Scott Mitnick City Manager From: Allen, Michael <malien @else,qundo.ore> Sent: Tuesday, February 1, 2022 2:17 PM To: Mitnick, Scott <smitnick@elsegundo.org> Subject: SB 9 Past City Actions Scott, In preparation for this evening, I wanted to forward the following highlighted actions the City has taken in response to SB 9. The below, along with tonight's zone text amendment and any continued effort to express our opposition to state legislation such as SB 9 only reinforces the City's existing and communicated stance on maintaining local land use control, a key component to the state's constitutional power awarded to cities. • Adopted the 2021 Legislative Platform; including several legislative priorities related to maintaining local control over land use and planning issues. More specifically, opposing any effort towards "overriding the City's adopted zoning ordinance" and any "legislation that reduces local land -use authority and/or alters local land use zoning designations without approval of local City Council" • September 7, 2021; authored our own letter to Gov. Gavin Newsom opposing SB 9. ■ September 10, 2021; joined/signed the League of California Cities letter to Gov. Gavin Newsom opposing SB 9. ■ January 6, 2022; joined via SCAG to support the Neighborhood Voices/Community Planning(ltem 2) initiative to override state housing laws Tonight's zone text amendment is intended to exercise the land use controls allowed local agencies by creating objective design standards to preserve and protect the character of the RI -Single Family Residential zone. Continued efforts to express or convey the City's opposition to SB 9, or any future state sponsored legislation that thwarts local land use control would be consistent with the City's existing legislative platform and the above actions. Let me know if any additional information is needed.
