Conduct a public hearing, introduce by title only and waive further reading of an Ordinance establishing a Short-term Home Sharing Rental Permit Pilot Program to allow and regulate home sharing in the City's residential zoning districts which will run from September 1, 2020, through December 31, 2021. I was planning to appear at TODAY's City Council meeting that was canceled TODAY at the last minute on the City website. May I give you my input to ensure EI Segundo homeowners who share their homes and the pilot program succeeds. I lived your "pilot" program for one entire year. I live and work in my EI Segundo home so I'm there almost 24/7 since June 2019. I've taken GREAT LENGTHS to ensure the guests follow the City, Airbnb, site terms, and my rules to ensure the guests are good neighbors, no parties, no noise, no damages, and for safety reasons. (Below) But until the Police AND Airbnb homeowners may fine their guests that break the rules and laws the guests will not behave. My home in San Diego and we have no problems as the guest gets a $1,000 police fine if called AND if the guest books on non-Airbnb sites they lose their $1,000 deposit as the homeowner controls the security deposit. (Airbnb won't take security deposits for break rules.) EI Segundo long term and short term guests know they can break EVERY rule in the book and they WON'T get fined by the EI Segundo police AND they will not lose their damage deposits as Airbnb requires guests must agree to pay for damages and out of pocket costs and most guests do not agree. 98% of guests are awesome, especially guests who fly in from out of state. LOCAL guests are not great. Example Police Report Assault & $20K Vandalism: Det Saldana Case #20-1098, May 18, 2020 In May, "Jaroon" booked my home via Airbnb for three guests for May 17-19. The guest had to sign the contract, agreed to the house rules and these rules are listing in the listing too. I send the guests a copy of their contract and house rules to sign and agree to them AGAIN as most guests don't read the contract when they check out. Airbnb requires a "second chance" so we make the guest copy and paste the below as their first warning prior to entering the home in the message center: NOTE: The guest MUST cut and paste the following and say they agree to all the City conditions. The City wants to collect its mandatory occupancy tax, avoid overcrowding and noise. Your guest count for both day and night is the maximum number of guests allowed at the home day or night. PLEASE NOTE THAT WE WILL BE SENDING CHECK-IN INSTRUCTIONS AFTER COMPLETING THE FOLLOWING STEPS The below are laws already in force and are in the ad, contract, house rules, etc. to be a good neighbor. No Noise. No Unruly Gatherings/No Parties. No Smoking Inside and Out. No Extra Guests Not on The Reservation at the Home at any time. (no more the 8 DAY AND NIGHT) Guests must pay all City Fines and Lose Your Security Deposit for Violations of City and House Rules. I met with every guest and show them my home (and room) and tell them the rules and we document everything in the message center of every conversation so if we have challenges. We stage our home around the entire outside with security cameras and noise detection and we watch almost 24/7. Jaroon's extra guests start rolling in and the music started to get loud. knock on the door to enter their space. Turned off the TV, speaker, and told guests to leave with my boyfriend taping the proof they broke the rules. This group started to get mad/riot like and assaulted me twice (2nd was a gang pile), threw knives around so we were forced to call 911. The group said yeah we know we don't get the ticket in EI Segundo and the owner gets the ticket. Guests left before the police arrived and I went to the Emergency room. The next day officer Black said to call if you have any additional damages or see anything else and came back over to document $20K damages and drugs, etc. Officer Black said, do not take your life into your danger. Call non -emergency police and we will help have you enter the home and if the guests don't leave we will arrest them for trespassing and you will not get a ticket. So I followed Officer Black's directions. Next time, no arrests but I got the ticket. I fought the violations requesting review and hearing with no reviews or hearings that have ever been granted. Then I received a letter from District Attorney "because crimes committed at my home" you no longer my rent your home. We reported Jaroon to Airbnb/Police and gave them a ring security camera, phone videos, photos, etc. The ATM was stolen so the guest was charged $0 total for the reservation, damages, extra guests, medical bills. We filled a claim and no response. Under 2% of Airbnb, Host Guarantees are paid out. Luther and Cori Waters, the aunt and uncle of the niece who posted her bragging video of assaulting a "white b*tch in EI Segundo. Promoting what you can do in EI Segundo with no consequences. Luther wants to turn her niece into the Det. Saldana since May 18 and she can turn in everyone involved. Airbnb has closed their investigation in two days without talking to me and zero dollars for medical or damages. Airbnb will only share the investigation with the Detective which he hasn't logged onto their portal yet. Det. Saldana has not interviewed the key assaulter as of July 7, 2020, with weekly, follow up calls since May 17 and the police department will not follow up on prior vandalism reports "with a 10 foot" pole. Airbnb Owner Assaulted 0 3:35 - Assault #1 • 10:30 -Assault #2 by the group 9 Guest says "let's get her fine, she will her lose her home" is Stops Party/Vandalism ($20K damages) The City of EI Segundo has told us to stop renting our home short term even though we have an agreement in writing to rent my home short-term to 8 guests. We impose a $500 fine if I get ONE call or text from the neighbors. If the police are called by the neighbors the Homeowner's Association fines you $1000 and you may also be cited by the police an additional $1000. Tenant/Guest agrees to closely read and abide by the Terms of the Agreement and assumes the responsibility to ensure their guests and any visitors abide as well. As consideration for the booking and use of Vacation Rental Property during the lease term, Tenant agrees to pay Laura Christine or Manager for all items specified. " "13. DISTURBANCES: Tenant and their guests shall behave in a civilized manner and shall be good neighbors respecting the rights of the surrounding property owners and shall not create noise or disturbances that interfere with the quiet enjoyment of their property. Creating a disturbance of the above nature shall be grounds for $500 Association fines for each occurrence and/or immediate termination of this agreement, forfeiture of rent and deposits and Tenants shall then be required to immediately vacate the premises. Quiet hour starts at 8 PM and pool (if applicable) and outdoor noise should be kept to a minimum regardless of the hour and in compliance with the local Noise Ordinance. 7 CITY OF San Diego and Los Angeles ORDINANCES & HOMEOWNER ASSOCIATION RULES We would love for you to enjoy your vacation with your family and friends! " "New City of San Diego and Los Angeles Ordinances & Homeowners Association Rules: If the City of San Diego and Los Angeles police come to the house or calls me due to a neighbor's complaint we both may be fined $1000 each for the noise. So you may be fined $1000 and will lose your entire deposit. (As stated in contract) The City's Noise Ordinance (San Diego Municipal Code, Section 59.5.01): Noise Abatement. Because excessive noise can be harmful to the health and welfare of citizens, the City of San Diego prohibits excessive and annoying noise within City limits. The City's Noise Ordinance (San Diego Municipal Code, Section 59.5.01) defines noise and regulates it by type, land use zone, and time of day. Violations of the noise ordinance could result in an administrative citation with fines up to $1,000. I've given my phone number to all the neighbors to call me first so that I can mitigate any damages by giving you a call and text to quiet down. I'm part of a homeowners association so I/you will be fined $500 from the HOA for noise, parties or smoking. No warnings. (As stated in contract) "31. NOISE: Tenant is aware if Unit is located in a high density neighborhood, it is therefore subject to noise from nearby residences/businesses/traffic. If Unit has common walls, ceilings or floors, noise may travel between and cause disturbance. " Bottom-line, if guests have no skin in the game the one bad apple will cause the EI Segundo homeowner to lose their home. Guests must be fined (by the Police, Airbnb via the Airbnb owner) and criminally prosecuted if they commit crimes or EI Segundo homeowners will lose their shared homes.
