STOP the MONSTEROUS office bldg. and parking structure that is trying to squeeze through the
city planners. A child can understand why it should not be shoved down the throats of El
Segundo residents. It would be S0000 much better tax wise to the city and residents for quiet,
safety and desirability to us the people of El Segundo. It can easily have a zoning variance to the
owners.

Dear Mayor & City Council members:
At the February 15, 2022 City Council Meeting — I presented the `Creation of El Segundo Downtown
Beautification Fund' under the `public comment' section of the meeting. The objective of the `Creation
of El Segundo Downtown Beautification Fund' was fourfold:
1) Raise awareness on the issue of our downtown looking like a `construction zone' with the sea of
orange K-rail temporary barriers along Main St, Grand Ave, Standard St, and Richmond St.
2) Bring forth the disparity between the appearance of El Segundo downtown and that of our
neighboring city (examples: Temporary Outdoor Dining along Manhattan Beach Blvd.; Manhattan
Ave).
3) Enlist the support of the city to dedicate funding to assist in the transformation of our `Temporary
Outdoor Dining' areas to more aesthetically pleasing outdoor dining spaces.
4) Enlist support from many of the city's largest employers to participate in the `beautification' of our
temporary outdoor dining areas — similar to the support provided by Sketchers Founder, Mr. Robert
Greenberg.
At the last City Council meeting, rather than identifying funds or awaiting the donation of funds related to
`temporary outdoor dining', action was taken as follows:
CITY COUNCIL ACTION — re: TEMPORARY OUTDOOR DINING (01-Mar-2022)
City Council, Agenda Item 11. —'Temporary Outdoor Dining Permitted During the Pandemic in
the Public Right of Way in the Downtown Area'. Item read as follows:
1. Receive and file information regarding staff immediately require outdoor dining
improvements to be removed that do not meet building code safety requirements.

Council voted 3-0 to direct staff to proceed to give notices to all businesses with temporary
outdoor dining that don't meet 'building and safety requirements ' to remove those improvements.
Businesses would be afforded time to correct code violations, exception - safety issues that are an
immediate threat to public safety would need to be addressed immediately.
2. Direct staff to cause the immediate removal of all outdoor dining located within travel lanes.
MAIN STREET — Council voted 3-0 — Staff is authorized to notes businesses on Main Street that
have temporary outdoor dining areas that encroaches into travel lanes — that they have thirty
(30) days (or April P) Ito relocate or adjust their outdoor dining footprint such that it is out of
the travel lane.
RICHMOND STREET— Council voted 2-1 — Staff is authorized to notify businesses on Richmond
Street that have temporary outdoor dining areas that encroach into travel lanes — that they have
until August 16`r' to relocate or adjust their outdoor dining footprint such that it is out of the
travel lane.
STANDARD STREET & GRAND AVE. — no action taken as the temporary outdoor dining on
both streets is within the parking space designated areas, except as it pertains to Item 1. 'building
code requirements'.
3. Discuss items 4 and 5 below but direct staff to conduct public outreach and bring these
items back for City Council's further consideration at its May 3, 2022 meeting.
Council voted to take up items 4 & 5 at the May 3, 2022, but did vote 3-0 to proceed on item 5.
4. Establish a date not later than October 31, 2022 for the removal of the remainder of all
temporary outdoor dining improvements that were allowed during the pandemic.
Council discussed the item and decided to set the date at or after the May 3`1 meeting.
5. Direction to proceed with further studies and development of a permanent outdoor dining
program.
Council voted 3-0 to proceed with the study of a permanent outdoor dining program.
Comprised below are `points' to be brought to the City Council's attention at the March 15' City Council
Meeting under `Public Comments':
Point #1 — Residents and employers in the City of El Segundo will greatly benefit by the continued
temporary outdoor dining spaces while the City Council takes up how to proceed with the establishment
of a permitting process for permanent outdoor dining.
Point #2 — Restaurants/Bar owner's losses during the pandemic have been significant, with some not
making it through (example: Brewport closure on New Year's Day). Eliminating any outdoor dining at
this date is not recommended, nor was it the intent behind the `Creation of the El Segundo Downtown
Beautification Fund'. Rather, the reference to the `beautification' of downtown starting with temporary
outdoor dining called for covering the orange k-rail, addressing accessibility barriers to patrons with
mobility challenges; and adorning those spaces with flowers, plants, and potted trees, [solution: plywood,
2 X 4s, 2 X 8s, paint, reflector signage, flowers, potted plants & potted trees].

Point 43 —'Outdoor dining' albeit initially authorized while we were collectively navigating through the
COVID-19 pandemic, is among the most positive outcomes we have come to enjoy, therapeutic in many
respects, as we went from living, working, dining, learning, teaching from our homes to emerging from a
hibernation of sorts — with a desire to be outside, dine outside with family and friends, and enjoy our
amazing weather.
I am proposing that you reconsider the action taken at your March I" City Council meeting — specifically,
Agenda Item 11, 2. Direct staff to cause the immediate removal of all outdoor dining located within
travel lanes, to which you voted 3 — 0 to notify businesses on Main Street to remove the travel lane
encroachments by April 1, 2022.
In lieu of that action, attached you will find a `Temporary Outdoor Dining Standard (Application for
Extension — Beyond April 30, 2022' (Proposed for review by the City's Planning Department & City
Council), to allow time to explore the `Creation of the El Segundo Downtown Beautification Fund' while
simultaneously requiring businesses apply to extend their `Temporary Use and Encroachment Permits'
beyond April 30'.
BENEFITS OF TIME EXTENSION:
Identify `Beautification, Safety & Accessibility' mitigation funds — e.g. General Fund; Chevron's grant
fund (earmarked for economic development); and other donations from businesses — and make available
those same funds to businesses through a reimbursement process for `beautification', 'safety &
accessibility' mitigation improvements to temporary outdoor dining spaces. Administer that
reimbursement process through the tentative date of October 31, 2022, while a path forward to permanent
outdoor dining is tackled by the city.
Thank you Mr. Mayor, City Council, and staff for your leadership these past 24 months during the
pandemic. You have kept us safe; you have made key decisions that have had profoundly positive
impacts on our way life herein beautiful El Segundo. Temporary outdoor dining is one of them —it is
healthy both physically and emotionally and it has played a key role in our pandemic recovery process.
Don't take it away — we aren't ready —just make it safer, more accessible, and more beautiful.

TEMPORARY OUTDOOR DINING STANDARDS
(APPLICATION FOR EXTENSION — BEYOND APRIL 30, 2022)
Businesses that have applied for and have been granted `Temporary Use and Encroachment Permits' by
the City's Planning Department for `Temporary Outdoor Dining' during the COVID-19 pandemic shall
be required to apply for an extension by April 1, 2022, otherwise, the temporary outdoor dining areas
must be removed by May 1, 2022 or within thirty (30) days. Businesses that have `temporary outdoor
dining' areas that do not meet the below requirements, will have thirty (30) days to correct or will be
required to remove the temporary outdoor dining improvements no later than May 15, 2022.
1.0 Exits
■ Outdoor dining areas shall be designed to maintain clear existing legal exits from the building to the
public way.
• A minimum of a 44-inch exit path is required to be maintained from the building and from any enclosed
outdoor dining areas for fifty (50) or more persons.
• Dining areas with an occupancy greater than fifty (50) persons will require 2 exits from that area.
2.0 Accessibility **
• Outdoor dining areas shall meet accessibility requirements.
■ One wheelchair seating space shall be provided for each twenty (20) seats.
• A minimum 36-inch egress aisle shall be maintained adjoining a wheelchair location.
• Wheelchair locations shall provide a minimum clear floor area of 33-inches by 48-inches for front
access or 33-inches by 60—inches for side access.
3.0 Awnings
Awnings providing shelter for outdoor dining areas shall comply with the following:
• Frames supporting awnings shall be of noncombustible materials.
• The cover material of awnings shall be an approved fire -retardant cover for retractable awnings or
noncombustible material for fixed awnings.
■ All portions of any awning shall be a minimum of 8 feet above the public walkway. Complete details
shall be submitted to the Building and Safety Division for approval of the support system and attachments
to the existing building.
4.0 Heaters
• Heating units shall have a UL or AGA listing (if used).
■ Heating units shall not be installed over or near exits from buildings.
• Heating units shall maintain the required clearances from combustible materials.
• A minimum headroom clearance of 6' 8" shall be maintained under the heating unit.
Public Right of Way (Vehicle Travel or drive lanes) — Temporary Use and Encroachment Permits
■ Temporary outdoor dining areas that encroach into `vehicle travel or drive lanes' shall be reviewed on a
case by case basis by the Planning Department to determine whether the increased vehicle traffic coming
out of COVID and encroachment into those vehicle travel or drive lanes presents increased safety
concerns to the dining or traveling public. Parking areas are not considered `vehicle travel or drive
lanes'.
** if a Temporary Use and Encroachment Permit was granted and there was no means to meet
accessibility requirements, the permit will be further evaluated based on that premise.

NOTE to Businesses: The City has tentatively set a date of August 16, 2022 for the removal of all

Dear Mayor & City Council members:
Firstly, I wish to thank the Mayor and City Council for your service to our great city. These past two
years have been challenging in so many ways — in our households — how we gather; in our community —
how our children are taught — and in our downtown — how we shop & dine. You have made key
decisions every step of the way to both ensure our safety (mask & social distancing policies) while
simultaneously extending olive branches to businesses- relaxing the terms of `take out' and authorizing
the creation of outdoor dining spaces in parking spaces & roadways along Main Street, Grand Avenue
and Richmond Street.
Orange `K-Rail' type barriers were provided by El Segundo's Street Department in the Summer of 2020 —
thus, creating temporary outdoor dining spaces. Cities across the country took similar actions in the early
phases of the pandemic, however, in most instances — temporary orange `K-Rail' type barriers were
replaced by more aesthetically pleasing, structurally safe barriers.
This communication is intended to express appreciation, in advance, for the City Council, Planning
Commission, Capital Improvement Program Advisory Committee, Arts and Culture Advisory Committee
and/or Businesses [Refer to APPENDIX A - The Aerospace Corporation, Boeing, Chevron, Los Angeles
Kings, Los Angeles Lakers, Mattel, Northrup Grumman Corporation, Raytheon Company, TopGolf,-
Government Agency - U.S. Air Force Space Command] for identifying resources to create the `El
Segundo Downtown Beautification Fund' or `ES-DBF'.
This `El Segundo Downtown Beautification Fund', a `public -private -partnership' would effectively fund
`Safe -Accessible Beautification Projects' through a `ES-DBF-SABP Reimbursement Process'.
`Eligible Expenses' for reimbursement are as follows:
• CATEGORY 1 - Reimbursement of `Permit Application Fees, Design fees; Construction
materials'- actual expenditures associated exclusively for use in temporary outdoor dining spaces.
CATEGORY 2 -Reimbursement of `Construction Labor Costs' only — actual expenditures paid to
3rd party (CA licensed) contractors under contract for improvements of existing temporary
outdoor dining areas. [INELIGIBLE COSTS - Restaurant/Food/Beverage Service Provider labor
and/or transportation costs associated with a project are not eligible for reimbursement from the
`El Segundo Downtown Beautification Fund.]
• CATEGORY 3- Reimbursement of `Temporary Landscape — e.g. Flowers, Vases, Plants, Soil,
Planters or Pots, Small Potted Trees' - actual expenditures associated exclusively for use in
temporary outdoor dining spaces identified for the specific business.

■ CATEGORY 4 — Reimbursement of `Fixtures, Furnishings & Equipment (FFE) e.g. dining
tables, dining chairs, umbrellas, tents, temporary lighting, heaters' - actual expenditures directly
associated with the improvements to temporary outdoor dining spaces.
Eligible Businesses to participate in the ES-DBF-SABP reimbursement process are as follows:
• Restaurants/Food/Beverage Services Providers — with existing temporary outdoor dining spaces
created as a result of the COVID-19 pandemic within the defined `Boundary MAP' [Refer to
APPENDIX C - El Segundo Downtown Beautification Fund — BOUNDARY MAP'].
In the City of Manhattan Beach, Robert Greenberg, CEO & Founder, Sketchers, provided labor &
materials for the establishment of temporary outdoor dining areas — in front of many of the restaurants in
Manhattan Beach — the result... the creation or maintenance of a quaint downtown.
I am not asking that we replicate Manhattan Beach — I am simply citing that we can do better for our
City's residents and do more to attract the visiting public to our downtown dining and shopping areas.
I, hereby, challenge the City to embrace the concept of the `El Segundo Downtown Beautification Fund'
and immediately implement measures, working with the private sector, such that we can expeditiously
remove from view the sea of orange `construction zone' K-rail barriers and replace with SAFE -
ACCESSIBLE -BEAUTIFICATION -PROJECTS — maintaining barrier structural performance;
replacement barriers or barrier coverings shall be fitted with reflectors to ensure continued high visibility
of lane encroachments to drivers passing by. Raised floor decks (if applicable) shall be incorporated to
ensure accessibility to patrons with mobility challenges; creating attractive outdoor dining spaces adorned
with flowers, plants, and small potted trees.
