loss of the District's property or any property in the
care, custody or control of the District.
The Department indemnifies, defends, and holds harmless the District, its
elected officials, appointed officers, and employees, from and against any and all
liability, expense, including defense costs and reasonable legal fees, and claims for
damages of any nature whatsoever, including without limitation, bodily injury,
death, personal injury, or property damage, arising from or connected with the
Department's sole willful acts or sole active negligence.

8. CONFIDENTIALITY: Both parties shall maintain the confidentiality of all student
academic, personal and private records. Both parties agree not to release such data
to any third party without the prior written consent of the student or unless
disclosure is otherwise authorized by law. Each party shall maintain the
confidentiality of its records in accordance with all applicable Federal, State, and
local laws, ordinances, regulations, and directives relating to confidentiality. Both
parties shall inform all of its officers, employees, and agents providing services
hereunder of the confidentiality of such records. Both parties agree to defend and
save harmless the other party, its officers, agents, and employees against any and all
liability and demands arising out of any disclosure of such reports and information
by the other party, its officers, agents, and employees.
9. NON-DISCRIMINATION: It is the policy of the El Camino Community College District
Public Safety Program and the participating affiliate to provide fair and equitable
treatment of all individuals participating in the program without regard to ethnicity,
religion, sexual identity, national origin, ancestry, age, or physical handicap.
We are committed to providing a work and learning environment free of
intimidation, harassment and unlawful discrimination. We share in the
responsibility of providing a harassment -free employment and educational
environment in complying with both federal and state mandates and guidelines
regarding non-discrimination and sexual harassment.
10. DELEGATION AND ASSIGNMENT: Neither party shall delegate its duties or assign
its rights hereunder, or both, either in whole or in part, without the prior written
consent of the other party. Any such delegation or assignment attempted without
such consent shall be null and void.
11. ALTERATION OF TERMS: The body of this Agreement fully expresses all
understandings of the parties concerning all matters covered and shall constitute
the total Agreement. No addition to, or alteration of, the term of this Agreement,
whether by written or verbal understanding of the parties, their officers, agents, or

employees, shall be valid and effective unless made in the form of a written
amendment to this Agreement and formally approved and executed by the parties in
the same manner as this contract form.
12. LICENSES. PERMITS. CERTIFICATES. AND ACCREDITATION: Both parties shall
obtain and maintain in effect during the term of this Agreement, all licenses,
permits, certificates, and accreditation required by law applicable to its
performance of this Agreement, and shall ensure that all their officers, employees,
and agents who perform services hereunder obtain and maintain in effect during the
term of this Agreement, all licenses, permits, certificates, and accreditations
required by law which are applicable to their performance hereunder.
13. SEVERABILITY: If any provisions of this Agreement are or become contrary to State
law or regulations of other agencies or decisions of courts of competent
jurisdictions, District and City, agree to renegotiate these portions without affecting
the balance or intent of this Agreement.
14. AUTHORIZATION WARRANTY: The District hereby represents and warrants that
the person executing this Agreement for the District is an authorized agent who has
actual authority to bind the District to each and every term, condition, and
obligation set forth in this Agreement and that all requirements of the District have
been fulfilled to provide such actual authority.
15. DISTRICT'S OFFICES: The District's business offices are located at El Camino
Community College District; Purchasing and Business Services Office; 16007
Crenshaw Boulevard; Torrance, California 90506. The District shall notify in writing
those City representatives listed in the Paragraph 17 herein below of any change in
its business address at least ten (10) days prior to the effective date thereof.
16. FIRE DEPARTMENT OFFICES: The Fire Department business offices are located at
314 MAIN STREET, EL SEGUNDO, CA 90245. The Department shall notify in writing
those District representatives listed in paragraph 17 of any change in its business

address at least ten (10) days prior to the effective date thereof.
17. NOTICES: Any and all notices required, permitted, or desired to be given hereunder
by one party to the other shall be in writing and shall be delivered to the other party
personally or by United States mail, certified or registered, postage prepaid, return
receipt requested, at the following addresses and to the attention of the persons
named. The Coordinator shall have the authority to issue all notices which are
required, permitted, or desired by Department hereunder. Addresses and persons
to be notified may be changed by either party by giving at least ten (10) days prior
written notice to the other party.
18. TERMINATION: This Agreement may be terminated at any time by the District or
Department within each's sole and exclusive discretion upon thirty (30) days prior
written notice to the other party. Such notice of termination shall not affect
students currently enrolled in the program [ISA Guideline 2.c.].

19. RELATIONSHIP: The relationship of the Department and the District is that of
independent contractor. Neither Party will be considered the agent or employee of
the other. Neither will exercise control or direction over the other while

performing their respective obligations under this Agreement. Neither party
intends to create a partnership or joint venture by entering into this Agreement.
20. ACCEPTANCE OF ELECTRONIC SIGNATURES: In accordance with Government Code
§ 16.5, the parties agree that this Agreement will be considered signed when the
signature of a party is delivered by electronic transmission. Such electronic signature
will be treated in all respects as having the same effect as an original signature.
21. GOVERNING LAW: This Agreement has been made in and will be construed in
accordance with the laws of the State of California and exclusive venue for any
action involving this Agreement will be in Los Angeles County.
22. AUTHORITY/MODIFICATION: The Parties represent and warrant that all necessary
action has been taken by the Parties to authorize the undersigned to execute this
Agreement and to engage in the actions described herein. This Agreement may be
modified by written agreement. The Department manager may execute any such
amendment on behalf of the Department.
23. COUNTERPARTS: This Agreement may be executed in any number or counterparts,
each of which will be an original, but all of which together will constitute one
instrument executed on the same date.

FOR COMMUNITY COLLEGE DISTRICTS AND PUBLIC

2015
Community college districts may claim full-time equivalent students (FTES) and state
apportionment for courses given through instructional service agreements/contracts
provided that California Education Code and title 5 requirements are met. The
regulations are contained in California Education Code sections 78015, 84752 and
California Code of Regulations, title 5, sections 51006, 53410, 55002, 55003, 55005,
55300, 58050, 58051(c)—(g), 58051.5, 58055, 58056, 58058(b), 58102-58106, 58108.
Other regulations and/or statutes may apply.
These guidelines paraphrase applicable sections of Education Code and title 5 and
apply only to programs and/or courses conducted in a cooperative instructional service
arrangement with public agencies. (As indicated in Legal Advisory 04-01.5, although
these guidelines are focused on agreements with public agencies, most of the
requirements apply equally to private training partners.) The following list of required
elements should be used as a guide in the preparation of agreements/contracts.
The governing board of a community college district, prior to establishing a
vocational or occupational training program, shall conduct a job market study of the
labor market area, and determine whether or not the results justify the proposed
vocational education program (Cal. Ed. Code, § 78015).
2. The college or district must have a written agreement/contract with the contractor
stating:
a. the responsibilities of each party, including a notation that although operated on -
site by the contractor, the college or district is responsible for the educational
program and/or course(s),
b. the procedures, terms and conditions relating to:
1) enrollment period,
2) student enrollment fees,
3) the number of class hours sufficient to meet the stated performance
objectives,

4) supervision and evaluation of students,
5) withdrawal of students prior to completion of a course or program, and
c. the terms and conditions relating to cancellation and termination of the
arrangement.
3. The college or district has documentation that instruction claimed for apportionment
under the agreement/contract is under the immediate supervision and control of an
employee of the district (Cal. Code Regs., tit. 5, § 58058) who has met the minimum
qualifications for instruction in the discipline of the course in a California community
college. Instructors need to provide the supervision and control necessary for the
protection of the health and safety of students and may not have any other assigned
duty during the instructional activity. As a general rule, faculty must be physically
present in the classroom or lab or within line -of -sight of the students.
a. Where the instructor is not a paid employee of the district, the college or district
has an additional written agreement/contract with each instructor requiring FTES
to be reported by the instructor and stating that the college or district has the
primary right to control and direct the instructional activities of the instructor.
b. The college or district must demonstrate control and direction through such
actions as providing the instructor an orientation, instructor's manual, course
outlines, curriculum materials, testing and grading procedures, and any other
materials and services it would provide to its hourly on -campus instructors.
4. The college or district lists minimum qualifications for instructors teaching
agreement/ contract courses and instructor qualifications are consistent with
requirements in other similar courses given by the college or district (Cal. Code

5. The course(s) included in the agreement must be held at facilities which are clearly
identified as being open to the general public, noting that students may be required
to meet course or program prerequisites (Cal. Code Regs., tit. 5, § 58051.5).

the college and has met any applicable prerequisites (Cal. Code Regs., tit. 5,

c. Course outlines of record for advanced public safety courses, including in-service
training courses in the areas of police, fire, corrections, and other criminal justice
occupations, will not list as a prerequisite public safety employment, or
possession of a basic course diploma. Appropriate health and safety
prerequisites and/or enrollment limitations can include the requirement to pass a
California Department of Justice Live Scan, as well as additional requirements
established at the local level, so long as they do not violate the law, title 5, or this
directive (Cal. Code Regs., tit. 5, §§ 55003, 58051(c)-(g) and 58106; Pen. Code
§ 832.3(c)).
d. Course outlines of record for advanced public safety courses, including in-service
training courses in public safety areas as described above, should include a
sufficiently detailed list of prerequisites that are directly related to content of the
advanced course, so that all prospective students can be assessed for
enrollment eligibility, and shall only be put in place as provided by title 5, section
55003. Prerequisites shall not be established or construed so as to prevent
academically qualified persons who are not employed by public safety agencies
from enrolling in and attending courses (Cal. Code Regs., tit. 5, §§ 55003,
58051(c)-(g), 58106; Pen. Code § 832.3(c)).
e. A student may request an evaluation of his/her previous experience and
coursework to determine if it is equivalent to the listed requirements. If it is
determined that a student does not meet the prerequisite requirements pursuant
to title 5 section 55003(o), the student may challenge the prerequisites through
the college's prerequisite challenge process pursuant to title 5 section 55003(p).
The college shall maintain documentation that demonstrates that its processes
for assessing student eligibility for enrollment were followed.
f. College publications shall inform students regarding the method by which they
can seek an evaluation for equivalent enrollment eligibility for advanced public
safety courses (Cal. Code Regs., tit. 5, §§ 55003, 58051(c)-(g) and 58106;
Pen. Code § 832.3(c)).
g. College publications, including the course outline of record and course syllabi,
shall include a notification that will advise advanced public safety course students
that approval of equivalent enrollment eligibility is not a guarantee that state
regulatory and licensing authorities will also grant equivalency for licensure or
employment purposes.

6. Degree and certificate programs must have been approved by the California
Community Colleges Chancellor's Office and courses that make up the programs
must be part of the approved programs, or the college must have received delegated
authority to separately approve those courses locally.
7. The agreement/contract or addendum must specify all courses conducted in the
cooperative arrangement and provide corresponding outlines of record with
documentation that each has been approved by the college's curriculum committee,
is consistent with title 5 course standards and has been approved by the district
board of trustees.
8. Procedures are in place by the college to ensure that faculty teaching different
sections of the same course teach in a manner consistent with the approved outline
of record for that course. Faculty covered under the agreement and students are
held to a comparable level of rigor to all courses offered at the college.
9. Permanent records of student attendance, grades and achievement will be
maintained by the public agency or college (as determined appropriate by the
community college district). Records will be open for review at all times by college
officials and submitted on a schedule developed by the community college district.
10. It is agreed that both contractor and community college district will insure that
ancillary and support services are provided for students (e.g. Counseling and
Guidance, Placement Assistance, Assessment Tutoring).
11. The community college district must certify that it does not receive full compensation
for the direct education costs of the course(s) from any public or private agency,
individual, or group.
12. The community college district is responsible for obtaining certification from the
public agency verifying that the instructional activity to be conducted will not be fully
funded by other sources.*
13. If the course(s) will be located outside the boundaries of the district, the district must
comply with the requirements of title 5, sections 55300 et seq., concerning approval
by adjoining high school or community college districts and use of non -district
facilities.

I would like to take a moment and extend my appreciation to you for assuming the role of "In -
Service Agreement" Instructor with El Camino College. The In -Service Fire Training program
cannot exist without your support and participation. This guidebook has been developed to
increase your understanding of the program, and describe your duties and responsibilities.
Your fire department and El Camino College have been partners in the In -Service Fire Training
program for many years, despite a temporary suspension in the program. The College believes
valuable training occurs on a professional basis within the fire service every day, and not all
training and education takes place in a classroom. For this reason, the In -Service Fire Training
program was developed, and the College views this course as a "win -win" for all concerned.
El Camino College has designated a campus coordinator to liaison with your fire department
coordinator. This individual is a seasoned fire service veteran, who understands the inner -
workings and challenges of your industry. You may contact an El Camino College representative

RESPONSIBILITIES OF THE ISA INSTRUCTOR
The responsibilities of the In -Service Agreement (ISA) Instructor are contained in Title 5 of the
California Code of Regulations, sections 51006, 53410, 55002, 55003, 55005, 55300, 58050,
58051(c)-(g), 58051.5, 58055, 58056, 58058 (b), 58102-58106, and 58108. The California
Community College Chancellor's Office has been designated under Title 5 to provide general
direction and oversight to California community colleges which operate ISA programs.
Therefore, while the college is bound to follow the regulations as set forth in Title 5, please be
assured every attempt has been made to ensure your involvement in this program is effective, yet
at the same time make this an easy process to follow. Listed below are your instructional
obligations:
1. Ensure that training time is expended in full compliance with the Course Outline of
Record and course objectives determined by El Camino Community College (hereafter
referred to as the "District"). A copy of the Fire Technology 150 Course Outline is
found in Appendix C.
2. Ensure the safety and well - being of students.
3. Ensure the proper delivery of instruction in accordance with District course outlines
and approved curriculum.
4. Maintain continued physical presence during all class meetings and sessions to deliver
or supervise instruction for each course section; maintain "line of sight" with students
during all instructional activities.
Maintain accurate and current records documenting the physical presence of the ISA
Instructor during all class meetings and sessions.
6. Regularly attend periodic District staff meetings and orientations.

7. Ensure all instructional materials used to teach a course are District -approved and
consistent with the District -approved Course Outline of Record.
8. Ensure accurate and current daily attendance records reflecting attendance by
students when approved instructional activities take place.
9. Sign and submit Positive Attendance Report(s) and grade records on form(s) provided
by the District. Copies of these forms are attached as Appendix G.
10. Ensure the effective use of instructional methods, technology, testing and remediation.
11. Ensure the proper administering and scoring of course tests (if applicable).
12. Ensure the accurate calculation of final student grades (if applicable) and the prompt
submission of grades to your Department Coordinator within five (5) calendar days of
course completion.
13. Ensure compliance with all District policies and administrative procedures while
conducting any training program on or in District facilities.
14. A minimum of twenty-seven (27) hours is required in order to obtain a passing grade
in this course. A student who successfully completes 27 hours or more of instruction
will be awarded a Passing ("P") grade; a student completing less than 27 hours will
receive a No Pass ("NP") grade.
Briefly, you are asked to conduct your training sessions in a professional manner, employing all
appropriate safety measures, while complying with your respective department's training
directives.

Please maintain current training records. This is a California Community College Chancellor's
Office requirement, and the College must follow all directives from the Chancellor's Office.
Furthermore, if a member of your crew is on long-term leave (ex. I.O.D., military, etc.), retired,
or has been transferred to a non -Operational position, inform your Department Coordinator
immediately. The Department Coordinator will notify the College representative, and steps will
be taken to remove the individual from the current class roster. This action greatly assists the
College in keeping up-to-date attendance records.

1. Successful completion of a California State Fire Marshal certified fire academy.
2. Proof of passing the Emergency Medical Technician (EMT) National Registry
Examination.
3. Furnish proof of current negative Tuberculosis (TB) test. Test must be taken within 12
months and valid during class period.
4. Completion of background investigation. Background investigation to be completed prior

Position Description -Instructor
The primary duty of Instructors shall be to teach assigned courses under the supervision
of Divisional Deans. As an art and a learned profession, teaching imposes complex and
diverse obligations which vary both in importance and susceptibility to precise description.
Nonetheless,
Instructors shall not be required to render services inappropriate to their credentials provided that
whenever feasible Instructors shall be assigned to teach courses within their area of professional
training and expertise. They shall, however, attempt to discharge the following responsibilities
at an optimum level of proficiency:
1. To help the students fulfill their maximum potential in mastering course content.
2. To instill in students a respect for excellence and a desire to pursue it.
3. To develop in the student a respect for differing points of view.
4. To maintain a thorough and up —to -date knowledge in the Instructor's regular
teaching field, to plan courses and to revise such plans when appropriate.
5. To maintain a fundamental knowledge of instructional materials and techniques,
and methods of student evaluation.
6. To maintain high standards of professional conduct and ethics appropriate to the
Instructor's professional position.
7. To adapt appropriate methods and materials of teaching to meet the needs of
students, consistent with the maintenance of quality education.
8. To teach courses in general conformity with official course outlines.
9. To provide students with written course objectives, with an explanation of grading
standards, and with periodic opportunities for the students to evaluate their progress
based on these objectives and standards.

Community college districts may claim full-time equivalent students (FTES) and state
apportionment for courses given through instructional service agreements/contracts
provided that California Education Code and title 5 requirements are met. The
regulations are contained in California Education Code sections 78015, 84752 and
California Code of Regulations, title 5, sections 51006, 53410, 55002, 55003, 55005,
55300, 58050, 58051 (c)—(g), 58051.5, 58055, 58056, 58058(b), 58102-58106, 58108.
Other regulations and/or statutes may apply.
These guidelines paraphrase applicable sections of Education Code and title 5 and
apply only to programs and/or courses conducted in a cooperative instructional service
arrangement with public agencies. (As indicated in Legal Advisory 04-01.5, although
these guidelines are focused on agreements with public agencies, most • the
requirements apply equally to private training partners.) The following list of required
elements should be used as a guide in the preparation of agreements/contracts.
The governing board of a community college district, prior to establishing a
vocational or occupational training program, shall conduct a job market study of
labor market area, and determine whether or not the results justify the proposed
vocational education program (Cal. Ed. Code, § 78015).
2. The college or district must have a written agreement/contract with the contractor
stating:

offered for credit and is transferable must be published in the college catalogue,
schedule of classes, and any addenda to the schedule of classes (Cal. Code

c. Course outlines of record for advanced public safety courses, including in-service
training courses in the areas of police, fire, corrections, and other criminal justice
occupations, will not list as a prerequisite •u• safety employment, •

prerequisites and/or enrollment limitations can include the requirement to pass a
California Department of Justice Live Scan, as well as additional requirements
established at the local level, so long as they do not violate the law, title 5, or this
directive (Cal. Code Regs., tit. 5, §§ 55003, 58051 (c)-(g) and 58106; Pen. Code

training courses in public safety areas as described above, should • a
sufficiently detailed list of prerequisites that are directly related to content of the

6. A student may request an evaluation of his/her previous experience and
coursework to determine if it is equivalent to the -• -• If it is
