TERMINATION OF
AFFORDABLE HOUSING AGREEMENT AND COVENANT CONCERNING USE, SALE
AND RESALE OF RESIDENTIAL UNITS
This TERMINATION OF AFFORDABLE HOUSING AGREEMENT AND
COVENANT CONCERNING USE, SALE AND RESALE OF RESIDENTIAL
UNITS ('Termination") is entered into as of the *' day of March, 2020, by and between the
CITY OF EL SEGUNDO, a general law city and municipal corporation ("City"), and D.R.
HORTON CA2, INC., a California corporation ("Developer") (collectively, the "Parties").
RECITALS:
A. - The City and Developer entered into that certain Affordable Housing Agreement and
Covenant Concerning Use, Sale and Resale of Residential Units dated and recorded October 16,
2018 as Document No. 20181 051979 in the Office of the County Recorder of Los Angeles
County, California ("Affordable Housing Agreement").
B. The Affordable Housing Agreement encumbers that certain real property consisting of
approximately 5.65 acres of land area that is located at 540 East Imperial Avenue in the City of El
Segundo, County of Los Angeles, State of California, and that is more particularly described in
Exhibit "A" attached to the Affordable Housing Agreement (the "Property").
C. The Parties now wish to terminate the Affordable Housing Agreement and cause its
removal from record with respect to the Property.
NOW, THEREFORE, in consideration of the foregoing Recitals, which are incorporated into
this Termination by this reference, and the mutual benefits and obligations set forth herein, the Parties
hereby terminate the Affordable Housing Agreement. Upon recordation of this Termination in the
Office of the County Recorder of Los Angeles County, Cal ifornia, the Affordable Housing Agreement
shall be of no further force or effect with respect to the Property and all restrictions upon the Property
set forth therein shall terminate.

certain Condominium Plan for Waypointe recorded March 5, 2018 as Document
No. 20180213492 in the Office of the County Recorder of Los Angeles County, California,
located within Lot 25 of Tract No. 71582, in the City of El Segundo, County of Los Angeles,
State of California, as per Map recorded in Book 1398, at Page 82 through 85, inclusive, of Maps,
