2020-02-04 CC Agenda - Public Communications related to Item #B3 -ADUHarada, Patricia From: Sent: To: Subject: Weaver, Tracy (City Clerk) Tuesday, February 04, 2020 1:13 PM *ALL CITY CLERKS FW: ADU and STRs - remaking the EI Segundo community into Los Angeles From: Ray Beckett [mailto:raymond_s_beckett@raytheon.com] Sent: Tuesday, February 04, 2020 12:41 PM To: ALL ELECTED OFFICIALS Subject: ADU and STRs - remaking the EI Segundo community into Los Angeles Dear EI Segundo City Council: This is respectfully submitted in support of maintaining EI Segundo as family friendly Community. There is great concern for adoption of these poorly planned concepts from the State of California and City of Los Angeles. Many of us moved here because it was not part of Los Angeles in governance and management. The waivers and exceptions made as part of these polices are in direct conflict with existing policy and undermine all the sound and noble efforts of past councils to maintain a quality of life for EI Segundo residents. Adoption of these ADU and STRs policies put EI Segundo on a path closer Los Angeles proper, what is next is adoption of LAUSD and LAPD? It is clearly possible once we turn all the RI's in to R2/R3's and STRs with ADU's. tiMCC 1nl Rules, it R-2 and R-3 T.ottes The intent of the ordinance is to allow one STR on a property in all residential zones. In the R-1 zone, one STR would be permitted either of a single-family unit (or portion) or of a permitted ADU, not both_ In the R-2 and R-3 zones, the draft ordinance includes special ruies to limit the number of STRs. In the R-2 and R-3 zones, if all dwelling units on the parcel are under common ownership (such as a duplex, triplex or apartment complex), then only one unit can be permitted as a STR; but if dwelling units on the parcel are under separate ownership (such as condominiums), then each dwelling (or portion) may be permitted as a STR. In the R-3 zone, an additional restriction is that ADUs may not be used as a STR. Please have the foresight to see these are failed policy steps, the city of Los Angeles just annexed and tore down a thousand low cost affordable apartments to expand LAX, without single family owner occupied RI's in place EI Segundo maybe the next LAX acquisition. I submit the following as proof this is bad policy, here is a real property on AirBNB in EI Segundo today, is this the future you want for EI Segundo ? All for $90 per night EI Segundo Casa Bonita - Tiny House Living El Segundo Hosted by Robert $9 0 per night Best regards- Ray Beckett 7 year resident and R1 property owner Harada, Patricia From: Shilling, Mona Sent: Tuesday, February 04, 2020 12:47 PM To: Harada, Patricia Subject: FW: Correspondence from Californians for Homeownership Attachments: 2020-1-20 - Californians Letter to City Council.pdf Patricia, The attachment and email below is Public Communication related to ITEM #3 on the 2020-02-04 CC Agenda, Thanks, Mona S From: Mitnick, Scott Sent: Wednesday, January 22, 2020 6:21 PM To: Shilling, Mona Subject: FW: Correspondence from Californians for Homeownership From: Matthew Gelfand fmailwadmin(tcaforhomes.oriRl On Behalf Of Matthew Gelfand Sent: Monday, January 20, 2020 11:56 PM To: Boyles,Drew (Mayor) <dbovlesPelseQundo.orP,>; Pirsztuk, Carol (Mayor pro tem) <coirsztuk(telseRundo.ore>; Brann, Don (Council Member) <dbrann(@elseeundo.org>; Nicol, Scot (Council Member) <snicoIPelseeundo.org>; Pimentel, Chris (Council member) <cnimenteI(@elseRundo.org> Cc: Lee, Sam <SLeePelseeundo.org>; McClain, Gregg <gmcclain(&eisePundo.org>; Mitnick, Scott <smitnick(@elseP,undo.org>; Hensley, Mark (City Attorney)<mhenslev(@henslevlawprouq.com>; King, David <d ki n e@ he ns lev lawP_rou v.co m > Subject: Correspondence from Californians for Homeownership To the City Council: Please see the attached correspondence regarding Agenda Item 14 being considered at your upcoming meeting. To the City Council: Californians for Homeownership is a 501(c)(3) non-profit organization devoted to using legal tools to address California's housing crisis. I am writing as part of our work monitoring local compliance with California's laws regarding accessory dwelling units (ADUs). This letter follows up on our December 12, 2019 letter to the Planning Commission commenting on the City's draft ADU ordinance. First, we want to commend staff for working to address the concerns raised in our prior letter. The draft being presented for your consideration is a major improvement. We also want to acknowledge the City's important recognition of its obligation to permit certain ADUs under Government Code Section 65852.2(e), as is detailed in the staff report before you. Second, we wanted to raise two remaining concerns, both relatively minor: • Proposed Municipal Code Section 15 -4E -3(B)(3) could be read to limit the setback exception to conversions that do not involve replacement of the existing structure with a new structure. The exception required by state includes "a structure constructed in the same location and to the same dimensions as an existing structure ...." Gov. Code § 65852.2(a)(1)(D)(vii). For clarity, this language should be integrated into the City's ordinance. • The parking requirement exception in proposed Municipal Code Section 15 -4E -3(F) includes only one of the five categories mandated by Government Code Section 65852.2(d). Among other things, the draft ordinance omits the exception for parking requirements if "[t]he accessory dwelling unit is part of the proposed or existing primary residence or an accessory structure." Perhaps the draft language was intended as an acknowledgment that all of the City's residential lots fall within the exception for public transit; if so, the ordinance should simply say 525 S. Virgil Avenue Los Angeles, CA 90020 Is January 20, 2020 Page 2 that parking is not required for the ADU. Otherwise, it should be revised to contain verbatim the complete language of Section 65852.2(d). We hope the information above is helpful to you as you move forward with the City's ADU ordinance.
