(Geosyntec) is pleased to provide you with this proposal for consulting services to assist the City of El Segundo (City) in applying to the Los Angeles Regional Water Quality Control Board (Regional Water Board) for approval of Pump Station 18 as a Regional Stormwater Mitigation Program. Provision VI.D.7c.iii.(6) of the Los Angeles municipal separate storm sewer system (MS4) permit (Order No. R4-2012-0175) allows for a Permittee to submit to the Regional Water Board for approval of a regional stormwater mitigation program to substitute in part or wholly for the New Development and Redevelopment requirements for the area covered by the program. A regional stormwater mitigation program may be approved by the Regional Water Board if it meets all of the following requirements: • Retains the runoff from the 85th percentile, 24-hour rain event or the 0.75 inch, 24-hour rain event, whichever is greater; • Results in improved stormwater quality; • Protects stream habitat; • Promotes cooperative problem solving by diverse interests; • Is fiscally sustainable and has secure funding; and • Is completed in five years including the construction and start-up of treatment facilities. In addition, the City would like to develop an In -Lieu Fee (ILF) Program for the Regional Stormwater Mitigation Program. Since Pump Station 18 will serve as the downstream Low Impact Development (LID) best management practice (BMP) for future new Proposal _PSI 8 Regional Project Support_January 112021 Agreement No. 6040 Mr. Lifan Xu Ms. Cheryl Ebert January 11, 2021 Page 2 development and redevelopment projects within the tributary watershed, these projects will not be required to construct project -specific LID BMPs, as otherwise would be required by the MS4 Permit and City. As a result, the City is proposing a program that charges a fee to these developers in place of the onsite LID requirements. Money collected from the Program could then be used on other stormwater controls within the City. This proposal provides a scope of work to assist the City with the requested support. SCOPE OF WORK Task 1 - Project Man ement Geosyntec will prepare for and attend a virtual, one -hour kick-off meeting with the City. The kick-off meeting will discuss the project objectives, detailed project schedule, key decision points, and project deliverables. In advance of the meeting, Geosyntec will prepare a meeting agenda, detailed project schedule, and deliverable plan. Geosyntec will send meeting notes that reflect the meeting outcomes to the meeting participants within one week of the kick-off meeting. Geosyntec will also participate in up to two one -hour conference calls throughout the duration of the Project (e.g., to discuss basic administrative details with the appropriate City staff) and will regularly correspond with the City via electronic mail. This task also covers administrative support (i.e., project management and invoicing) related to the Project. Assumptions: • Geosyntec will prepare for and attend a one -hour virtual Project kick-off meeting and up to two one -hour conference calls throughout the duration of the Project. • All Project deliverables will be delivered electronically. • The City of El Segundo PM will be responsible for rectifying any conflicting review comments and will provide direction to Geosyntec. • Following the draft deliverable dates, the City has a two -week maximum comment period. No comments received after agreed -upon schedule can be addressed within current scope and fee. Deliverables: • Meeting agendas and meeting summaries. The application will be prepared in a manner consistent with previous successful applications approved by the Regional Water Board (e.g., those submitted by the City of Torrance). Geosyntec will participate in one one - hour virtual meeting with the Regional Water Board to receive comments on the draft application and will finalize the application package based on input from the Regional Water Board and the City. Assumptions: • It is assumed that one round of review of the application package by the City and corresponding revisions will occur prior to submission to the Regional Water Board (i.e., two drafts of the application will be produced). • It is assumed that one one -hour meeting will be held virtually with the Regional Water Board to receive comments on the application package. Deliverables: • Regional Stormwater Mitigation Program application package for submittal to the Regional Water Board (two drafts and final). Task 3 —In-Lieu Fee Program Develo anent To support the development of the ILF Program, and relying on the application package produced for Task 2, Geosyntec will provide a technical memorandum that contains the following input for the City to incorporate into a Program document: • Definition of the ILF Program: o General overview of the ILF Program, including, but not limited to, the regulatory basis of the ILF Program (i.e., MS4 Permit), the administrating department within the City, and a map showing the area where the ILF Program applies. o Estimate of Pump Station 18 capture performance for stormwater runoff from upstream development based on previous analyses conducted by Geosyntec and the City in 2017. • Stormwater Control Economic Analysis: Proposal_ PSIS Regional Project Support_January 11 2021 engineers I scientists I innovators Agreement No. 6040 Mr. Lifan Xu Ms. Cheryl Ebert January 11, 2021 Page 4 o Geosyntec will estimate costs for developers to implement stormwater controls on their projects, as well as the economic benefit derived from not implementing LID BMPs on the development project site. These costs can then be used by the City to establish a fee structure for the ILF Program. o Ideas for how the collected revenues may be used, such as implementation of other City stormwater facilities or programs, administration costs, or stormwater facility operation and maintenance. r Development Tracking Program Alternatives Analysis: o Once in place, the ILF Program will require tracking of participating developments within the Pump Station 18 tributary watershed, in order to track both the funding of the ILF Program and the performance of Pump Station 18 relative to MS4 Permit requirements for the participating upstream developments. Information input into the database can be based on permit applications and/or certificates of occupancy following project completion. o Geosyntec will prepare an alternatives analysis to introduce tracking tool options to the City and provide recommendations on a development tracking program. The analyzed alternatives may range from a simple Excel -based tracking tool to a more robust and dynamic GIS-based online platform. Assumptions: • The following information and input are assumed to be provided by the City: o Legal review of the proposed definition for the ILF Program and any necessary program revisions. o Identification of the City department managing the ILF Program and the collected revenues. o The review process for ILF Program applicants and how the review process for these applicants may differ from typical project applicants. o How the City currently sets fees for similar programs. o Eligibility restrictions or fee credits the City would like to consider. o Final determination of the ILF Program fee. Proposal_PS 18 Regional Project SupportLhnuary 112021 engineers I scientists I innovators Agreement No. 6040 Mr. Lifan Xu Ms. Cheryl Ebert January 11, 2021 Page 5 • The economic analysis will be conducted using rough order -of -magnitude costs for BMP implementation and may not be specific to the City. The ultimate form of the Program will be determined by the City, following City attorney direction. « GIS data will be provided by the City, as requested by Geosyntec, and may include, but are not limited to: o Cost data for recently approved new/redevelopment projects, o Representative and applicable City plans, o Parcel data, and o Other mapping data. • A development tracking tool will not be created within the scope of this proposal. • It is assumed that one round of review of the technical memorandum by the City (i.e., one draft and one final technical memorandum). Deliverables: 9 Geosyntec will produce a technical memorandum to support the City's ILF Program development. An analysis of tracking program alternatives, to be included as part of the technical memorandum. COST PROPOSAL Geosyntec will conduct the Scope of Work for $24,988 based on time and materials expended in accordance with Geosyntec Consultants 2020 Rate Schedule. This amount will not be exceeded without prior approval. A budgetary cost breakdown is presented in Table 1 showing anticipated expenditures of time and materials. This budget allows for the potential for reallocation of cost between tasks and subtasks, or replacement of tasks per direction from the City, so long as the total contract amount is not exceeded without City approval. It is the nature of regulatory -driven programs to be subject to uncertainty and unpredictable events such as changes in regulatory requirements, emerging issues, enforcement action or third -party lawsuits, or simply additional support required by City staff that was unanticipated. If such unpredictable event(s) or needs arise, Geosyntec stands ready to assist the City and, at City staff s request, will submit a request for an Proposal _PSI S Regional Project Support_January 112021 engineers I scientists I innovators Agreement No. 6040 Mr. Lifan Xu Ms. Cheryl Ebert January 11, 2021 Page 6 authorization for scope change to provide the City with additional consulting services to respond to such an increased scope.
