is within the subject -matter jurisdiction of the Planning Commission and items listed on the
Agenda during the Public Communications portion of the meeting. Additionally, the public can
comment on any public hearing item on the Agenda during the public hearing portion of such item.
The time limit for comments is generally five minutes per person.
Playing of video tapes or use of visual aids may be permitted during meetings if they are submitted
to the Planning and Building Safety Director a minimum of two working days before the meeting
and they do not exceed five minutes in length. Written materials distributed to the Planning
Commission within 72 hours of the Planning Commission meeting are available for public

4. Administrative Use Permit to allow an 18 foot Monument Sign on the Flyte
property at 2200, 2222, 2230 E. Imperial Hwy. (EA -1267)
Project Description: The applicant requests the approval of an Administrative
Use Permit to allow a 18 foot monument sign on the Northwest corner of the
property located at 2200, 2222, 2230 E. Imperial Hwy. The subject property is
located in the northeast portion of the city, and is bounded by Imperial Highway
and North Nash Street. The property is located in the Mixed Use North (MU -N)
Zone.
Environmental Determination: The project is categorically exempt from
the requirements of the California Environmental Quality Act (CEQA) as a
Class 11 categorical exemption (Accessory Structures).
RECOMMENDED ACTION: That the Planning Commission: (1) Receive and File
the Director of Planning and Building Safety's approval of Environmental
Assessment No. EA -1267 and Administrative Use Permit No. 19-02; and (2)
discuss and take any other action related to this item.

5. An Ordinance Amending Title 9 of the EI Segundo Municipal Code Related
to Wireless Facilities in the Public Rights of Way. (EA -1189)

Applicant: City of EI Segundo
Project Description: An ordinance adding Chapter 9 of Title 9 of the EI Segundo
Municipal Code to establish regulations for wireless communication facilities in the
public right-of-way. If the Planning Commission recommends approval of the
regulations, the City Council will consider the proposed ordinance at an upcoming
meeting. (Environmental Assessment No. EA -1189 and Zone Text Amendment
No. ZTA 17-03)
Environmental Determination: The project is categorically exempt under the
California Environmental Quality Act pursuant to 14 California Code of Regulations
§ 15301, 15302, 15303, 15304, and 15061(b)(3), because it establishes
regulations rather than development of actual facilities.
RECOMMENDED ACTION: That the Planning Commission: (1) Continue this
item to January 9, 2020.
6. Conditional Use Permit for New Wireless Communications Facility. (EA -
1265)
Address: 1904 E. EI Segundo Boulevard
Applicant: Josh Halminski, Smartlink LLC
Project Description: A request to install a new pole -mounted wireless
communications facility in a SCE transition line right-of-way. (Environmental
Assessment No. EA -1265 and Conditional Use Permit No. CUP 19-01).
Environmental Determination: The project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) as a Class 3
categorical exemption (new construction of small structures).
RECOMMENDED ACTION: That the Planning Commission: (1) open the public
hearing and take documentary and testimonial evidence; (2) after considering the
evidence adopt Resolution No. 2877; or (3) discuss and take any other action
related to this item.
7. An Ordinance Amending Title 15 (Zoning Ordinance) of the EI Segundo
Municipal Code regarding Accessory Dwelling Units and Junior Accessory
Dwelling Units. (EA -1247)

Project Description:
The proposed ordinance amends Title 15 (Zoning Code) of the EI Segundo
Municipal Code to update the City's requirements relating to ADUs and to create
requirements and development standards for JADUs. The Planning Commission
will consider the. proposed ordinance and make a recommendation to the City
Council. The City Council is the final decision-making body for the ordinance.
Environmental Determination: The proposed ordinance is statutorily exempt
from further environmental review under the California Environmental Quality Act
(California Public Resources Code §§ 21000, of seq., "CEQA") and CEQA
Guidelines (14 California Code of Regulations §§ 15000, of seq.), because it
involves the adoption of an ordinance regarding accessory dwelling units to
implement the provisions of Section 65852.2 of the Government Code as set forth
in Section 21080.17 of the Public Resources Code, pursuant to CEQA Guidelines
section 15282(h).
RECOMMENDED ACTION: That the Planning Commission: (1) open the public
hearing and take documentary and testimonial evidence; (2) after considering the
evidence adopt Resolution No. 2881; or (3) discuss and take any other action
related to this item.

H-1. Consideration and possible action regarding recommending the City Council approve
the Environmental Assessment (EA) 1253 and Zone Text Amendment No. 19-07 to reduce
setback requirements and allow certain encroachments for properties in the Urban Mixed
Use North and Corporate Office Zones. (ES)
Principal Planner Eduardo Schonborn gave the staff report. He displayed a table showing
the differences in development standards that can be found in the July 25, 2019 Planning
Commission Video log. The amendment will bring these large buildings closer to the
street, and would allow encroachments into the setback area that includes solar panels,
equipment, and outdoor dining and gathering areas. The zone text amendment cleaned
up the code, combining sections and deleting redundancies. Vice Chair Newman clarified
what the Planning Commission is recommending to the City Council. The applicant was
present for questions.

Open Public Communications
Ben Neiman, project applicant and owner of 550 N Nash was present for questions. He
said that they are interested in making the building more appealing to their new tenant,
asking for the ability to put a gathering space into the setbacks and change the look of the
outside.
Closed Public Communications
The commission discussed that the buildings are going to be closer together, but also that
there is an interest in making the buildings more people- friendly. Commissioner Hoeschler
asked if the FAR would change with decreased setbacks – Mr. Schonborn said that only
the setbacks would change, and the FAR is going to stay the same. There would not be a
design requirement to provide these amenities. The standards will still require a setback,
so it will not feel overwhelming or dangerous. There were several questions about design
review.

Director Sam Lee mentioned that the AC Hotel is now open, had an opening night
the previous evening. He mentioned that there would be a special meeting August
1 Sc for Raytheon to discuss the Development Agreement for Raytheon. He also
reminded everyone that August 6, 2019 would be the meeting date to discuss
Beach Cities Media Campus.

There was a brief discussion about outdoor dining potential in the downtown as
well as in Smoky Hollow.
Chair Baldino had a question about street sweeping and trash collection, and
asked who he could talk to – Jazmin Allen in Public Works.
Commissioner Hoeschler expressed his concern for affordable housing in the for -
sale model, and is curious to see how this will affect the DR Horton project.

Consideration and possible action regarding recommending approval of an
ordinance amending and possibly eliminating the affordable housing
requirement within the 540 East Imperial Avenue Specific Plan and
Development Agreement. (ES)
The applicant submitted a letter requesting that the item be moved to the regularly
scheduled meeting on February 28th, 2019.

H-5. Consideration of the FEIR, adopt a resolution recommending that City Council
approve the General Plan Amendment.
Principal Planner Eduardo Schonborn gave the staff report. He gave a brief history of the
item and the previous requests. In November, the applicant submitted a letter requesting
that the City reconsider the TopGolf Specific Plan, which had some slight modifications to
the TopGolf building, resulting in a 350 square foot increase in building size. Previous
space was shifted, where lobbies were shrunk, the lounge area was smaller, and corridors
and back of house were increased. The biggest increase is in the hitting bays, as the
suites for each hitting bay were made larger. Staff reviewed the increase to determine the
proper course of action. There is an increase, but it is not physically noticeable. A new
specific plan was done in order to add commercial golf entertainment facilities as a
permitted use, and allows for alcohol service through a CUP, and establishes development
standards for the specific plan area. There is also a General Plan amendment that will
amend the maps to read "The Lakes Specific Plan" and not "Open Space Parks. A change
of zone is required, and the proposed zoning for the site is proposed The Lakes Specific
Plan. There is also a Zone Text Amendment, which will add the Lakes Specific Plan to our
list of Zoning Designations to the Municipal Code. Additionally, there is a site plan review,
which will list the improvements on the site.
The Commission had questions regarding the SCE Easement behind the property and its
availability for golf holes, as well as parking, and the vehicle exit path from the facility. Vice
Chair Newman had a question about the traffic study, and whether City was still
comfortable with applying the traffic study done in 2017 to today. Eduardo confirmed that
he has been working with the Consultant Kimley Horn and its Project team, and has
discussed the study and the impacts and determined that the impact are not enough to
trigger a new Environmental Impact Report to be done, and that it can be covered by the
existing study. Additionally, there is a Conditional Use Permit to permit the sale of alcohol
on both the TopGolf site as well as the Golf Course. There also is a Lot Line Adjustment
application, which would adjust the property lines to match the boundaries of the subareas
within the specific plan. The EIR was circulated, and public comments were collected. The
impacts do not trigger any thresholds that would result in a statement of overriding
consideration. There are three areas that are being mitigated, which includes noise, air
quality, and hazards & hazardous materials. Construction noise, air quality from the trucks
and construction vehicles are appropriately maintained to not create an air quality issue,

and the hazards & hazardous materials is in the transport of materials and the demolition
of the existing clubhouse, as it was built at a time where there could have been asbestos
used in the original construction. It was determined that the modifications proposed were
adequately covered by the existing EIR.
Commissioner Wingate asked whether Chevron (who donated the land to the City) has
accepted the changes from Open Space to TLSP, Mr. Schonborn said that they had not
raised any concerns with the change. Commissioner Wingate also discussed a letter
submitted by Law Firm Sheppard Mullin, asking what needed to happen should the edits
need to be made. Mr. Schonborn said that because they are clarifications and minor
editorial comments and could be read into the record for the Council. The changes that
Sheppard Mullin brought up can be given as instructions to staff in the motion.
Chair Baldino opened Public Communications.
Taynor Micheli, Director of Real Estate and Development for Top Golf. The changes
come from experiences had at other TopGolf Facilities to make the program better. Mr.
Micheli mentioned that they have developed enough venues to gain knowledge and create
a more efficient design.
The Commissioners had several questions for the applicant. Vice Chair Newman
addressed that the bays are now larger, and that there is now beverage service on all
three levels. She asked what else was being improved. Mr. Micheli mentioned that the
bays are being modified to be deeper, to allow staff to set up events on the tee line, and
the number of occupants are not increasing. The number of bays has not changed. Chair
Baldino mentioned that they received an email from someone inquiring about a restroom
on Hole 4, and asked whether Mr. Micheli had any information regarding this. He said he
was not aware. He said that there would be two restrooms within the two buildings
(clubhouse and TopGolf), but not on the course.
Commissioner Hoeschler asked whether the 2:00 am cut off time was in regards to people
hitting at 2:00 am, Mr. Micheli said that people are still playing that late, as an
entertainment aspect. The energy is on the tee line even that late. The 2:00 am cut off will
be on Friday and Saturday nights, with a midnight closing time Sunday through Thursday.
Chair Baldino addressed the ABC alcohol service training, asked if there is any other
training provided to staff. Mr. Micheli mentioned that there is a Risk Management division,
all staff are trained to identify and not over serve. They have an obligation to maintain the
safety of their guests, take it very seriously. Vice Chair Newman asked if they have had
any accidents. Mr. Micheli have said that there are events that happen, such as ricocheting
golf balls and having to remove people, but they have security on premises and address
the issues promptly and learn from anything that happens.
Vice Chair Newman also asked how many TopGolf facilities there are, Mr. Micheli
mentioned there are 50 facilities to date, they have goals to get to 100. They have started
updating, fixing maintenance concerns, upgrading equipment and expanding to new areas
over the last 7 years. Vice Chair Newman asked what they are doing for the game of
golf, and asked whether juniors are picking up golf with TopGolf facilities. Mr. Micheli
mentioned that they have partnerships with the LPGA and PGA tours. TopGolf has
brought people to the game of golf because it is more relaxed. The golf community sees
TopGolf as a positive influence. Commissioner Keldorf asked what the new timeline for
permits and construction would be should full project approval be granted. Mr. Micheli said
it's about 6-7 months to get permitting and design, and hope to be in the ground by the
end of 2019, and then it takes at least 12 months to build. During construction, part of the
9 -hole course will be open — everything will be started concurrently, but the golf course is
to be open within 6 months, then the clubhouse, then the TopGolf Facility.
Commissioner Hoeschler brought up the two 50' screens in the driving range. The screens
are meant to be viewed by guests and only the guests, will be used to view live TV, and
other internal programs. Commissioner Hoeschler asked if you could see them driving on
PCH, Mr. Micheli said that it is possible that you could see it from PCH, but the screens
are in the back and should be mostly screened behind the building. There are no other
TopGolf facilities in Southern California.
Assistant City Attorney David King commented prior to the public providing
comments that all communications that were provided to the dais were also
provided to the public during the meeting.
Tom Courtney — Resident of Manhattan Beach, Small Business Owner in EI Segundo.
Longtime opponent of TopGolf, because he believes that because the golf course has
been in existence for 70 years and has mostly been paid for by non -EI Segundo residents.
He said nobody is going to be practicing golf at a TopGolf facility. He also brought
concerns about parking at this facility.
Mary Courtney — Resident of Manhattan Beach. She suggested that they should make
the rezoning a vote of the people, and that she wants to warn the commission that they
will pursue a referendum should the project be approved. She also said that the EIR is too
old, there are too many changes, and that the information given from the City has not been
consistent and that these factors be reviewed and made public. She urged that they do
not urge approval of the Zoning Change and will generate a referendum.
Linda Pollard — 45 year EI Segundo resident. Focusing concerns on two issues — the
business of the golf course is an enterprise fund, the land it sits on is not. The point is that
EI Segundo Open Space land was gifted to us and is being proposed to be rezoned for
the benefit of a big developer. The changes are extensive, and the money coming back
will never be enough to offset the impacts, and there will be permanent damage to the
surrounding community. The traffic study of the 2 year old EIR is dated and should be
redone given there are new developments since there. The item should not be approved.
The issues are too important.
Chair Baldino closed Public Communication.
Commissioner Wingate — TopGolf as presented is going to bring money into the city,
understands that people want it to stay the same, but the golf course has been running for
a long time and has not been economically self-sufficient. The demands of the city

financially are such that this will continue to provide opportunities to play, the putting green
is still there, and there are arrangements for youth and EI Segundo residents to have
special rates. This is a positive thing for the city.
Commissioner Hoeschler- TopGolf is making special concessions to those who want to
hit a bucket of balls, and that aspect was taken care of. There is a lower level for those
who want to hit balls, and not have the entertainment aspect of TopGolf. Kimley Horns
study was instigated by the City, but paid for by the applicant via a reimbursable
agreement, as there is no contact between the consultant and the applicant. The study
took 2 weeks, ample time to study the traffic.
Vice Chair Newman — Operational conditions # 45 addresses Mr. Courtney's concerns
about the parking. She asked about the legality of the referendum issue that Mrs. Courtney
raised. Mr. King said that there is no need for this to be approved by the voters, but there
is no legal requirement that the City make this an option to be voted on by the people. It
is still golf. We have not changed its use, but we have changed the way it is played.
Chevron has not objected to the change as the maker of the gift. It is a quit -claim deed to
the City.
Commissioner Keldorf — This meeting is not happening in a vacuum — there have been
enough meetings where operations and financials were discussed in great detail, and that
the City is currently subsidizing a public use, and that approval will not change the fact
that golf is still available. All arguments have been vetted to a good degree.
Chair Baldino — The reason we are here is because of a change of 350 square feet. The
City hired an outside consultant to see if the change would require a new EIR. The report
came back that it did not. In respect to parking — the facility needs 420 parking spots, and
they are providing 523 parking spaces. As a member of the Planning Commission, Mr.
Baldino was appointed to the RFP committee. He said the most lucrative proposal was for
an outdoor music venue, and remove the golf course entirely. With TopGolf, the City gets
to save their golf course, which has lost money for the City consistently. It is an enterprise
fund, and was designed by the City to sustain itself and give money back, and it has never
been able to do that. When people say that the City is subsidizing golf, that is true,
however, it is being subsidized for the 85% of people who do not live in EI Segundo. If
people are serious about saving the Lakes, there is no better plan than TopGolf, who is
going to redesign the course and give a brand new clubhouse. There are people who live
here who have never been to the Lakes but have been to several TopGolf facilities. The
Planning Commissions job is to evaluate what the consultant has done in regards to the
EIR, everything is here to be looked at, the change of 350 square feet does not require a
new EIR analysis, and he is glad that TopGolf is bringing the newest and best design. The
role of the Planning Commission is to approve the EIR, and recommend to City Council
that they approve of TLSP, but the nuts and bolts is all hammered out at the City Council
level. He is satisfied that this is the right move for the people of EI Segundo.
Mr. King recommended that both resolution titles be read into the record. If it is the
pleasure of the Planning Commission to include the recommendations of Sheppard Mullin
in the motion, to read those too.

affordable housing issues that are occurring in California now. Commissioner Hoeschler
sent the commission an email about the Urban Land Institute Conference on housing
happening in Newport Beach on February 5 & 6, 2019, and will have speakers to discuss
housing. Commissioner Hoeschler will attend and return back to the Commission with
findings.

The El Segundo Municipal Code allows monument signs up to 8 feet by right in non-residential
zones. Monument signs greater than eight feet, up to a maximum of 20 feet, require approval of
an administrative use permit (ESMC § 15-18-4(A)(1)(d)(1)). Administrative use permits are
approved by the Director but must be received and filed by the Planning Commission (ESMC §
15-22-7).
On December 4, 2019, the Director granted approval for a new 18 -foot tall, seven -foot wide corner
monument sign located at 2200, 2222, 2230 E. Imperial Hwy. The approval includes conditions
that protect the city from potentially negative impacts of constructing this monument sign. The
conditions, findings of approval, and environmental assessment are provided in the attached
approval letter. Staff believes that the project is appropriate for the location and will not create
unwanted impacts, and so recommends that the Commission receive and file this report.

CONDITIONS OF APPROVAL
Based on these findings and facts in support of these findings, the Director of Planning and
Building Safety Department approved the project, subject to the following conditions:
1. Any change to the monument sign, including the height, design, colors, materials,
dimensions, location and directional orientation, must be reviewed and approved by the
Director of Planning and Building Safety, prior to the construction of the modification.
The Director of Planning and Building Safety will make a determination regarding the
need for Planning Commission review of the proposed modification.
2. The monument sign is limited to a maximum height of 18 feet and a maximum of 150
square -feet per sign face.
3. The project shall comply with the EI Segundo Municipal Code and the latest editions of
the California Building Code (2016, Appendix H, Signs), California Electrical Code,
California Energy Code, and the California Green Building Standards Code.
4. If the sign is proposed to be lighted, submitted plans must show compliance with the
latest California Energy Code.
5. The monument sign must comply with all applicable laws including the ESMC, the
building code, electrical code, mechanical code, and grading code, at the time the sign
is constructed.
6. The Applicant agrees to indemnify and hold the City harmless from and against any
claim, action, damages, costs (including, without limitation, attorney's fees), injuries, or
liability, arising from the City's approval of Environmental Assessment No. EA 1267 and
Administrative Use Permit No. AUP 19-02. Should the City be named in any suit, or
should any claim be brought against it by suit or otherwise, whether the same be
groundless or not, arising out of the City's approval of EA -1267 or AUP 19-02, the
Applicant agrees to defend the City (at the City's request and with counsel satisfactory
to the City) and will indemnify the City for any judgment rendered against it or any sums
paid out in settlement or otherwise. For purposes of this section "the City" includes the
City of El Segundo's elected officials, appointed officials, officers, and employees.
7. The applicant must, if applicable, include the following note on the construction plans:
"No work is to occur on public right-of-way."
8. All construction related parking must be accommodated on-site.

Environmental Determination and Required Findings
Environmental Assessment:
After considering the facts and findings, the Director finds this project is categorically exempt
from the requirements of the California Environmental Quality Act (CEQA) pursuant to 14
California Code of Regulations section 15311 as a Class 11 categorical exemption (Accessory
Structures).
The proposed project involves an accessory structure (monument sign) and will not have a
significant effect on the environment.
Administrative Use Permit Findinas:
The following are the facts in support of each finding for this decision:
Findina 1:
There is compatibility of the particular use on the particular site in relationship to other existing
and potential uses within the general area in which the use is proposed to be located.
The proposed sign is similar in height and scale to other monument signs located in
the immediate area and is compatible with the surrounding buildings.
Findina 2:
The proposed use is consistent and compatible with the purpose of the Zone in which the site
is located.
1. The zoning for the site is Mixed Use North(MU-N). The purpose of the MU -N zone is
to provide for the development of office projects.
2. Monument signs greater than eight feet in height, up to a maximum of 20 feet in
height, in non-residential zones require an Administrative Use Permit in accordance
with the El Segundo Municipal Code (ESMC) Section 15-18-4(A)(1)(d)(1).
3. The project is harmonious in size, design, style, material, and appearance to the
buildings and sites which they occupy and surround.

The proposed location and use and the conditions under which the use would be operated or
maintained will not be detrimental to the public health, safety, or welfare, or materially injurious

BACKGROUND
In the EI Segundo Municipal Code wireless communications facilities on private property are
regulated in Chapter 19 of Title 15 (zoning code). The chapter serves two often competing
purposes—to protect the public safety, general welfare, and quality of life on one hand, and to
facilitate the deployment of wireless infrastructure in the city on the other. Since federal and
state laws prohibit considering the safety of radio equipment that complies with FCC standards,
and the technological requirements of wireless networks severely limits their location options,
cities rely on their ability to regulate the design of new sites to mitigate visual impacts that
these sites can have.
In California, it is rare to see a new tower application that is not preemptively proposed to be
disguised as a tree or embedded into a building's architecture. The various providers of wireless
service expect it will be a condition of approval. However, there are occasionally applications
that are so remote from public access that the need to disguise the facility is not easily justified.
This is one of those applications.
LOCATION
Although the address of the site provided by the applicant for this facility is 1904 E. EI Segundo
Boulevard, the location is actually approximately 1/2 mile south of EI Segundo Boulevard. In
fact, the site is also about the same distance from Pacific Coast Highway, Rosecrans Avenue,
and Aviation Boulevard. The nearest publically accessible street is Hughes Way near the
Raytheon gate, and that is over 300 feet from the proposed tower. The site is within a Southern
California Edison right-of-way that is fully paved with gravel. The area is sparsely used for
storage, but is mostly empty except for the base of transmission line towers. The proposed
wireless tower is to be along the south edge of the gravel area (see diagrams below).
Surrounding uses are a catchment basin, railroad land (mostly undeveloped), RV storage,
equipment storage, and parking lot for Raytheon. There are two existing antenna poles to the
east and close to Pacific Coast Highway, neither of which is camouflaged.

PROJECT DESCRIPTION
This proposed wireless facility will include a 60 foot tower with 12 eight -foot panel antennas
mounted at the top and a 4 foot diameter microwave dish antenna mounted on the pole
beneath the panel antennas. At the base of the pole will be an enclosure that is surrounded by
a chain-link fence and will house up to 4 equipment cabinets, one of which is a backup DC
power generator, as well as utility boxes and other necessary equipment.
The height of the tower exceeds the Open Space zone limit of 32 feet, but pursuant to ESMC
Section 15-2-3, radio antennas are exempt from this standard. Staff believes that 60 feet is
reasonable and is consistent with other wireless towers in the vicinity.
DISCUSSION
This proposed site is not visible from any residence in the city or surrounding cities. It will be
visible from some office or retail vantages, but the nearest will be about 1/4 mile away.
Raytheon has facilities that are closer but the site will only be visible from a few locations there
except the southern parking lots. There is no reason to propose disguising the tower or even
upgrading the equipment enclosure to a block wall.
ENVIRONMENTAL DETERMINATION
The project is categorically exempt from the requirements of the California Environmental
Quality Act (CEQA) pursuant to 14 California Code of Regulations §15301 as a Class 3 categorical
exemption (New construction of small structures).

A RESOLUTION APPROVING ENVIRONMENTAL ASSESSMENT NO. EA -1265, AND
CONDITIONAL USE PERMIT NO. CUP 19-01 TO LOCATE A WIRELESS
COMMUNICATIONS FACILITY ON A SOUTHERN CALIFORNIA EDISON
TRANSMISSION RIGHT-OF-WAY AT 1904 E. EL SEGUNDO BOULEVARD
The Planning Commission of the City of EI Segundo does resolve as follows:
SECTION 1: The Commission finds and declares that:
A. On August 26, 2019, Smartlink LLC, representing Verizon Wireless, filed an
application for Environmental Assessment No. EA -1265, Conditional Use Permit No. 19-1
and Variance 19-1, requesting approval for a new wireless communications facility on an
existing Southern California Edison right-of-way, on property located at 1904 E. EI
Segundo Boulevard;
B. The project applications reviewed by staff, which determined that a variance was
not required pursuant to ESMC 15-2-3, which exempts antennas from zoning height
limitations;
C. In addition, the City reviewed the project's environmental impacts under the
California Environmental Quality Act (Public Resources Code §§ 21000, et seq., "CEQA"),
and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et
seq., the "CEQA Guidelines");
D. On November 14, 2019, the Planning Commission held a public hearing to receive
public testimony and other evidence regarding the application including information
provided to the Commission by Smartlink, LLC on behalf of Verizon Wireless; and,
E. The Commission considered the information provided at the hearing and this
resolution, and its findings, are made, in part, based upon the evidence presented.
SECTION 2: Factual Findings and Conclusions. The Commission finds that the following facts
exist:
A. The subject site is located in the Open Space (OS) Zone, at 1904 E. EI Segundo
Boulevard. The subject property is an 11.5 -acre parcel located at the southeast corner of
EI Segundo Boulevard and Pacific Coast Highway and running southeast toward the
midpoint of a square enclosed by Pacific Coast Highway, EI Segundo Boulevard, Aviation
Boulevard, and Rosecrans Avenue.
B. The property is owned by Southern California Edison (SCE) and is currently
developed with several lattice transmission towers.
C. The subject site is bounded on the south and west by a drainage water retention
basin owned by the City of EI Segundo and by the Southern Pacific Railroad right-of-way,
on the north and east by the Raytheon campus.
D. The proposed project includes installing a wireless facility on a new 60 foot pole,
consisting of 12 eight -foot antenna panels, one microwave dish, and supporting
equipment near the base of the tower.
SECTION 3: Environmental Assessment. The proposed project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) pursuant to 14 California Code
of Regulations § 15301 as a Class 3 categorical exemption (New construction of small
structures).
SECTION 4: Zoning Code Findings. The proposed project conforms to the City's the
development standards for wireless facilities projects as specified in Chapter 15-19 of the City's
Municipal Code, as follows:
A. The underlying zoning for the site is Open Space (OS), which conditionally permits
utility facilities and other similar uses. The property is currently improved with SCE
transmission towers, and the proposed project would result in the placement of a
wireless communications facility as an accessory to the existing electrical transmission
use.
B. The purpose of the OS zone is "to provide adequate recreational opportunities
and to preserve open space for the anticipated needs of both present and future
residents and employees in the city" (ESMC §15-8-1). The wireless facility will not reduce
the recreational opportunities in the City, nor will it develop open space since the facility
would be located on an existing restricted right-of-way easement.
C. The subject site is surrounded by a variety of commercial, recreational, and light
industrial uses, and no residential uses are located in the vicinity.
SECTION 5: Conditional Use Permit/ Wireless Communications Facility Permit (Major) Findings.
After considering the above facts, the Commission finds as follows:
A. The proposed location of the conditional use is in accord with the objectives of
this Title and the purposes of the zone in which the site is located. The zoning
designation for the subject site is Open Space (OS). The purpose of this zone is "to
provide adequate recreational opportunities and to preserve open space for the
anticipated needs of both present and future residents and employees in the city" (ESMC
15-8-1). The wireless facility will not reduce the recreational opportunities in the City, nor
will it develop open space since the facility would be located on an existing transmission
tower on the subject property.
B. That the proposed location of the conditional use and the conditions under which
it would be operated or maintained will not be detrimental to the public health, safety or
welfare, or materially injurious to properties or improvements in the vicinity. The

proposed location of the conditional use is surrounded by a variety of commercial,
recreational, and light industrial uses, and no sensitive land uses are adjacent to or near
the proposed wireless communications facility that could be impacted by the operation
of the facility. The use is also subject to certain conditions in the attached Exhibit A.
Accordingly, given the nature of the surrounding uses and immediate area, and the
absence of any residential uses in the vicinity, the proposed location of the conditional
use and the conditions under which it would be operated and maintained will not be
detrimental to the public health, safety or welfare, or materially injurious to properties
or improvements in the vicinity.
C. That the proposed conditional use will comply with each of the applicable
provisions of Chapter 15-19 of the Zoning Code. The proposed project is consistent with
Chapter 15-19 of the Zoning Code, which requires a major facility to obtain approval of a
conditional use permit.
D. The proposed major wireless communication facility complies with all additional
or different requirements made applicable by Chapter 15-19. The underlying OS Zoning
designation allows utility facilities, which the subject property already supports, and the
proposed wireless facility would be ancillary to such use. There is compatibility of the
particular use on the particular site in relationship to other existing and potential uses
within the general area in which the use is proposed to be located.
SECTION 6: Approval. Subject to the conditions listed on the attached Exhibit A, which are
incorporated into this Resolution by reference, the Planning Commission approves
Environmental Assessment No. EA -1265 and Conditional Use Permit No. 19-1.
SECTION 7: This Resolution will remain effective unless superseded by a subsequent
resolution.
SECTION 8: The Commission Secretary is directed to mail a copy of this Resolution to Synergy
Development Services and to any other person requesting a copy.
SECTION 9: This Resolution may be appealed within 10 calendar days after its adoption. All
appeals must be in writing and filed with the City Clerk within this time period. Failure to file a
timely written appeal will constitute a waiver of any right of appeal.
SECTION 10: Except as provided in Section 9, this Resolution is the Commission's final decision
and will become effective immediately upon adoption.

CONDITIONS OF APPROVAL
In addition to all applicable provisions of the EI Segundo Municipal Code, Verizon Wireless agrees
to comply with the following provisions as conditions for the City of EI Segundo's approval of
Environmental Assessment No. EA -1265 and Conditional Use Permit No. 19-1:
Zoning Conditions
1. This approval is for the project as shown on the plans reviewed and approved by the
Planning Commission on November 14, 2019, and on file with the Planning and Building
Safety Department. Before the City issues a building permit for the wireless facility, the
applicant must submit plans, showing that the project substantially complies with the plans
and conditions of approval on file with the Planning and Building Safety Department. Any
subsequent modification must be referred to the Planning and Building Safety Director for
a determination regarding the need for Planning Commission review and approval of the
proposed modification.
2. This approval allows for a new wireless communications facility comprised of the following:
• A new monopole with up to 12 eight -foot antennas mounted at the top, and a 4 -
foot diameter microwave dish also mounted near the top of the pole, all of which
shall not exceed a height of 60 feet;
• A 400 square foot enclosure around the equipment area at the base of the
monopole, with accompanying equipment cabinets and utility hardware;
• Underground electrical and telco connections to the equipment enclosure from the
sources of these services near Hughes Way.
3. The facility must not bear any signs or advertising devices other than required signs, such
as certifications, warnings, or other seals or safety related signs.
4. The applicant must promptly remove any graffiti on the facility. The applicant must provide
the Planning and Building Safety Director the name and contact information for an
individual or individuals who are available 24 hours for the removal of any graffiti from the
facility. If graffiti is reported to this contact person by the City and not removed within 24
hours of such notification, the City may remove the graffiti at the applicant's expense. An
invoice for any such expenses shall be provided by the City to the applicant, and the
applicant must pay any such invoice within 10 days of receipt.
5. In the event that any of these conditions conflict with the recommendations or
requirements of another permitting agency or City department, the stricter shall apply.
6. Cables must be installed on the inside of the monopole. All cabling, trays, and antenna
panels must be painted to match the monopole to the satisfaction of the Planning and
Building Safety Director prior to building permit final.
7. The maximum height of the enclosure fence must not exceed 8 feet in height.
8. No wireless communications facility or accessory equipment installed or operated as part
of a Verizon Wireless facility shall interfere with any City emergency transmission signal or
form of communication.
9. The wireless facility must be maintained in good condition at all times, to the satisfaction
of the Planning and Building Safety Director.
Building Safety Conditions
10. Plans must be submitted to the Building and Safety Division for review and approval prior
to issuance of a permit.
11. The plans must include all applicable calculations, which may include wind and seismic
anchorage requirement for all equipment and must be designed and approved by a
licensed Engineer.
12. The plans must include all required attachment methods for all equipment and antenna
panels located within the enclosure or mounted on the monopole.
13. The facility must be erected, located, operated and maintained at all times in compliance
with ESMC Chapter 15-19 and all applicable laws, regulations and requirements of the
building code, and every other code and regulation imposed or enforced by the City, the
State, and the United States Federal Government. The applicant must obtain all applicable
building and construction permits that may be required prior to erecting or installing the
facility.
Miscellaneous Conditions
14. Approval of this permit shall not be construed as a waiver of applicable and appropriate
zoning regulations, or any Federal, State, County and/or City laws and regulations. Unless
otherwise expressly specified, all other requirements of the EI Segundo Municipal Code
shall apply.
15. Failure to comply with and adhere to all of these conditions of approval may be cause to
revoke the approval of the project by the Planning Commission, pursuant to the provisions
of the EI Segundo Municipal Code.
16. In the event that any of these conditions conflict with the recommendations or
requirements of another permitting agency or City Department, the stricter standard shall
apply.

17. The applicant agrees to indemnify and hold the City harmless from and against any claim,
action, damages, costs (including, without limitation, attorney's fees), injuries, or liability,
arising from the City's approval of Environmental Assessment No. EA -1265 and Conditional
Use Permit No. 19-1. Should the City be named in any suit, or should any claim be brought
against it by suit or otherwise, whether the same be groundless or not, arising out of the
City approval of Environmental Assessment No. EA -1265 and Conditional Use Permit No.
19-1, the Applicant agrees to defend the City (at the City's request and with counsel
satisfactory to the City) and will indemnify the City for any judgment rendered against it or
any sums paid out in settlement or otherwise. For purposes of this section "the City"
includes the City of EI Segundo's elected officials, appointed officials, officers, and
employees.

Chapter 4 of the Smoky Hollow Specific Plan allows property owners and developers to submit
Community Benefit Plans to the City outlining specific benefits in exchange for approval of
increases in development intensity and/or other specified exceptions from the Specific Plan's
standards. The Community Benefit Plans are divided into two levels of review, or tiers, depending
on the types of exceptions requested. Community Benefit Plans falling under Tier I must be
evaluated by the Planning Commission, and those falling under Tier II must be evaluated by the
City Council based on specific findings listed in the Specific Plan. This is a new process for the
City, so staff has developed a methodology for evaluating the Community Benefit Plans and will
present its methodology to the Planning Commission at its meeting on December 12, 2019. To
prepare for the presentation, attached are relevant materials, including excerpts from the Specific
Plan.

D. Change of Occupancy. When all or a portion
of a building is modified in such a manner,
including how it is used, such that the
Building Code occupancy group is changed,
parking, as required by this Specific Plan,
shall be provided for the entire building and
all other buildings on the same lot.
4.4.5 Nonconforming Curb Cuts
Existing nonconforming curb cuts along street
frontages shall be removed subject to the
following provisions:
A. New Buildings. When new buildings are
constructed on a lot, any nonconforming
curb cuts on the property shall be removed.
B. Additions to Buildings. When additions to
structures add 50 percent or more of the
gross floor area of existing structures on
a lot, all nonconforming curb cuts shall be
removed.
4.5 PROJECT REVIEW AND
APPROVAL PROCESS
All projects proposed within the Smoky Hollow
Specific Plan area shall substantially conform
with the provisions of this Specific Plan.
4.5.1 Administrative Adjustments
The Administrative Adjustment review
process allows limited exceptions to certain
development standards. In addition to the
instances allowed by ESMC Section 15-24-1
(Adjustments), a property owner or authorized

agent of the property owner may file an
Administrative Adjustment application
whenever any one of the following deviations
from the provisions of this Specific Plan is
proposed:
A. Condition of Approval. If an Administrative
Adjustment process is not already included
in an approved conditional use permit or
administrative use permit, a minor deviation
from a condition of approval.
B. Development Standards. A deviation in any
numeric development standard, excluding
the number of required parking spaces,
density, height, or floor area ratio, not
exceeding 10 percent.
C. Curb Cuts for Additions. A deviation from
the standard required by Section 4.4.5.13
(Additions to Buildings).
Findings and required notice for Administrative
Adjustments shall comply with ESMC Chapter
15-24 (Adjustments).
4.5.2 Community Benefits Plan
Community benefits are based on the principle
that in exchange for allowing incremental
increases in development intensity, the
community should, in return, receive certain
benefits, including beneficial design features
such as publicly accessible open space and
other development requirements that serve the
community's core needs. Any project in Smoky
Hollow proposing a deviation from development
standards beyond the minor deviations allowed
by Section 4.5.1 Administrative Adjustment shall
submit a Community Benefits Plan for review
and approval by the Director. The Community
Benefits Plan shall outline the request for
flexibility from strict interpretation of the
development standards and regulations of this
Specific Plan, as well as the proposed public
amenities, features, and improvements prioritized
in this Specific Plan that would be provided.
Examples of potential community benefits
include, but are not limited to, publicly accessible
open space, publicly accessible parking,
enhanced accessibility improvements, and
implementation and/or funding of streetscape
improvements identified in this Specific Plan.
See Table 4-1: Community Benefits Plan for a
description of the process and requirements for
Community Benefits Tiers I and II.
4.6 APPEALS
All appeals pertaining to the Smoky Hollow
Specific plan shall be conducted in accordance
with the provisions of ESMC Chapter 15-25.
4.7 SPECIFIC PLAN
MODIFICATIONS AND
AMENDMENTS
Modifications to the text or exhibits of this
Specific Plan may be warranted in the future
to accommodate unforeseen conditions or
events. The City will process revisions pursuant
to California Government Code Section 65450,
et seq. All Specific Plan amendments shall be
found consistent with the EI Segundo General
Plan in compliance with Government Code
Section 65454. The Specific Plan may be
amended as often as deemed necessary by the
City Council in compliance with Government
Code Section 65453.

2.2.1 Land Use Objectives
These land use objectives are broad policy
statements intended to guide land use decision-
making:
► Encourage commercial and industrial
development that promotes new and
established businesses and sustains
economic growth while also preserving
Smoky Hollow's postwar industrial
character, history, authenticity, and fine-
grained architectural scale.

2.2.2 Zoning Districts
To identify specific areas for certain allowed
uses and development standards, the Specific
Plan establishes four zoning districts (see
Figure 2-1: Zoning Districts).
The Smoky Hollow East (SH -E) zoning
district provides a transitional land use
area between higher -intensity office uses
east of Sepulveda Boulevard and the
smaller, single -parcel industrial and creative
businesses of the western portion of the
Smoky Hollow area. The SH -E zoning
district accommodates development
of incubator industrial, research, and
technology uses; medium-sized light
industrial and manufacturing; and creative
office activities.
The Public Facilities (PF) zoning district
designates property for public uses
necessary to support community needs,
such as libraries, fire stations, schools, and
utilities.
► The Parking (P) zoning district identifies
land that is currently used or expected
to be used as a parking facility either as
surface lots or parking structures.

This section presents guidelines to assist
applicants in developing high-quality building
rehabilitation, additions, and new construction
projects in Smoky Hollow. Guideline concepts
are noted over photographic examples of
project types; these concepts are further
described in the written design guidelines that
follow the photographic examples.
Applicants and their design teams should
utilize the following design guidelines to the
maximum extent for all construction projects.
The design guidelines are organized into five
key themes:
