ADJOURNMENT: POSTED: DATE: June 25, 2021 BY: Tracy Weaver, City Clerk TIME: 12:00 PM 2 E CITY OF E L S E GU N D O City Council Agenda Statement Meeting Date: June 29, 2021 Agenda Heading: Consent TITLE: Allow Adults over 21 Years of Age to Bring and Consume Alcohol at Library Park on the Days of the Summer Concerts in the Park RECOMMENDATION: Suspend El Segundo Municipal Code Section 7-6-8 to allow adults over 21 years of age to bring and consume alcohol at Library Park on the days of the Summer Concerts in the Park, Sundays, July 11, July 25, August 8, and August 15, 2021 from 3:00 p.m. until 7:00 p.m. FISCAL IMPACT: None BACKGROUND: The City of El Segundo Community Services Department is pleased to bring back Summer Concerts in the Park. • July 11 — Tom Petty/Stevie Nicks Cover Band • July 25 — CJ Simmons (Country) • August 8 — The Reflexx (80's Cover Band) ■ August 15 — Yachty by Nature (70's/80's Yacht Rock) Each of the summer concerts will begin around 4:30 p.m. Bands typically play two 45- minute sets and conclude at approximately 6:30 p.m. Many concert attendees walk to the event from adjacent neighborhoods and families gather early to enjoy games and picnics in the park. El Segundo Municipal Code 7-6-8 states that it is unlawful to drink any alcoholic beverage or possess an open container of any alcoholic beverage upon any public street, alley, sidewalk, pathway, parking lot, park, beach, or other public property. The California Business and Professions Code Section 25620(a) also prohibits the possession of an open container, but the City can take action to enact an exception within the code which states "this section does not apply where the possession is within the premises located in a park or other public place for which a license has been issued." Consumption is allowed under State law if the municipal code is suspended. 1 3 Summer Concerts in the Park June 29, 2021 Page 2of2 The El Segundo City Council voted to suspend the Municipal Code in this way for Summer Concerts in the Park in 2019. The concert series was suspended in 2020 due to the pandemic. City staff will ensure that appropriate liability coverage is in place and proper police personnel are assigned for each of the special events. FISCAL IMPACT: There is no budget impact associated with this item. BACKGROUND: The retirement of a career El Segundo Police Department employee has created a vacancy at the rank of Police Captain requiring a recruitment process to fill. The examination plan for this position was last approved by the City Council on September 19, 2000. A review and revision of the existing examination plan is necessary to create a more appropriate testing process for the Police Captain position. DISCUSSION: The current examination plan has been in existence for more than twenty years and is a "Closed -Promotional" process with the eligible candidates limited to City of El Segundo employees. Revising the examination plan to remove the "Closed -Promotional" process will provide an opportunity for other experienced law enforcement professionals to apply and increase the number of qualified candidates. Additionally, the established testing process consists of two interviews, career preparation and structural technical, weighted at 100%. A revised exam plan consisting of a written examination and an assessment center will allow for a variety of exercises to better assess candidates' leadership and management skills that may not be demonstrated through an oral interview. A process that requires candidates to achieve 70% on each exam element to be placed on the eligibility list will ensure candidates are well qualified in all competencies necessary for success in the position. The City and the El Segundo Police Managers' Association (PMA) have met and conferred regarding the revised Police Captain examination plan and have agreed to present the following to City Council for approval and adoption: Written Examination and Assessment Center- Weighted 100% Candidates must achieve 70% on each exam element to be placed on the eligibility list.
