CONTRACT 5871B Amendment CLOSEDAgreement No. 5871 B SECOND AMENDMENT TO AGREEMENT NO.5871 BETWEEN THE CITY OF EL SEGUNDO AND C&J TECHNICAL SOLUTIONS AND SERVICES, INC. ENG 20-14: PARK VISTA SENIOR LIVING CENTER PLUMBING UPGRADE DESIGN THIS SECOND AMENDMENT ("Amendment") is made and entered into this 30th day of March 2022, by and between CITY OF EL SEGUNDO, a general law city and municipal corporation existing under the laws of California ("CITY"), and C&J TECHNICAL SOLUTIONS AND SERVICES, INC. ("CONSULTANT"), a California Corporation. 1. Pursuant to Section 34 of Agreement No. 5871 ("Agreement") subsection C of Section 1 is amended in its entirety to read as follows: "C. As additional consideration, CITY agrees to pay CONSULTANT a sum not to exceed Fifty -Three Thousand Dollars ($53,000) which includes the original contract amount of $25,000 plus expanded scope amount of $28,000 for CONSULTANT's services. Unless otherwise specified by written amendment to this Agreement, CITY will pay this sum as specified in the attached Exhibit "A," which is incorporated by reference." 2. Exhibit "A" as referenced in paragraph 1, above, is amended to include the additional fees and rates for CONSULTANT set forth in Attachment 1 to this Amendment which is incorporated by reference. 3. Pursuant to Agreement Section 34, Exhibit "A," as referenced in Section 2 (Scope of Services), is amended to include the additional services set forth in Attachment 1 to this Amendment which is incorporated by reference. 4. Pursuant to Agreement Section 34, the term of Agreement in Section 8 is extended through June 30, 2023. 5. This Amendment may be executed in any number of counterparts, and all such counterparts so executed constitute one Amendment binding on all the parties notwithstanding that all the parties are not signatories to the same counterpart. In accordance with Government Code § 16.5, the parties agree that this Amendment will be considered signed when the signature of a party is delivered by electronic transmission. Such electronic signature will be treated in all respects as having the same effect as an original signature. 6. Except as modified by this Amendment, all other terms and conditions of the Agreement will remain the same. INTRODUCTION The City of El Segundo, Public Works Department, has contracted with CJTSS to provide a Scope of Work and engineered design drawings for the replacement of an existing 1987 (34-years old) Domestic Cold Water (DCW) and Domestic Hot Water (DHW) piping distribution system and its components. The first physical inspection of the DCW/DHW distribution system and its components was conducted on July 14th, 2021. The inspection included the exposed DCW/DHW distribution system and its components. A limited inspection of piping and fittings above the ceiling was conducted in several typical vacant apartments, where the DCW/DHW piping was accessible. The additional items requiring attention were observed during our survey and a list of recommendations was included in the interim report submitted on September 21, 2021. The additional scope of work requires a second site survey to assess the unknown existing conditions of the DCW, DHW, sanitary waste cast iron piping and confirm the presence of missing natural gas piping, including the 1988 solar heating system. B. Objectives 1. The objective of this second survey is to assess as noted the unknown existing conditions of the following but not limited to DCW, DHW, natural gas piping, sanitary waste cast iron piping and confirm the presence the 1988 solar heating system. The second survey objective is to identify the noted piping systems that will enable the replacement DCW, DHW and sanitary piping project to be removed and replaced with the least amount of interruption and intrusion to the residents daily living and the facility operations. Planning and scheduling of all the required tasks is critical to achieve this objective in an efficient phased manner over several years. The additional field information obtained during the second field survey will permit CJTSS to amend the submitted DRAFT Scope of Work for the replacement of the DCW/DHW systems for the purpose of providing a true perspective of the Park Vista SCC Facility plumbing infrastructure and the development of an accurate Scope of Work assessment for the long-term objective of the project. The noted EMG "Physical Needs Assessment Report" identified the aging issues of the DCW/DHW piping distribution system and rated the system as in "Fair" condition, however the first on -site field inspection, by CJTSS of July 7/14/2021 revealed specific plumbing conditions that were not identified by EMG. The specific concerns to the operability of the Park Vista SCC Facility plumbing systems are the subject of the second field survey and are as follows: a. Dishwasher Locations: High vapor and temperatures occurrences behind dishwasher locations where the gypsum -board drywall and the wood framed wall studding has absorbed these moisture laden vapors over the years and thereby contribute to the copper piping corrosion process. Isoladon Valyg&Balancing Valves: Inspect, where accessible, the existing DCW/HCW Isolation Valves, Balancing Valves as per the DCW/DHW riser single line diagram. There are approximately six (6) known isolation valves to enable a partial or a complete close off the DCW/DHW distribution system. The isolation valve are gate type valves which are, due to their aging, difficult to close or in some cases are "frozen" open. The second field survey will assess the true condition of the existing isolation valves and the six (6) balancing valves. It is to be noted that four additional isolation valves are required for a total of ten (10). It is possible that the 1988 Design Drawings were incomplete, and the four (4) new isolation valves may be present. The second survey will either confirm the valves presence or verify their omission. c. Solar Heating System: An existing partial solar heating system was installed in 1988. The first inspection observed the following: 2-inch DHW active (hot water) piping installed for the 1988 Solar Heating system with 2, 2-inch and 4, 1" pipe risers installed on the outside of the building. The existing water heaters are connected to the two (2) below grade Solar HW storage tanks. Pipe risers are enclosed with sheet metal furring. The type of underground storage tanks material needs to be determined to enable regulatory removal. d. Existing Qp2er Pi in : The copper pipe installed in the individual apartments is copper Type M, color code Red. This piping is the lightest and is thin wall. This type of piping has a reduced life and flow velocities should be kept below 5 feet per second. The continuing use of copper Type M piping is not recommended. It is recommended that the copper piping installed above the corridors and the risers shall be investigated to determine the actual type of copper piping is installed, i.e., Type K (color code Green), Type L (color code Blue) or Type M. e. Natural Gas Piping DHW 11gaters, The 1988 Gas Piping design drawings indicate only a single 2-inch NG pipe was installed for the two (2) roof mounted water heaters. The second Field Survey will verify the NG pipe size and number of risers serving the roof mounted water heaters. Sewer Waste P Ir em: The Park Vista Senior Care Center, sewer waste plumbing waste system has been compromised by Microbiologically Influenced Corrosion (MIC). The Scope of Work for DCW/DHW Replacement Report recommended that a Risk Assessment for MIC be conducted. The second Field Survey will determine the extent of the MIC condition. The proposed inspection tasks include: • Inspect dishwasher locations in six (6) randomly selected apartments. • Inspect and verify -five (5) floors -the existing DCW/DHW isolation valves and existing DHWR balancing valves. • Inspect the existing solar heating system components, ground floor including the ground storage tanks. • Inspect and document the condition, size and location of the copper piping on five (5) floors to determine the type of copper piping installed, e.g., Type K, Type L and Type M. This will require drilling holes in common area ceilings. We will require assistance from the City of El Segundo to repair the penetrations (each approximately 2" diameter). • Inspect and document the condition, size and location of the natural gas piping riser(s) serving the roof mounted water heaters. • Inspect and document the condition, size and location for five (5) floors sanitary waste cast-iron horizontal piping for Microbiologically Influenced Corrosion (MIC). D. Deliverables include: • Revised Assessment Report with detailed recommendations • Revised set of record drawings based on updates from the field survey. • Basis of Design Document for use in RFP Development. E. WORK INCLUDED AS BASIC SERVICES: 1. Site investigation at the beginning of the design phase to review site conditions. 2. Provide updated F. EXCLUSIONS AND CLARIFICATIONS: 1. Additional site visits or client meetings, if required, will be billed at actual cost. 2. Patching and repairs of openings existing walls and ceilings that are required during course of our survey. 3. Patching and repair of existing fire rated assemblies that must be opened to expose utilities during our survey. 4. Fire Alarm and Fire protection system design will be performed by others. 5. Structural engineering (if required) will be provided by others. 6. Plan Check fees, permit applications and permit fees are the responsibility of the CLIENT. 7. Travel expenses for mileage, which shall be billed at the current federal mileage reimbursement rate. 2. Printing shall be billed for building department submittals, re -submittals and coordination sets for Client review with a 10% handling fee. Drawing sets for internal review and coordination are not included. 3. Shipping, if applicable, will be sent via FedEx for standard Next Day delivery and billed with a 10% handling fee. 4. Outside services or Consultants as required and approved in advance with applicable mark up. I. Each invoice is due and payable within forty-five (45) calendar days of the date of the invoice. 2. If any work designed by CJTSS is abandoned or suspended for (90) days, or if this agreement is canceled, CJTSS shall be paid for services rendered to date of cancellation based on the fee schedule above. If suspended work is resumed after (90) days, fees will be renegotiated as necessary. 3. ADDITIONAL SERVICES: For services not included in the Scope of Work or redesign of work already approved, CJTSS will be paid in addition to the fee indicated above and requires prior written authorization from the Client. J. ACCEPTANCE 1. Drawings prepared by CJTSS under this agreement may not be used on other projects or extensions to this project except by agreement in writing with CJTSS with appropriate compensation. 2. Job observations during construction performed by CJTSS are provided to determine if the project is executed in accordance with the construction documents. The Design Professional is not responsible for the Contractor's performance, safety measures or Contractor's errors or omissions. K. TERMS AND CONDITIONS 1. If above stated terms are agreeable, please sign and return one copy of this proposal to our office. If this agreement is not signed and returned and we are asked to proceed with the project, all conditions contained herein shall constitute a contract for services.
