PROFESSIONAL SERVICES AGREEMENT
FOR DESIGN SERVICES
BETWEEN
THE CITY OF EL SEGUNDO AND
MNS ENGINEERS, INC.
ENG 21-25: ON -CALL LAND SURVEYING SERVICES
This AGREEMENT is entered into this 271h day of May 2021, by and between the CITY
OF EL SEGUNDO, a municipal corporation and general law city ("CITY") and MNS
ENGINEERS, INC., a CORPORATION ("CONSULTANT"). The parties agree as follows:
1. CONSIDERATION,
A. As partial consideration, CONSULTANT agrees to perform the work listed in the
SCOPE OF SERVICES, below;
B. As additional consideration, CONSULTANT and CITY agree to abide by the
terms and conditions contained in this Agreement;
C. As additional consideration, CITY agrees to pay CONSULTANT a sum not to
exceed Fifty Thousand dollars ($50,000) annually in each fiscal year for
CONSULTANT's services. CITY may modify this amount as set forth below.
Unless otherwise specified by written amendment to this Agreement, CITY will
pay this sum as specified in the attached Exhibit "A," which is incorporated by
reference.
2. SCOPE OF SERVICES.
A. CONSULTANT will perform services listed in the attached Exhibit "A," which is
incorporated by reference.
B. CONSULTANT will, in a professional manner, furnish all of the labor, technical,
administrative, professional and other personnel, all supplies and materials,
equipment, printing, vehicles, transportation, office space and facilities, and all
tests, testing and analyses, calculation, and all other means whatsoever, except
as herein otherwise expressly specified to be furnished by CITY, necessary or
proper to perform and complete the work and provide the professional services
required of CONSULTANT by this Agreement.
3. PERFORMANCE STANDARDS. While performing this Agreement, CONSULTANT will use
the appropriate generally accepted professional standards of practice existing at the time of
performance utilized by persons engaged in providing similar services. CITY will continuously
monitor CONSULTANT's services. CITY will notify CONSULTANT of any deficiencies and
CONSULTANT will have fifteen (15) days after such notification to cure any shortcomings to
CITY's satisfaction. Costs associated with curing the deficiencies will be borne by
CONSULTANT.

4. PAYMENTS. For CITY to pay CONSULTANT as specified by this Agreement,
CONSULTANT must submit a detailed invoice to CITY which lists the hours worked and hourly
rates for each personnel category and reimbursable costs (all as set forth in Exhibit "A") the
tasks performed, the percentage of the task completed during the billing period, the cumulative
percentage completed for each task, the total cost of that work during the preceding billing
month and a cumulative cash flow curve showing projected and actual expenditures versus time
to date.
5. NON -APPROPRIATION OF FUNDS. Payments due and payable to CONSULTANT for
current services are within the current budget and within an available, unexhausted and
unencumbered appropriation of the CITY. In the event the CITY has not appropriated sufficient
funds for payment of CONSULTANT services beyond the current fiscal year, this Agreement will
cover only those costs incurred up to the conclusion of the current fiscal year.
6. ADDITIONAL WORK. N/A.
7. FAMILIARITY WITH WORK. By executing this Agreement, CONSULTANT agrees that it
has:
A. Carefully investigated and considered the scope of services to be performed;
B. Carefully considered how the services should be performed; and
C. Understands the facilities, difficulties, and restrictions attending performance of
the services under this Agreement.
If services involve work upon any site, CONSULTANT agrees that CONSULTANT has or will
investigate the site and is or will be fully acquainted with the conditions there existing, before
commencing the services hereunder. Should CONSULTANT discover any latent or unknown
conditions that may materially affect the performance of the services, CONSULTANT will
immediately inform CITY of such fact and will not proceed except at CONSULTANT's own risk
until written instructions are received from CITY.
8. TERM. The term of this Agreement will be from July 1, 2021 to June 30, 2024 unless
otherwise terminated pursuant to Section 15.
9. TIME FOR PERFORMANCE,
A. CONSULTANT will not perform any work under this Agreement until;
CONSULTANT furnishes proof of insurance as required under Section 23
of this Agreement; and
CITY gives CONSULTANT a written notice to proceed.
B, Should CONSULTANT begin work on any phase in advance of receiving written
authorization to proceed, any such professional services are at CONSULTANT's
own risk.
10. CONSISTENCY. In interpreting this Agreement and resolving any ambiguities, the main
body of this Agreement takes precedence over the attached Exhibits; this Agreement
supersedes any conflicting provisions. Any inconsistency between the Exhibits will be resolved
in the order in which the Exhibits appear below:

A. Exhibit A: Scope of Work and Fee Proposal
11. CHANGES. CITY may order changes in the services within the general scope of this
Agreement, consisting of additions, deletions, or other revisions, and the contract sum and the
contract time will be adjusted accordingly. All such changes must be authorized in writing,
executed by CONSULTANT and CITY. The cost or credit to CITY resulting from changes in the
services will be determined in accordance with written agreement between the parties.
12. TAXPAYER IDENTIFICATION NUMBER. CONSULTANT will provide CITY with a
Taxpayer Identification Number.
13. PERMITS AND LICENSES. CONSULTANT, at its sole expense, will obtain and maintain
during the term of this Agreement, all necessary permits, licenses, and certificates that may be
required in connection with the performance of services under this Agreement.
14. WAIVER. CITY's review or acceptance of, or payment for, work product prepared by
CONSULTANT under this Agreement will not be construed to operate as a waiver of any rights
CITY may have under this Agreement or of any cause of action arising from CONSULTANT's
performance. A waiver by CITY of any breach of any term, covenant, or condition contained in
this Agreement will not be deemed to be a waiver of any subsequent breach of the same or any
other term, covenant, or condition contained in this Agreement, whether of the same or different
character.
15. TERMINATION.
A. Except as otherwise provided, CITY may terminate this Agreement at any time
with or without cause.
B. CONSULTANT may terminate this Agreement at any time upon thirty days'
written notice.
C. Upon receiving a termination notice, CONSULTANT will immediately cease
performance under this Agreement unless otherwise provided in the termination
notice. Except as otherwise provided in the termination notice, any additional
work performed by CONSULTANT after receiving a termination notice will be
performed at CONSULTANT's own cost; CITY will not be obligated to
compensate CONSULTANT for such work.
D. Should termination occur, all finished or unfinished documents, data, studies,
surveys, drawings, maps, reports and other materials prepared by
CONSULTANT will, at CITY's option, become CITY's property, and
CONSULTANT will receive just and equitable compensation for any work
satisfactorily completed up to the effective date of notice of termination, not to
exceed the total costs under Section 1(C).
E. Should the Agreement be terminated pursuant to this Section, CITY may procure
on its own terms services similar to those terminated.
F. By executing this document, CONSULTANT waives any and all claims for
damages that might otherwise arise from CITY's termination under this Section.

16. OWNERSHIP OF DOCUMENTS. All documents, data, studies, drawings, maps, models,
photographs and reports prepared by CONSULTANT under this Agreement are CITY's
property. CONSULTANT may retain copies of said documents and materials as desired but will
deliver all original materials to CITY upon CITY's written notice. CITY agrees that use of
CONSULTANT's completed work product, for purposes other than identified in this Agreement,
or use of incomplete work product, is at CITY's own risk.
17. PUBLICATION OF DOCUMENTS. Except as necessary for performance of service under
this Agreement, no copies, sketches, or graphs of materials, including graphic art work,
prepared pursuant to this Agreement, will be released by CONSULTANT to any other person or
public CITY without CITY's prior written approval. All press releases, including graphic display
information to be published in newspapers or magazines, will be approved and distributed solely
by CITY, unless otherwise provided by written agreement between the parties.
18. INDEMNIFICATION. This Agreement contemplates that CONSULTANT will act both as a
design professional (as defined by Civil Code § 2782.8) and for other management services.
Accordingly, CONSULTANT agrees to provide indemnification as follows:
A. CONSULTANT must save harmless, indemnify and defend CITY and all its
officers, employees and representatives from and against any and all suits,
actions, or claims, of any character whatever, brought for, or on account of,
any injuries or damages sustained by any person or property arising from,
pertaining to, or relating to the negligence, recklessness, or willful
misconduct of CONSULTANT or any of CONSULTANT's officers, agents,
employees, or representatives. CONSULTANT's duty to defend consists of
reimbursement of defense costs incurred by CITY in direct proportion to the
CONSULTANT's proportionate percentage of fault. CONSULTANT's percentage
of fault will be determined, as applicable, by a court of law, jury or arbitrator. In
the event any loss, liability or damage is incurred by way of settlement or
resolution without a court, jury or arbitrator having made a determination of the
CONSULTANT's percentage of fault, the parties agree to mediation to determine
the CONSULTANT's proportionate percentage of fault for purposes of
determining the amount of indemnity and defense cost reimbursement owed to
the CITY; CONSULTANT and CITY must each pay half the mediator's fees.
Notwithstanding the above, in the event one or more defendants to a Claim is
unable to pay its share of defense costs due to bankruptcy or dissolution of the
business, the CONSULTANT must meet and confer with the CITY regarding
unpaid defense costs.
B. Defense For All Non -Design Professional Liabilities. Notwithstanding the
foregoing and without diminishing any rights of the CITY under subsection A, for
any liability, claim, demand, allegation against CITY arising out of, related to, or
pertaining to any act or omission of CONSULTANT, but which is not a design
professional service, CONSULTANT must defend, indemnify, and hold harmless
Indemnitees from and against any and all damages, costs, expenses (including
reasonable attorneys' fees and expert witness fees), judgments, settlements,
and/or arbitration awards, whether for personal or bodily injury, property damage,
or economic injury, to the extent that they arise out of, pertain to, or relate to the
negligence, recklessness, or willful misconduct of the CONSULTANT.
C. For purposes of this section "CITY" includes CITY's officers, officials, employees,

agents, representatives, and certified volunteers.
D. It is expressly understood and agreed that the foregoing provisions are intended
to be as broad and inclusive as is permitted by the law of the State of California
and will survive termination of this Agreement.
The insurance coverage to be maintained by CONSULTANT as required by Section 22, will not
limit the liability of CONSULTANT hereunder. The provisions of this section will survive the
expiration or earlier termination of this Agreement.
19. ASSIGNABILITY. This Agreement is for CONSULTANT's professional services.
CONSULTANT's attempts to assign the benefits or burdens of this Agreement without CITY's
written approval are prohibited and will be null and void.
20. INDEPENDENT CONTRACTOR. CITY and CONSULTANT agree that CONSULTANT will
act as an independent contractor and will have control of all work and the manner in which it is
performed. CONSULTANT will be free to contract for similar service to be performed for other
employers while under contract with CITY. CONSULTANT is not an agent or employee of CITY
and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY
provides for its employees. Any provision in this Agreement that may appear to give CITY the
right to direct CONSULTANT as to the details of doing the work or to exercise a measure of
control over the work means that CONSULTANT will follow the direction of the CITY as to end
results of the work only.
21. AUDIT OF RECORDS. CONSULTANT will maintain full and accurate records with respect
to all services and matters covered under this Agreement. CITY will have free access at all
reasonable times to such records, and the right to examine and audit the same and to make
transcript therefrom, and to inspect all program data, documents, proceedings and activities.
CONSULTANT will retain such financial and program service records for at least three (3) years
after termination or final payment under this Agreement.
22. INSURANCE.
A. Before commencing performance under this Agreement, and at all other times
this Agreement is effective, CONSULTANT will procure and maintain the
following types of insurance with coverage limits complying, at a minimum, with
the limits set forth below:

B. Commercial general liability insurance will meet or exceed the requirements of
ISO-CGL Form No. CG 00 01 11 85 or 88, or equivalent. The amount of
insurance set forth above will be a combined single limit per occurrence for bodily

injury, personal injury, and property damage for the policy coverage. Liability
policies will be endorsed to name CITY, its officials, and employees as
"additional insureds" under said insurance coverage and to state that such
insurance will be deemed "primary" such that any other insurance that may be
carried by CITY will be excess thereto. CITY's additional insured status will
apply with respect to liability and defense of suits arising out of CONSULTANT's
acts or omissions. Such insurance will be on an "occurrence," not a "claims
made," basis and will not be cancelable or subject to reduction except upon thirty
(30) days prior written notice to CITY.
C. Professional liability coverage will be on an "occurrence basis" if such coverage
is available, or on a "claims made" basis if not available. When coverage is
provided on a "claims made basis," CONSULTANT will continue to renew the
insurance for a period of three (3) years after this Agreement expires or is
terminated. Such insurance will have the same coverage and limits as the policy
that was in effect during the term of this Agreement and will cover
CONSULTANT for all claims made by CITY arising out of any errors or omissions
of CONSULTANT, or its officers, employees or agents during the time this
Agreement was in effect.
D. Automobile coverage will be written on ISO Business Auto Coverage Form CA
00 01 06 92, including symbol 1 (Any Auto).
E. CONSULTANT will furnish to CITY valid Certificates of Insurance evidencing
maintenance of the insurance required under this Agreement, a copy of an
Additional Insured endorsement confirming CITY has been given Insured status
under the CONSULTANT's General Liability policy, and such other evidence of
insurance or copies of policies as may be reasonably required by CITY from time
to time. Insurance must be placed with insurers with a current A.M. Best
Company Rating equivalent to at least a Rating of "A:VII."
F. Should CONSULTANT, for any reason, fail to obtain and maintain the insurance
required by this Agreement, CITY may obtain such coverage at CONSULTANT's
expense and deduct the cost of such insurance from payments due to
CONSULTANT under this Agreement or terminate pursuant to Section 15.
23. USE OF SUBCONTRACTORS. CONSULTANT must obtain CITY's prior written approval
to use any consultants while performing any portion of this Agreement. Such approval must
approve of the proposed consultant and the terms of compensation.
24. INCIDENTAL TASKS. CONSULTANT will meet with CITY monthly to provide the status on
the project, which will include a schedule update and a short narrative description of progress
during the past month for each major task, a description of the work remaining and a description
of the work to be done before the next schedule update.

25. NOTICES. All communications to either party by the other party will be deemed made when
received by such party at its respective name and address as follows:

Any such written communications by mail will be conclusively deemed to have been received by
the addressee upon deposit thereof in the United States Mail, postage prepaid and properly
addressed as noted above. In all other instances, notices will be deemed given at the time of
actual delivery. Changes may be made in the names or addresses of persons to whom notices
are to be given by giving notice in the manner prescribed in this paragraph.
26. CONFLICT OF INTEREST. CONSULTANT will comply with all conflict of interest laws and
regulations including, without limitation, CITY's conflict of interest regulations.
27. SOLICITATION. CONSULTANT maintains and warrants that it has not employed nor
retained any company or person, other than CONSULTANT's bona fide employee, to solicit or
secure this Agreement. Further, CONSULTANT warrants that it has not paid nor has it agreed
to pay any company or person, other than CONSULTANT's bona fide employee, any fee,
commission, percentage, brokerage fee, gift or other consideration contingent upon or resulting
from the award or making of this Agreement. Should CONSULTANT breach or violate this
warranty, CITY may rescind this Agreement without liability.
28. THIRD PARTY BENEFICIARIES. This Agreement and every provision herein is generally
for the exclusive benefit of CONSULTANT and CITY and not for the benefit of any other party.
There will be no incidental or other beneficiaries of any of CONSULTANT's or CITY's
obligations under this Agreement.
29. INTERPRETATION. This Agreement was

31. ENTIRE AGREEMENT. This Agreement, and its Exhibits, sets forth the entire
understanding of the parties. There are no other understandings, terms or other agreements
expressed or implied, oral or written. This Agreement will bind and inure to the benefit of the
parties to this Agreement and any subsequent successors and assigns.
32. RULES OF CONSTRUCTION. Each Party had the opportunity to independently review this
Agreement with legal counsel. Accordingly, this Agreement will be construed simply, as a
whole, and in accordance with its fair meaning; it will not be interpreted strictly for or against
either Party.

33. SEVERABILITY. If any portion of this Agreement is declared by a court of competent
jurisdiction to be invalid or unenforceable, then such portion will be deemed modified to the
extent necessary in the opinion of the court to render such portion enforceable and, as so
modified, such portion and the balance of this Agreement will continue in full force and effect.
34. AUTHORITY/MODIFICATION. The Parties represent and warrant that all necessary action
has been taken by the Parties to authorize the undersigned to execute this Agreement and to
engage in the actions described herein. This Agreement may be modified by written amendment.
CITY's executive manager, or designee, may execute any such amendment on behalf of CITY.
35. ACCEPTANCE OF ELECTRONIC SIGNATURES. The Parties agree that this Agreement,
agreements ancillary to this Agreement, and related documents to be entered into in connection
with this Agreement will be considered signed when the signature of a party is delivered by
electronic (.pdf) or facsimile transmission. Such electronic or facsimile signature will be treated
in all respects as having the same effect as an original signature.
36. CAPTIONS. The captions of the paragraphs of this Agreement are for convenience of
reference only and will not affect the interpretation of this Agreement.
37. TIME IS OF ESSENCE. Time is of the essence for each and every provision of this
Agreement.
38. FORCE MAJEURE. Should performance of this Agreement be prevented due to fire, flood,
explosion, acts of terrorism, war, embargo, government action, civil or military authority, the
natural elements, or other similar causes beyond the Parties' reasonable control, then the
Agreement will immediately terminate without obligation of either party to the other.
39. STATEMENT OF EXPERIENCE. By executing this Agreement, CONSULTANT represents
that it has demonstrated trustworthiness and possesses the quality, fitness and capacity to
perform the Agreement in a manner satisfactory to CITY. CONSULTANT represents that its
financial resources, surety and insurance experience, service experience, completion ability,
personnel, current workload, experience in dealing with private consultants, and experience in
dealing with public agencies all suggest that CONSULTANT is capable of performing the
proposed contract and has a demonstrated capacity to deal fairly and effectively with and to
satisfy a public CITY.

RE: Revised Proposal for On -Call Land Surveying Services
Dear Mr. Xu:
Thank you for requesting a proposal for our professional land surveying services. MNS Engineers,
Inc. (MNS) has enjoyed working with you and other City staff over the past four years. We look
forward to the opportunity to continue to do so over the nextfiscal year.
MNS has been providing City Surveyor services for over three decades to several cities and counties
in California. We have been providing survey services for the City of El Segundo since 2018. During
this time, we have increased our knowledge of the City's processes and expectations and developed
a solid understanding of the forms, formats, certificates, and statements associated with those
projects.
I have lead the MNS Survey Department for over three decades. My experience with providing private
development review for cities in California began in 1991, this service has become a significant part
of our department over time. Our diversified experience with dozens of cities and municipalities gives
us a solid understanding of the needs of these projects and how best to serve our municipal clients.
In Los Angeles County, we have provided surveying services for the City of Malibu, since 2012, and
the City of Pasadena, since 2015. These services have included subdivision map reviews and reviews
of lot line adjustments and mergers as well as support of capital improvement projects such as
project base maps, easement preparation, and roadway vacation support. We are well -prepared to
serve our city clients within Los Angeles County.
Chris Vandrey, PLS, CFedS, has been involved with the City's survey projects for three years and
has an excellent understanding of the needs and expectations of the City. He will be responsible for
the organization, tracking, and reviews for most of the projects we receive from the City. Chris and I
consult on a daily basis regarding these projects; I provide assistance and oversight for each project
as well as signing on the final products.
MNS understands the nature of on -call contracts:
• Timing. We are well-acquainted with the importance of timing as it relates to private development
review and the pressures often imposed upon the review team. With respect to that, when we
receive a submittal, it is logged in on the same day and a response target date set at two weeks
from date of receipt. Over the years we have consistently delivered the reviews within that time
allotment, or sooner.
• Quality. Our team is committed to providing high quality, professional services. Our goal is to
support the City in such a way as to protect the City's interests, limit liability, and ensure the
development and maintenance of public and private assets are completed consistently, efficiently,
and of a quality that matches or exceeds the City's expectations.

Land Surveying
Our Land Surveying department is comprised of the following
components:
Municipal Surveying services. MNS provides a substantial
amount of private development review, conducting map
checking, document review services for tract maps, parcel
maps, lot line adjustments, mergers, and certificates of
compliance. We also support many cities with their real estate
needs such as easement research, roadway vacation services,
including resolution preparation, determining fee or easement
status of road right-of-way (R/W), annexation mapping and
descriptions, and preparation of various documents including
grant deeds, easement deeds, and quitclaim deeds.
Right -of -Way Engineering services. We bring significant
expertise in supporting the R/W acquisitions and dispositions
required for capital improvement projects. We have a strong
working knowledge of Caltrans policies and procedures
regarding R/W acquisition and typically tailor our products
to match these requirements, often with modifications to
suit local agencies. We also have experience in providing
early project support preparing the R/W datasheet and the
associated cost estimates. We provide monument preservation
services. This is typical for roadway construction projects.
Design Surveying services. Our firm has extensive experience
in R/W, boundary and easement retracement, ground, aerial
and bathymetric topographic mapping, utility mapping, as-
builts, and 3-dimensional (3D) scanning survey data collection.
Typical projects include roads, highways, bridges, parking
lots, pipelines, and other municipal projects, including water,
recycled water, wastewater processing, and treatment plants.
Construction Surveying services. MINIS has significant
experience in providing construction surveying for roads,
highways, bridges, retaining walls, pipelines, water processing
facilities and multiple -story buildings. We provide stability
monitoring for projects requiring excavation near adjacent
structures.

We are proud of our work and do not accept providing anything but efficient and timely service and quality deliverables. Our managers
have over 100 years of combined experience, and in addition to project management, provide mentoring and quality standards to our
staff. Our office staff receives training for computer -aided drafting and design (CADD), global positioning system (GPS), geographic
information system (GIS), and other support software; we provide special training sessions. We have developed various resources
online for data useful to our work. Our field staff are experts in the use of Robotic Total Stations and GPS surveys. Each team member

Section 4Scopeof Services
The following Critical Project Elements identifies the typical
survey tasks to be performed on non -construction and
construction projects.

Typicalury Tasks for Non -Construction Projects
• Project datums and sources identified. Typical horizontal
and vertical datums used are City, County, NGS, Caltrans. In
non -critical, isolated small projects, assumed datums may be
acceptable to provide efficiency. This will he confirmed by the
City prior to commencing work.
• For topographic mapping, map scale, accuracy, and contour
interval are identified.
• Field equipment and procedures are established for desired
accuracy, detail, and efficiency.
• Project limits are identified.
• Level of mapping detail is identified.
• Critical boundary and R/W are identified.
• Non -critical boundaries, R/W, level of accuracy requirements,
and acceptable resources are identified. Typically project base
maps require, for instance, R/W lines.
• If the project will be confined within the paved road, R/W can
at times be per record data and best fit or from a GIS source.
The source will be identified on the map and an advisory if
the design will require construction in close proximity to the
R/W line, that line must move to the critical R/W status and be
formally retraced.
• Easement research and retracement needs are identified. The
need for title reports is assessed.
• CADD mapping standards are identified. These can be in-house
or City specified.
• Utility mapping requirements are identified. Critical items
may include location of visible utilities, manhole dipping,
Underground Service Alert (USA) markings, and atlas
procurement from utility companies. In some cases; as
needed, we contract with an underground utility locating
company to positively identify locations, type, and condition in
the case of sewer and storm drain video inspection.
Access issues determined and access permits acquired as
needed.
• Safety issues are considered. Traffic control is implemented
as needed. Special, off-peak traffic working hours may be
incorporated for crew safety.
• Scanning may be incorporated for safety and efficiency.
Typical Survey Tasks for Construction Projects
Plan Verification. Construction staking assignments begin
with verifying the plans are the current, approved plans. We
often receive electronic drawings, which we carefully compare
against the hard copy approved plans. We will note any
discrepancies and address them with the design consultant.
Project Controls. Prior to commencing construction layout
work, our first field assignment is to check and verify
project horizontal and vertical control. Our field team will
independently survey this control. We will provide a project
control report for use by the construction staking surveyor.
Conforming Ties. We will identify all tie-in points where new
construction conforms to the existing in order to eliminate any
discrepancies that we may encounter.
Safety. Safety issues are considered. Traffic control is
implemented as needed. Special, off-peak traffic working hours
may be incorporated for crew safety.
• Survey Request Authority and Timing. Prior to commencing
work, we will establish the person or persons authorized to
request staking, monitoring, or other tasks with the City. We
will also establish a preferred lead time to ensure availability
and preparedness.
Typical Tasks for Private DevelopmentReview
• Project Review Procedures. Upon receiving a project from the
City, we log the submittal into our spreadsheet and assign a
tracking number. We also set a target due date that falls prior to
the State -mandated deadline for response. The project location
and key data are also entered into our GIS database in order to
observe if we have reviewed any previous projects the vicinity
to leverage that experience into the new project. The submittal
is reviewed for completeness. Once the submittal is deemed
substantially complete, we conduct the first thorough review.
We prepare a redlined map and a separate text document
listing the review comments. We can work with hard copy
submittals but have found that Adobat PDF submittals are very
efficient and we encourage that type of submittal. Depending
on the City's preference, we will send our comments directly
back to the City whereby the City will review and forward to

project surveyor; otherwise, we will work directly with the
project surveyor with copies to the City.
Coordination with Plan Checking. When easements,
roadways, or other dedications are required, we find it valuable
to correspond with the person assigned to the plan check to
ensure the areas being dedicated are adequate for the project.
We also review the conditions of approval to identify any
conditions tied to the preparation or recordation of the map
and/or documents.
Design Services to be Provided by WINS Surveys
• R/W Datasheet Preparation for Project Approval/Environmental
Documents (PA/ED) Design Phase of transportation projects.
• R/W Certification for Plans, Specifications, and Estimate
(PS&Es) Design Phase of transportation projects.
• Determination of Prior Rights for Utility Relocation Cost
appropriations.
The cost for providing a specified project or task will vary
depending upon the size, complexity, and nature of the project.
The following shows a range of fees for average -sized, average -
complexity projects that MNS typically encounters.
These fees will vary depending upon the size and complexity,
as well as on the completeness of the submittal and the quality
of the maps and doCUrnentS provided. Based upon actual costs
from six recent projects, for reviewing a Parcel Map or 1 Lot Tract
Map for Condominiums, which required one major review and
two subsequent, minor reviews through to recordation; the costs
ranged between $2,400—$4,200 with an average fee of $3,005.
Topographic for Design of Completere
Improvements
This includes contour map and 3D surface, above -ground
utilities, opening and measuring of manholes, full topo from
back of walk to back of walk, striping, and R/W retracernent for
a 500-foot block. An approximate cost will be $9,500411,500,
depending upon complexity and availability of monuments.
Reducing the scope when this comprehensive level is not needed
will reduce the cost.
Construction Projects
These vary greatly; however, atypical daily charge which will
include office and field support for one day of staking:
• One -person crew with office support will be approximately
$2,270
• Two -person crew with office support will be approximately
$3,270
A large percentage of our work is completed with a one -person
crew.
In all instances, a larger project will typically benefit from
efficiency of scale and have a lower average daily rate.

Mr. Reinhardt has significant career experience in land
surveying and oversees all of the firm's surveying
activities. Along with managing a full range of survey
services, Mark is the contract City Surveyor for the Cities
of Arroyo Grande, Carpinteria, Greenfield, Malibu,
Pasadena, and Salinas. His responsibilities include
reviewing all parcel maps, tract maps, lot line
adjustments, and other land development projects. He is
also knowledgeable and experienced in preparing
resolutions and back up data for roadway vacations and
other special projects related to City real estate projects.
Mark has extensive expertise in right-of-way engineering
and has prepared design surveys, right-of-way maps,
appraisal maps, deeds, and legal descriptions for several
State Highway projects using Caltrans standards. Mark
has provided right-of-way engineering services and
documents for several roadway projects within the
Counties of San Benito, Monterey, San Luis Obispo,
Santa Barbara, Ventura, Los Angeles, San Joaquin, and
Kern. He is very effective in coordinating the needs of
various agencies on a project. His experience includes:
Municipal Surveying Services, Various Agencies, CA.
Project Manager. MNS has provided Municipal Surveying
Services to many public agencies; some examples
follow:
• City of Carpinteria. We have been designated as
City Surveyor for over two decades. We provide the
City with reviewing and signing of all parcel maps,
tract maps, lot line adjustments, certificates of
compliance, and mergers. We have provided them
with various standardized procedures and document
formats and support them with acquisitions,
relinquishments, and roadway vacations.
• City of Santa Clarita. The City experienced an
intense growth period in the first decade of the 21st
century. MNS was selected to assist in processing
numerous tract maps. On average, the maps were
15-20 sheets with the largest one consisting of over
45 sheets. One tract had six phases already in
various states of review. Our procedure was to first
learn the City's system of review and the special
dedications and acceptance wordings; in some
cases, they were unique to that City. We also
coordinated between two surveying firms to ensure
their separate but adjacent tracts had identical
centerline locations for the same roadways to
traverse through both tracts.

City of Malibu. Mark has served the City of Malibu
since 2012 as contract City Surveyor. He routinely
manages the map checking, certificate of compliance
reviews, lot line adjustments, etc. along with
supporting the Public Works and Planning staff with
special projects such as review of right-of-way
locations on development plans for accuracy and
preparing legal descriptions for acquisitions.
City of Pasadena. MNS was selected in 2015 to
provide City Surveyor services to the City of
Pasadena. As with other City clients, we have a
spreadsheet that tracks each project as they are
submitted. The spreadsheet indicates the date
received, sets a target response date 10 days
following receipt, and receives entries of the actual
response date. This has worked successfully to
provide prompt service to these development review
projects and kept them well within the State -
mandated 20-day response time. It has actually
worked to shorten the response time, often within a
couple of days.
City of Goleta. The City of Goleta incorporated in
2002. MNS has provided private development review
for them since that time. Typical projects include
parcel maps and tract maps. Because MNS works
almost exclusively for public agencies, we do not
typically experience conflicts of interest with private
developers.
Monument Preservation Programs, Cities of Solvang,
Buellton, and Carpinteria, CA. Principal Land Surveyor.
Over the past 15 years, these cities required monument
preservation programs for all of their roadway overlays
and roadway reconstruction projects. Mark managed all
of these programs, which required research for record
monuments, field searching and tying out of monuments,
replacing monuments following construction, and filing
pre- and post -construction corner records with the
County Surveyor.
Ekwill Street and Fowler Road Extensions and
Roundabouts, City of Goleta, CA. Principal Land
Surveyor/Project Manager. This $16.7M project designs
two new roadway corridors to improve traffic flow within
the City of Goleta between State Route 217 and the
Santa Barbara Municipal Airport. This project also
involves two new roundabouts at the Hollister
Avenue/State Route 217 interchange and a new bridge
over San Jose Creek. Surveying involved an aerial
topographic map, extensive ground -based topographic
surveys, utility surveys, monument recovery to assist in
the right-of-way engineering, and retracement of 41
parcels, 10 roadway and highway segments, and
numerous easements along with the preparation of

approximately 45 legal descriptions and plats for
acquisition, and preparation of three records of survey to
be used as references for the various legal descriptions
and easements along the new roadways. Mark
recommended and later prepared three Records of
Survey to be used as references for the various legal
descriptions and easements along the new roadways;
this provided and expedited the preparation of legal
descriptions once the acquisition elements of the project
were specifically identified and the acquisition effort
became the critical path of the project.
Mesa Road/Phelps Road Trunk Sewer, Goleta West
Sanitary District, CA. Principal Land Surveyor/Project
Manager. This project replaced and rerouted 11,400 feet
of trunk sewerline. Surveying services included preparing
a base map, which included aerial topographic mapping
and color digital ortho-photo preparation; conducting a
thorough field survey of all hardscape and utilities along
the entire corridor; performing extensive boundary and
right-of-way retracements along with the research and
retracement of numerous sanitary sewer easements in
favor of the District; and preparing grant deeds, legal
descriptions, and plats for the acquisition of new
sewerline alignment and for temporary construction
purposes to remove the old line and for construction.
Following completion of the mapping and easement
study, MNS provided quitclaim deeds with legal
descriptions and plats to extinguish easements no longer
used following the new trunk line construction. The
budget was significantly reduced by using one -person
survey crews utilizing GPS and Robotic Total Station
systems. Responsibilities included managing the base
map preparation for design and providing assistance in
eliminating various easements and acquiring others.
Fernald Point Road Bridge, County of Santa Barbara,
CA. Principal Land Surveyor/Project Manager. MNS
prepared the project base map for design of the Fernald
Point Road Bridge. The base map included preparing a
ground -based topographic map along the creek corridor
a length of 1,300 feet and along the roadway corridor
approximately 650 feet. Mapping elements included
paving, fences, gates, drainage features, utilities and
signs. We also mapped the soffits of the Fernald Bridge,
Railroad Bridge, Highway Bridge, and Jameson Lane
Bridge. MNS also retraced the Fernald Point Road right-
of-way for about 700 feet. All CADD work was completed
by the County of Santa Barbara mapping guidelines,
including Linetype Legend, Symbol Legend, Control
Point Table, and Monument Table. MNS prepared four
maps sheets and two control sheets.

Mr. Vandrey has over 19 years of experience in land
surveying, specializing in municipal surveying services in
the last 10 years. Prior to MNS, Chris served as the
County Surveyor for the County of San Mateo where he
oversaw all the surveying and mapping services required
for the Public Works Department and for various cities
within the County. He is well versed with subdivisions,
boundary surveys, legal descriptions, easements,
geographic information systems (GIS), and
drafting/Civil3D. He is well -versed in the Subdivision Map
Act and other legislation related to surveying and
understands how to apply local ordinances when working
with different public agencies. He is known for improving
processes and procedures to provide efficient solutions.
Before beginning his career in land surveying, Chris
served with the United States Marine Corps for six years.

Municipal Surveying Services, Various Agencies, CA.
Principal Municipal Surveyor. Chris supports the MNS
team to provide Municipal Surveying Services for several
public agencies; some examples follow:
• City of Ell Segundo. Over the past three years, Chris
has been the primary contact with El Segundo for
map and document reviews. Chris has worked with
City staff on several types of development related
reviews including survey maps, Lot Line Adjustment
applications and applications for Voluntary Merger.
Chris reviewed the Lot Line Adjustment for the City's
golf course known as `The Lakes at El Segundo.' He
also worked with City staff and multiple consultants in
the review of the Lot Line Adjustment and on -site
easements for the LA Times property along Imperial
Highway. Chris also conducted the review of the
ALTA survey map at the Pacific Coast Commons
project and is currently reviewing the Vesting
Tentative Tract Map also for the Pacific Coast
Commons site. He has also worked with City staff on
the legal description for the abandonment of the
waterline easement on the Raytheon site.
• City of Malibu. Chris has taken over many of the
responsibilities of providing the City with contract City
Surveyor services. He routinely manages the map
checking, certificate of compliance reviews, lot line
adjustments, etc. along with supporting the Public
Works and Planning staff with special projects such
as review of right-of-way (R/W) locations on
development plans for accuracy and preparing legal
descriptions for acquisitions. Chris recently
participated in meetings with the City's Planning and

Public Works staff along with the City Attorney to
map the Conditional Certificate of Compliance course
as it relates to the Local Coastal Plan and the City's
Land Use Plan. We also presented key questions
related to the historic subdivision map acts and local
county ordinances as they relate to determination of
compliance. The results of these meetings were a
clear processing path and rules for consistent
decisions on certain aspects related to parcel
creation compliance.
City of Pasadena. MNS has served the City since
2015 and recently received a five-year contract to
continue providing them with surveying and
municipal services. MNS has provided review
services for several Parcel Maps and Tract Maps,
and a variety of other tasks, including an extensive
retracement of approximately 1,100 feet of disputed
City R/W and adjacent property corners, street
topographic mapping, monument preservation, legal
descriptions and exhibits and field mapping for
encroachments into City property.
City of Salinas. MNS has provided private
development review for the City since 2015. Typical
projects include parcel maps, tract maps, lot line
adjustments and mergers. Along with several smaller
projects we are reviewing multiple phases of the very
large Monte Bella subdivision. As with all of our
municipal clients, Chris has successfully transitioned
into a key role with the City and won their confidence
with his review work.
City of Arroyo Grande. MNS has provided private
development review for the City since 2014. Typical
projects include parcel maps, tract maps, lot line
adjustments and mergers. With our wide range of
experience and knowledge of procedures and
formats with other cities, we assisted the City with
improving and standardizing the forms used for Lot
Line Adjustments, Voluntary Mergers, and
Certificates of Compliance. Chris has taken charge of
the majority of the review of these private
development projects.
City of Greenfield. MNS has served the City of
Greenfield since 2011 and continues to provide land
surveying services including contract City Surveyor
services. Chris manages the map checking, lot line
adjustments, tentative map reviews, etc. He also
supports the Public Works Department and Planning
Department staff with special projects such as
preparing legal descriptions for utility easements and
preparing right-of-way exhibits to help the City
determine where to place City signs. Chris also
worked closely with the City Engineer and PG&E on
creating a detailed right-of-way and utility map for a
major electrical undergrounding project.

Private Company Experience, Antelope Valley and
Encino, CA. Mapping and Surveyor Technician. Chris'
primary role was to prepare subdivision maps and run
the daily operations of the field Surveying Group. He
scheduled 10+ field crews for construction and boundary
projects across Los Angeles County and parts of the
Antelope Valley. Chris also provided plans and
construction calculations for the field crews on several
large-scale residential and commercial projects and
provided the necessary equipment and data to field
crews on a daily basis. Other responsibilities included
preparing annexation maps to special districts, drafting
plats and writing legal descriptions for road right-of-way
dedications, preparing lot line adjustments, and providing
support to the engineering department.
County of San Mateo, San Mateo, CA. County
Surveyor. For over six years, Chris served as the County
Surveyor, responsible for overseeing map checking of
records of survey and corner records. He also reviewed
all subdivision maps in unincorporated San Mateo
County (County). He oversaw field surveys for Public
Works infrastructure projects. He established the
County's GIS-based monument preservation program
and the County's Public Works Projects GIS. In addition
to being the lead surveyor for Public Works, Chris
worked regularly with the County's Planning Department
in reviewing applications for lot line adjustments,
certificates of compliance and served on the committee
to rewrite the County's subdivision ordinance. He worked
closely with County Counsel on several land -related
issues and has given expert testimony in court on behalf
of the County. In his role as County Surveyor, Chris
served as a consultant to the Real Property Division and
to the Parks and Recreation Department supporting land
acquisitions, easement abandonments, and preparing
legal description for various projects. As part of his
County Surveyor duties, he was the City Surveyor for the
Cities of Daly City, Millbrae, and San Carlos for whom he
conducted map and document reviews.
City of Santa Clarita, Santa Clarita, CA. Map Checker
and Field Surveyor. Chris worked as a map and
document reviewer for the City of Santa Clarita's (City)
Development Services team. He reviewed tract maps,
parcel maps, lot line adjustments, road abandonments,
and other various development related documents. Chris
also worked with planning staff to create and revise legal
descriptions for special district boundaries. Chris played
a key role in creating the City's first in-house Surveying
Group. This group provided field surveying services for
various City departments, including construction staking
on capital improvement projects and monument
preservation surveys.
