2022-03-01 CC Agenda Packet - PRESENTATION - ITEM D14 - Hyperion UpdateHyperion Update Public Works Department March 1, 2022 ELSEGU\DO Proposed Hyperion Air Quality Monitoring Project ➢ Two mobile trailer units will be installed initially on temporary basis ➢ These two units are scheduled to be fully operational by end of April 2022 ➢ Will transfer into three permanent stationary units by end of 2022 ➢ Public will be able to access the information/data online ➢ The units are designed to detect only H2S (Hydrogen Sulfide) emissions Air Quality Information ➢ A total of 42 Notices of Violation (NOV) have been issued by AQMD since July 11, 2022 incident, last NOV was issued in October 17, 2021: ■ Forty NOVs issued for public nuisance (Odors) One NOV issued for exceeding visible emissions rule limits (Smoke) ■ One NOV issued for exceeding emission limits of Nitrogen Oxides (NOx) during the flare testing in September 2021, failed to perform the flare testing which is required once every 5 years ➢ AQMD has taken the following actions against Hyperion regarding air quality: ■ Petitioned the South Coast AQMD Hearing Board to issue an Order for Abatement for exceeding the permitted Nitrogen Oxides (NOX) Emission Rate for Flare Equipment. The hearing date is scheduled for March 9, 2022, at 9 a.m. ■ Ongoing communication with Hyperion for settlement regarding penalties for Smoke and Odor -related NOVs Next Steps ➢ Hyperion Staff to brief the City of Los Angeles Public Works Board regarding the Ad Hoc Advisory Committee recommendations by mid May 2022, and every 6 months thereafter
