BACKGROUND AND DISCUSSION:
Revised Administrative Order No. 1
When a local or state emergency is declared, the City Municipal Code provides for the carrying
out of plans for the protection of persons and property within the City. In such an emergency, the
City Manager serves as the Director of Emergency Services ("Director"). The Director is
empowered to, among other things, make and issue rules and regulations on matters reasonably

related to the protection of life and property, provided, however, that the City Council ratifies such
actions in a timely manner (ESMC §§ 2-2-5, 1-7-9).
On March 4, 2020, the Governor declared a State of Emergency based on the COVID-19
pandemic. On March 17, 2020, City Council adopted Resolution No. 5207 confirming the
existence of a local emergency based on the COVID-19 Pandemic. The Director issued
Administrative Order No. 1 on March 16, 2020, and issued an amended Administrative Order No.
1 on April 15, 2020.
On May 29, 2020, the L.A. County Health Officer issued the "Reopening Safer at Work and in the
Community for Control of COVID-19," which allowed for restaurants to safely reopen with certain
restrictions. In response, the City Manager amended Administrative Order No. 1 to implement the
County's order in the City of El Segundo and relax certain City standards relating to temporary
encroachment permits and temporary use permits. The Director requests the City Council ratify
the order and that such ratification be recorded in the meeting minutes.
Prosum Aureement for Technical Support relatine to COVID-19 Response
For over 10 years, the City has retained Prosum, Inc., to provide technical expertise and resources,
managing multiple projects for the City's Information Systems Department.
On May 29, 2020, the City Manager executed an agreement with Prosum, Inc. to provide
consulting services related solely to the City's response to the COVID-19 emergency, including
Information Technology Helpdesk services to configure and distribute computing, training and
troubleshooting equipment for remote workers; communications consultants to aid in keeping the
public and employees informed; and project Managers to aid in COVID-19 specific projects to
assist the Incident Management Team in wireless communications and network upgrades required
as a result of increased network activity. City staff plan on seeking reimbursement from the Federal
Emergency Management Agency (FEMA), and created a separate contract specific to COVID-19
response for that purpose.
The Director requests the City Council ratify the execution of the agreement and that such
ratification be recorded in the meeting minutes.

temporary outdoor dining or temporary outdoor retail uses within a portion of the onsite, off-street parking area
that serves the restaurant, retail food facility or retail operation. Temporary outdoor dining within an on-site, off-
street parking area must be conducted in accordance with El Segundo Municipal Code section 15-2-16 and the Los
Angeles County Health Officer's most current order. Temporary outdoor retail uses within an on-site, off-street
parking area must be conducted in accordance with the Los Angeles County Health Officer's most current order. A
Temporary Use Permit is required for the displacement of any on-site parking to allow additional space for outdoor
dining or outdoor retail uses. The Planning and Building Safety Director- or his designee is authorized to issue
Temporary Use Permits consistent with this paragraph. The Planning and Building Safety Director or his designee
may issue a temporary use permit pursuant to this paragraph without having first received the proof of insurance
required by the terns of the permit, provided that proof of adequate insurance is submitted to the Director or his
designee within 72 hours after issuance of the temporary pennit. If the applicant fails to timely provide proof of

Over the past several days, there has been civil unrest in the City of Los Angeles as well as in the
cities of Beverly Hills, Culver City, Santa Monica, West Hollywood, Long Beach and other
portions of Los Angeles County which has led to injuries to persons and destruction of property.
On May 30, 2020, Governor Newsom issued a Proclamation of a State of Emergency for Los
Angeles County and the City of Los Angeles.
The City of El Segundo is adjacent to City of Los Angeles and there is an imminent threat of the
civil unrest spreading to the City of El Segundo which could lead to extreme peril to life and
property in the City of El Segundo.
On May 31, 2020, there were protests planned in the City of Torrance on May 31, 2020, and the
City of Manhattan Beach on June 1, 2020, and there have been social media posts encouraging
people to bring the civil unrest to other South Bay Cities, including the City of El Segundo. On
May 31 and June 1, the County of L.A. Board of Supervisors imposed a Countywide curfew for
both unincorporated and incorporated areas of the County (including the City of El Segundo).
As of the date of this report, there have not been reports of any civil unrests in the City. Out
of an abundance of caution, however, and in response to the events above, the City Manager, acting
as the City's Director of Emergency Services, proclaimed a local emergency on May 31, 2020 (see

attached Exhibit). In addition, the Director issued Administrative Order No. 1, imposing a curfew
consistent with the County of L.A.'s order. The Director is now recommending the City Council
proclaim a local emergency by adopting the attached resolution and ratify Administrative Order
No. 1. (2020-1).
If the resolution is adopted and a local emergency is proclaimed, the City Council must review the
need for continuing the local emergency at its regularly scheduled meetings until the local
emergency is terminated. The review must take place within 60 days after the resolution is
adopted or the previous review. The City Council must proclaim the termination of the local
emergency at the earliest possible date that conditions warrant (Gov. Code § 8630).

RESOLUTION NO.
A RESOLUTION OF THE EL SEGUNDO CITY COUNCIL CONFIRMING
THE EXISTENCE OF A LOCAL EMERGENCY AND RATIFYING THE
CITY MANAGER'S ADMINISTRATIVE PROCLAMATION OF LOCAL
EMERGENCY DATED MAY 31, 2020 AND ADMINISTRATIVE ORDER
NO. 1.
The City Council of the City of EI Segundo does resolve as follows:
SECTION 1: The City Council finds that:
A. Over the past several days, there has been civil unrest in the City of Los
Angeles as well as in the cities of Beverly Hills, Culver City, Santa Monica,
West Hollywood, Long Beach and other portions of Los Angeles County
which has led to injuries to persons and destruction of property;
B. On May 30, 2020, Governor Newsom issued a Proclamation of a State of
Emergency for Los Angeles County and the City of Los Angeles;
C. The City of EI Segundo is adjacent to City of Los Angeles and there is an

accordance with EI Segundo Municipal Code Chapter 2-2 and issue
Administrative Order No. 1 to impose a curfew consistent with the County's
order;
G. Based upon information provided to the City Council by the City Manager,
acting as the Director of Emergency Services, including, without limitation,
set forth in the staff report accompanying this Resolution, it is apparent that
local resources are unable to completely cope with the effects of this
emergency; and
H. Accordingly, pursuant to EI Segundo Municipal Code (ESMC) section 2-2-
5, the Director of Emergency Services is hereby requesting the City Council
proclaim the existence of a local emergency.
SECTION 2: The City Council has reviewed the state of the community and ratifies the
City Manager's Proclamation of Emergency dated May 31, 2020, and Administrative
Order No. 1 imposing a Citywide curfew consistent with the County's order.
SECTION 3: In accordance with Government Code section 8630 and ESMC Chapter 2-
2, and applicable law, the City Council declares that due to such civil unrest, a local
emergency exists within the City of EI Segundo's territorial limits.
SECTION 4: The City Manager, as the Director of Emergency Services, is empowered
to carry out all emergency powers conferred upon him as the Emergency Services
Director by local and state laws, and by all other lawful authority, as may be necessary to
protect life and property.
SECTION 5: During the existence of this local emergency, the powers, functions, and
duties of the Emergency Services Director and the emergency organization of this City
will be those prescribed by state law, by ordinance, and resolutions of this City approved
by the City Council.
SECTION 6: Since local resources are unable to cope with the effects of this emergency,
the City Council directs the Emergency Services Director to forward a copy of this
resolution to the Los Angeles County Office of Emergency Management to be forwarded
to the Director of California Governor's Office of Emergency Services requesting that the
Director find it acceptable in accordance with State law and forward it to the Governor of
California with the request that the Governor proclaim the City of EI Segundo to be in a
state of emergency; that the Governor waive regulations that may hinder response and
recovery efforts; that recovery assistance be made available under the California Disaster
Assistance Act; and the State expedite access to State and Federal resources and any
other appropriate federal disaster relief programs.
SECTION 7: The Emergency Services Director is directed to send this resolution to
the California Office of Emergency Services (OES).
SECTION 8: Pursuant to Government Code section 3504.5(b), when the City Council
determines that an ordinance, rule, resolution, or regulation must be adopted immediately
without prior notice or meeting with a recognized employee organization, the Emergency
Services Director shall provide notice and opportunity to meet at the earliest practicable
time following the adoption of the ordinance, rule, resolution, or regulation.
SECTION 9: The City Manager is designated as the authorized representative for public
assistance and as the authorized representative for individual assistance of the City of EI
Segundo for the purpose of receiving, processing, and coordinating all inquiries and
requirements necessary to obtain available state and federal assistance.

SECTION 10: This local emergency will continue to exist until otherwise determined by
City Council Resolution. The City Council must review the need for continuing the local
emergency at least once every 60 days until the emergency is terminated.
SECTION 11: This Resolution will become effective immediately upon adoption and will
remain effective unless repealed or superseded.
SECTION 12: The City Clerk will certify to the passage and adoption of this Resolution; will
enter the same in the book of original Resolutions of said City; and will make a minute of
the passage and adoption thereof in the record of proceedings of the City Council of said
City, in the minutes of the meeting at which the same is passed and adopted.

PROCLAMATION OF A STATE OF EMERGENCY
WHEREAS on May 25, 2020, George Floyd tragically died in
Minneapolis, Minnesota, shortly following his arrest in which an officer of
the Minneapolis Police Department kneeled on his neck to detain him
during the arrest, and then did not respond to Mr. Floyd's requests for help
when he stated that he could not breathe; and
WHEREAS Los Angeles County and the City of Los Angeles have
requested State assistance including the activation of the California
National Guard based on the civil unrest the City and County of Los
Angeles report and based on limited local resources; and
WHEREAS I find that conditions of Government Code section
8558(b), relating to the proclamation of a State of Emergency, have been
met; and
WHEREAS under the provisions of Government Code section
8625(c), I find that local authority is inadequate to address the threat
posed by the civil unrest within Los Angeles County and the City of Los
Angeles.
NOW, THEREFORE, I, GAVIN NEWSOM, Governor of the State of
California, in accordance with the authority vested in me by the State
Constitution and statutes, including the California Emergency Services
Act, and in particular, Government Code section 8625, HEREBY PROCLAIM
A STATE OF EMERGENCY to exist in Los Angeles County and the City of Los
Angeles.
IT IS HEREBY ORDERED THAT:
1. All agencies of the state government use and employ state
personnel, equipment, and facilities or perform any and all
activities consistent with the direction of the Office of Emergency
Services and the State Emergency Plan. Also, all residents are to
heed the advice of emergency officials with regard to this
emergency in order to protect their safety.
2. The Office of Emergency Services shall provide assistance to Los
Angeles County and the City of Los Angeles, if appropriate and
necessary, under the authority of the California Disaster
Assistance Act, Government Code section 8550 et seq., and
California Code of Regulations, Title 19, section 2900 et seq.
3. The California National Guard shall mobilize under Military and
Veterans Code sections 143 and 146 to support response efforts
in Los Angeles County and the City of Los Angeles.

proclamation be filed in the Office of the Secretary of State and that
widespread publicity and notice be given of this proclamation.

Order Issued: May 31, 2020
By virtue of authority vested in me as the City Manager of the City of El Segundo pursuant
to the provisions of the E1 Segundo Municipal Code, Section 2-2-5, to promulgate, issue,
and enforce rules, regulations, orders, and directives, I hereby declare the following
orders to be necessary for the protection of life and property. This Order will take effect
immediately and remain in effect until the current local emergency is terminated by City
Council resolution.

The El Segundo Police Department, along with law enforcement authorities cooperating with the El Segundo
Police Department, are hereby authorized and charged, to the extent provided by law, with the responsibility
of enforcing this curfew and are further authorized to arrest such persons that do not obey this curfew after due
notice, oral or written, has been given to said persons. A violation of any of the above prohibitions constitutes
a misdemeanor under El Segundo Municipal Code Section 2-2-8 and is punishable by fines not to exceed
$1,000 or imprisonment not to exceed six months. Further, the violation of any provision of this Order is
declared to be a nuisance and may be abated by the City in accordance with its authority to abate nuisances.
The remedies listed in this Order are not exclusive of any other remedies available to the City under any
applicable Federal, State or local law.
This Order shall remain in effect until it is tenninated by either the Director of Emergency Services, the City
Council of the City of El Segundo, or the state of emergency is terminated.
